ORDINANCE NO. 110 AN ORDINANCE relating to building regulations; adopting by reference the Western Plumbing Officials Uniform Heating & Comfort Cooling Code, 1962 Edition, of the Western Plumbing a„ Officials Association, and making amendments thereto; providing for the issuance and revocation of installer's license; requiring installer's surety bond and insurance; adopting a permit fee schedule; declaring violations to be misdemeanors and providing a penalty; and miending Chapter 11.32 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA Section 1. That Section 11.32.010 of the City of Yakima Municipal Code is hereby amended to read as follows: 11.32.010 ADOPTION OF WESTERN PLUMBING OFFICIALS UNIFORM HEATING & COMPORT COOLING CODE. The Western Plumbing Official's Uniform Heating & Comfort Cooling Code, 1962 Edition, of the Western Plumbing Officials Association, except as hereinafter specifically amended or changed, is hereby adopted as the Uni- form Heating & Comfort Cooling Code of the City of Yakima, and the provisions and regulations thereof are hereby adopted as • the provisions and regulations of the City of Yakima, and the several Sections or numbers therein shall constitute the numbers and may be referred to as the numbers of this chapter," Section 2. That Section 11..32.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.020 FILING OP CODE. Three copies .of the Western Plumbing Officials Uniform Heating & Comfort Cooling Code, 1962 Edition, of the Western Plumbing Officials Association, shall be filed for use and examination by the public in the office of the City Clerk Section3.. That Section 11.32.030 of the City of Yakima Municipal Code is hereby amended to read as follows: 11.32.030 AMENDMENT TO SECTION 1.11--COST OF PERMITS. Section 1.11 of said Uniform Code is hereby amended to read as follows: 1.11--COST OF PERMITS. Every applicant for a permit to install, add to, alter, relocate, or replace a heating system, appliances, comfort cooling system, or part thereof, shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in con- nection therewith, together with such information pertinent thereto may be required. -1- Such applicant shall pay for each permit issued and at the time of issuance, a fee in accordance with the following 111 schedule, and at the rate provided for each classification shown therein. Any person who shall commence any warm air heating or comfort cooling work for which a permit is required by this Code without first having obtained a permit thereof shall if subsequently permitte to obtain a permit pay double the permit fee fixed by this section for such work, with an addi- tional charge of $10.00. Provided, however, that this pro- vision shall not apply to emergency work when it shall be Proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencement of the work. in all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreason- able delay in obtaining such permit, shall pay a double fee as herein provided with an additional charge of $10.00. Section 4. That Section 11.32.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.040 AMENDMENT TO SECTION 2C3--STANDARDS. Section 203 of said Uniform Code is hereby amendea_by adding•to Table 2—A 110 thereof the following: • 'N.B.F.U, Pamphlets 90A, 90B, 54 and 31; AGA Information Letter No 90;' as acceptable standards to assist ia the administration of said Uniform Code." Seption5. That Section 11.32.053 of the Cite of Yakima Municipal Code is hereby amended to read as foLlows: "11.32.050 ADDITION OF NEW SECTION TO UNIFORM CODE. There is hereby added to said Uniform Code following Section 203. a new section number 204 to read as follows: 204--EXCEPTIONS TO STANDADS. Notwithstanding the stanthxds and guides set out in Section 203 hereof oil tanks will not require pressure tests in domestic installations; dual purpos gas—oil burners may have a pilot line ahead of the manual main shut—off valvo; and chimneys used for gas equi:?ment must have liners or be provided with metal liner of correct size for the attache equipment v except that burners using 350000 BTU/hr input or more do not require metal linc.r.." Section 6. That Section 11.32.060 of the City of Yak:Lma Municipal Code is hereby amended to read as follows: • • 11.32.060 AMENDMENT TO SECTION 1207—CERTIFICATE OF . All • INSPECTION. Section 1207 of said Uniform Code is hereby amended by adding thereto a subsection (d) to read as • follows: 1207--CERTIFICATE OF INSPECTION. . . (d) Certification of inspection- and approval of as installations shall be by attaching metal "City of Yakima" seal to gas piping and by telephone verification to the Gas Company.'" Section 7.. That Section 11.32.070 of . the City of Yakima Municipal Code is hereby amended to read as 'follows: 11.32.070- AMENDMENT TO SECTION 1211--GAS METER LOCATIONS. Section 1211 of said Uniform Code is hereby amended by adding . thereto a subsection (g) to read as follows: 1211--GAS METER LOCATIONS. (g) All gas meters shall be located outside of buildings, and those meters now installed inside or under buildings shall . be moved to the outside when additional equipment is added, or if existing equipment is replaced.'" Section 8. That Section 11.32.080 of the City.of Yakima Municipal • Code is hereby amended to read as fellows: 11.32.080 DEFINITIONS. •As used in this' chapter the following terms