HomeMy WebLinkAbout1962-373 ORDINANCE NO „..-4Z2 ,410 • AN ORDINANCE providing for the annexation by the City o Yakima of certain property contiguous to the City of Yakima, and zoning said property. WHEREAS, proceedings have been held in accordance with Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS; at a regularly scheduled meeting of the Planning Commission of the City of Yakima, a hearingwas held pursuant to legal notice, upon the zoning and land use classification of said property hereinafter des- , cribed and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the:City of Yakima and made recommendations as to the zoning for said.properthand EREAS, said proposed area to be annexed to the City of Yakima is moreithan 10 acres in area, and WHEREAS, the City Council has heretofore determined that it would approve the proposed annexation and that it would not require the property owners of such area to assume the existing indebtedness of the City of Yakima, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, the Mayor of the City of Yakima, the Chairman of the Board of Yakima County Commissioners the Chairman of the School Board of Yakima School District No. 7, the Representative of the State Department of Commerce and Economic Development, and a Resident and Property Owner of the area pro- posed to be annexed met and considered all of the factors set forth in said Chapter 282, Laws of 1961 and at the conclusion of said meeting made • -1- and entered their findings and determinations with respect to such annex 4111 ation and recommended to the City Council of the City of Yakima that said proposed area be annexed to the City of Yakima, and WHEREAS, pursuant to due and legal notice as provided by law and City Charter, a public hearing was held upon said petition for annexation be- , fore the City Council of the City of Yakima on the 13th day of August, 1962, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as hereinafter set forth for the reasons that such zoning and classification is in accord with good planning and with the comprehensive plan of the City of Yakima that the majority of the property owners in the vicinity do not oppose the classification orthe annexation, that the needs of the City and • Community do require the hereinafter set forth zoning classifications and that the highest and best use for said property is as hereinafter determined, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property contiguous to the City of Yakima, Washington, to-wit: • • Beginning at a point on the North line of the Southwest Quarter of Section 26, Township 13 North, Range 18, E.W.M.; 331.86 feet East of the Northwest corner of said Southwest Quarter; thence East along North line of said Southwest Quarter to a point 443.2 feet West of the Northeast corner of the Northwest quarter, Southwest Quarter of said Section subdivision; thence South 0 13 East 144.51 feet; thence East 110 feet; thence North 0 6 West 144.51 feet to the North line of the Southwest Quarter,. Section 26, Township 13 North, Range 18, E,W.M.; thence East along the North line of said Southwest Quarter to the extended East line of Hamilton Acres Addition, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington; thence South along the 111 -2- East line of Hamilton Ares Addition to the South line of 111 the Northwest Quarter, Southwest Quartel', Section 26, Township 13 North, Range 18, E.W.MA thence West along said South line to a point 332.86 feet East Of the South-. west corner of the Northwest Quarter, Southwest Quarter, Section 26, Township 13 North, Range 18, E.W.M., thence North 0 23 East 1,326.28 feet to the North line of the Southwest Quarter of Section 26, Township 13 North, Range 18, E.W.M.„ which is the point of beginning; and, Beginning at the intersection of the centerline of Nob Hill Boulevard and the centerline of South 24th Avenue; thence East along the centerline of Nob Hill BoUlevard to the centerline of South 22nd Avenue; thence South along the centerline of South 22nd Avenue 242.8 feet; thence, West and parallel with the centerline of Nob Hill Boule- vard to the centerline of South 24th Avenue; thence North along the Centerline of South 24th Avenue to the center- line of Nob Hill Boulevard which is the point of beginning; is hereby annexed to the City of Yakima, Washington: Section 2. That the owners of the hereinbefore described real property • annexed to the City of Yakima shall not be required to assume existing'in debtedneSs of the City of Yakima. Section 3, That the hereinbefore described real property annexed to the City of Yakima is hereby zoned as follows: - (a) The following described property is hereby zoned as R.-2 Two Family Residence Zone: Beginning at a point on the North line of the Southwest Quarter of Section 26, Township 13 North, Range 18, E.W.M. 331.86 feet East of the Northwest corner of said Southwest Quarter; thence East along North line of said Southwest Quarter to a point 4)13.2 feet West of the Northeast corner of the Northwest Quarter, Southwest Quarter of said Section subdivision; thence South 0° 13 East 144.51 feet; thence East 110 feet; thence North 0 6 West 144.51 feet to the North line of the Southwest Quarter, Section 26, Township 13 North, Range 18, E.W.M; thence East along the North line of said Southwest Quarter to the extended East line of Hamilton Acres Replat, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Wash- ington; thence South along the East line of Hamilton Acres Replat to the South line of the Northwest Quarter, Southwest 411 quarter, Section 26, Township 13 North, Range 18, E.W.M.; thence —3— West along said South line to a point 332.86 feet East of the Southwest Corner of the Northwest Quater, South- . west Quarter, Section 26, Township 13 North, Range 18, E.W.M.; thence North 0 441 23" East 1,326.28 feet to the North line of the Southwest Quarter of Sect.on 26, TOwnship 13 North, Range 18, E,W.M., which is the point of beginning; EKCEPT,Lot'18, Block 2, of the Plat of Applewood Manor as recorded in the office of the Auditor of Yakima County, Washington. • (b) That the following described property is hereby zoned B-2 Local Business Zone: Lot 18, Block 2,'of Applewood Manor Addition according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington; and, The North 242.8 feet, of the West 280,5 feet of the Northwest Quarter, Northwest Quarter, Southeast Quarter of .3eCtion 26, Township North, Range 18, E.W.M. (c) The following described property is hereby zoned M-1 Light Indus- . trial Zone: Beginning at the intersection of the centerline of Nob Hill Boule- vard and the centerline of South 24th Avenue; thence East along the centerline of Nob Hill Boulevard to the centerline of South 22nd Avenue; thence South along the centerline of South 22nd Avenue 242.8 feet; thence West and parallel with the centerline of Nob Hill Boulevard to the centerline of South 24th Avenue; thence North along the centerline of South 24th Avenue to the centerline of Nob Hill Boulevard, which is the point of • beginning; EXCEPT the North 242.8 feet of the West 280.5 feet of the Northwest Quarter, Northwest Quarter, Southeast Quarter, cf Section'26, Township 13 North, Range 18, E.W.M.; all of which above described property is situated in Yakima County, Washington. Section 4. That the next regularly amended Use District Map prepared by and for the City of Yakima shall show said property as hereinbefore zoned and classified. Section 5. The City Clerk is herebyauthorized and directed to file a certified copy of this ordinance with the County .Auditor of Yakima 411 and the Board of County Commissioners of Yakima County. -4- , Section 6. This ordinance shall be in full fore and effect 30 days 11/ after its final passage, approval and publication, as provided by law and by the City Charter.
