AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Im- provement District, providing for the method of paymelit thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following streets shall be improved by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with necessary drainage features: le No. 54th Avenue from Englewood Avenue to Englewood Hill Drive. 2. Englewood Hill Drive from a point 270' East of Minnesota Avenue to a point 880 East of Minnesota Avenue. 3. No 47th Avenue from Englewood Avenue to a point 700' north thereof. 4. Mavis Avenue from No 40th Avenue east to the Yakima Valley Canal Company RAT, 5. No. 42nd Avenue from the Yakima Valley Canal Company R/W to Mary Lin Drive. 6. Mary Lin Drive from No 42nd Avenue to a point 500' west thereof. 7. Barge Street from No. 42nd Avenue to a point 510' west thereof. 8. Willow Street-North and South of P.P. & L. Wasteway from No 6th Avenue to a point 145' west of No. 9th Avenue. 90 The North 206.3' of Hanratty Drive. 10, So. 21st Avenue from West Viola Avenue to a point 300', more or less, south of Logan Avenue. 11. Plath Avenue from So. 18th Avenue to So. 20th Avenue. 12. Conestoga Blvd. from No Nob Hill Road to a point 750', more or less, east thereof. 13. So. 28th Avenue from Nob Hill Blvd, to W. Viola Avenue, Section 2. That East Washington Street from South First Street to the N.P.R.R. R/W shall be improved by grading, ballasting and facing with with asphaltic concrete and Portland Cement concrete, together with any necessary drainage features. pectim2. Section 4. There is hereby created a Local Improvement District to be called "Local Improvement District No.:412 which said district shall include all of the property adjacent to the above-mentioned im- provements which are subject to assessments said property being described above. Section 5. The assessments shall be made according to special 411 benefits to be derived from the iuprovements without regard to the zone and termini method' Section 6 All costs and expanses in connection with the con- struction of said improvements inauding the cost and expense of engineering inspection advertising publication of notices and all other expenses incident thereto 9 shall be levied and assessed upon all the property embraced within said Looal improvement District in the manner and as provided by the Laws el' the State of Washington and the ordinances of the City of Yakima and said City shall not be liable iy1 any manner for any portion of said costs and expenses of said imProve- ment, 6- Section 7. All of the aforesaid construction work shall be in accordance with the plans and speoifications profiles maps and de- o tailed drawings which have been prepaed by the City Engineer filed with the City Clerk and which are hez approved and adop�,ed© Section 8. All of the work necessary to be done in connection with the making of said improvement shall be done and made by contract • upon competitive bids, and the City shall have the power to reject any and all bids. • Section 9. There is hereby created a special fund, to be called "Local Improvement Fund District No.Aga," into which shall be placed all sums paid on account of the aforesaid special assessments, including • all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all •premium and interest on said bonds issued for said improvement* Section 10, Bonds bearing interest at the rate of 4% per annum, _ payable on or before 2_2!years from the date of issuance, shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be • levied and assessed upon the property within said district, payable in ten equal annual installments with interest at the rate of 4% per annum, interest payable annually, under the mode of payment "payment by bonds," 0 ! as defined by the statutes of the State of Washington and the ordinances of the City of Yakima; provided, that this improvement may be financed by the issuance of promissory notes, under the authority of ROW 35,45.150.