shall have the following meanings (a) HEATING AND/OR COMFORT COOLING INSTALLER means any person, firm or corporation who installs, contracts to install or serves ices, repairs, alters or cleans any or all types of heating and cooling. appliances. (b) JOURNEYMAN means any person engaged in the actual work of installing or servicing any heating or comfort cooling appliance, and who is the authorized holder of a valid and subsisting 'Journeyman's License. This license may be re- stricted to gas, oil or comfort cooling., solid fuel or furnace cleaning. (e) APPRENTICE means any person engaged in the actual work of installing or servicing any heating or comfort cooling appliance and who is the authorized holder of a valid and • subsisting 'Apprentice Permit.' (d) HEATING AND/OR COMFORT COOLING APPLIANCE means an appliance which utilizes gas, liquid, solid fuel or elec- tricity for the purpose of heat and/or ceoling, and shall include all necessary piping-and duct. work„ and shall also include piping for all gas appliances including such app1i- 111 ances as gas refrigerators, (e) FURNACE CLEANER means one.who cleans furnaces., changes filters, removes hot and cold air ducts and smoke pipes for • cleaning,.and lubricates' motors and fans; however, he shall not make adjustments of combustion or controls on any type of heating and/or cooling equipment." -4- • Section l. That Section 11.32.090 of the City of Yakima Municipal • Code is hereby amended to read as follows: "11.32.090 LICENSE AND BOND REQUIRED. It shall be unlawful for any person, firm or corporation to engage in the business of installing or contracting to install any type of heating or comfort cooling appliance without first having obtained and being the authorized holder of a valid and subsisting 'Heating and/or Comfort Cooling Installer's License obtained according to and in compliance with the provisions of this chapter and without having filed with the City Clerk a valid and subsisting surety bond as hereinafter provided." Section 10. That Section 11.32.100 of the City of Yakima Municipal Code is hereby aEended to read as follows: 11.32.100 FEE FOR INSTALLER'S LICENSE. The fee for such Heating and/or Comfort Cooling installer's License shall be Fifty Dollars ($50.00) and Twenty-Five Dollars (125.00) re- newal, per annum for each establishment or place of business of each such heating and/or comfort cooling installer to be taken out in case of individuals in the name of the person owning the business, and in the case of firms or corporations, in the name of such firm or corporation which license expires one year fro date of issue." Sectipall. That Section 11.32.110 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.32.110 SURETY BOND AND LIABILITY INSURANCE. The surety bond required of heating and comfort cooling installers by Section 11.32.090 hereof shall be in the sum of One Thousand Dollars (1 for each establishment or place of business maintained by any person, firm or corporation as a heating and/or comfort cooling installer payable to the City of Yakima for the use and benefit of said City and any and all persons dealing with the licensee or his agents in his capacity as a heating and/or comfort cooling installer and shall be executed by the applicant and by a surety company authorized to do business in the State of Washington, which bond shall be con- ditioned that the licensee and his agents shall fully comply with all provisions of law relating to installations of heating and/or comfort cooling appliances and that any person injured by failure to comply therewith may have a right of action on said bond in his own name and that the principal and sureties shall pay all judgments recovered against the principal for any violation of or failure to comPly with said provisions of law; provided that such action must be commenced within one (1) year after completion of the work. The total and aggregate liability of the surety under the aforementioned shall in no event exceed the sum of One Thousand Dollars (8 A condition precedent to the issuance of the license referred to in Section 11.32.090 hereof shall be the filing with the City Clerk by the applicant of a policy of insurance commonly known • , . , . . . • . as Public Liability and Property Damage Insurance and Products • Liability insurance in an amount of not less than $10,000.00 • for each person and $20,000.00 for each incident for personal injury and $10 for property damage for each -ilicideAt . - . of liability; and such license when issued•shall- remain valid during .such time only as said policy of insurance shall remain • in full force and effect." • . . . . Section 12, That Section 11,32.120 of the City of Yakima Municipal Code is hereby amended to read as follows: • "11.32.120 JOURNEYMAWS LICENSE OR APPRENTICE PERMIT REQUIRED.. It shall be unlawful for 'any person to install or service any •. heating and/Or comfort cooling appliance without first having obtained and being the authorized holder of a valid and sub sisting 'Journeyman's License' or without first having obtained.. ...• and being the authorized holder of a valid and subsisting 'Apprentice Permit' obtained according to and in compliance • with the provisions of this chapter' _ . . . • Section 13, That Chapter 11.32 of the City of Yakima Municipal Code is hereby amended by adding thereto 9 following Section 11.32.120 . . a new section numbered 11.32.130 to read as follows: • • i1 JOURNEYMAN'S LICENSE OR APPRENTICE PERNIT--FEE. The fee for such journeyman's License shall be Five Dollars . (S5.00), and Two Dollars (A2,)0) for renewal per annum for each person. The fee for such Apprentice Permit shall be Two Dollars (S2.00) per annum for each person. Each separate examination will require payment. of an addition Five Dollars ($5.00) fee." • . Section 14. • That Chapter 1l32 of the City of Yakima Municipal Code is hereby amended by adding thereto l following Section 11.32.130, a new section numbered 11.32.140 to read as follows: . • . 11.32.140 JOURNWAN'S•LICENSE--APPLICATION--LIMITATION. No Journeyman's License shall be issued until such time as • the applicant has made app34cation to the Examining Board and has shown a proper degree of proficiency as determined by an examination conducted by the Examining Board a Said:journeyman's License may be issued for installation or servicing of heating and/or comfort cooling appliances. Said license shall indicate which type or types of fuel the holder is authorized to install or service may be limited to cleaning on1y may be for installa- tion and servicing of comfort coolingaequipment, or may be for all of them," • . III Section 15. That Chapter. 11.32 of the City of Yakima Municipal Code 16 hereby amended by adding thereto, following Section 11.32.140, a new section numbered 11,32,150 to read as follows: , -6- . "11.32,150 APPRENTICE PERMIT--APPLIOATION--TIME PERIOD, An Apprentice Permit shall be issued upon written application. • . signed by the proposed employer under the following'regulations: (a) Number of apprentices shall not exceed the number of journeymen in any one employment. • (b) The holder of an Apprentice Permit shall work under the • supervision of a journeyman'at. all times. (c) The holder of an Apprentice Permit shall serve as an apprentice for a period of not less than eighteen (16) months nor more than sixty (60) months unless such time is extended • by action of the Examining Board." Section 16, That Chapter 1132 of the City of Yakima Municipal Code is hereby amended by adding thereto y following Section 11.32.150 a new section numbered 11.32.160 to readas followst 11.32.160 EXAMINING BOARD--EXAMINATIONS--FEES. There is hereby created an Examining Board who shall periodically hold examinations.for the purpose of determining the degree of proficiency of journeymen installers and service men and issuing Journeymen's .Licenses to those qualified. The Examining Board shall consist of the Fire Marshal of the City of Yakima the Plumbing Inspector, the Electrical Inspector and two Heating and/or Comfort Cooling Installers one member from the Gas Company and one Journeyman appointed by the City Manager f each of whom shall serve for a term of one year or until his suc- cessor has been duly appointed© Members of the Board•shall serve without compensation. e • The Examining Board shall have the power to make rules and regulations not inconsistent with this chapter. However f no limit shall be Placed upon the number of' journeymen that may be licensed. Said Examining Board is hereby authorized and empowered to hold such examinations 'for the purpose of examining applicants for similar licenses issued by other cities and towns . in the State of Washington at the request o± such city or town through its duly authorized representative and such city or town shall pay to the City of Yakima the sum of Five Dollars ($5.00) per application. -and the City Clerk of the City of Yakima is hereby authorized and directed to execute appropriate . vouchers to effect the collection of such feea It shall be the duty of this Examining Board to act as a Board of Appeals in making a correct determination of any appeal arising from the actions of the Administrative Authority. Said Board shall keep an accurate record of all its official transactions and shall render such report and statistics as the Department having jurisdiction may require and direct." Section 17. That Chapter 11.32 of the City of Yakima Municipal 411 Code is hereby amended by adding thereto f .following Section 11.32.160 a new section numbered 11.32a170 to read as follows -7- • 11.32.170 REVOCATION OF LICENSE—PROCEDURE, Any license S or permit issued hereunder shall be revoked by the City Clerk .upon recommendation of the Examining Board for fraud or mie- , representation in making application for license or permit or in carrying out any work for which the license or permit is required, or for failure to comply with any provision of this • • chapter,' The holder of any license or permit revoked shall have the right of appeal to the City Council from such revoca tion by filing a notice of appeal with the City Council within ten (10) days after such notice of revocation is mailed by . registered mail to the address of the licensee by the City Clerk. The hearing on the appeal shall be held before the City Council or a •committee thereof as directed by the City . Oounci1 At the hearing the holder of the license shall be entitled to be heard in person, to produce witnesses and to be represented by counsel. • The action of the City Council on the question shall be final and conclusive Sectipn 18. That Chapter 11.32 of the City of Yakima Municipal Code is hereby amended by adding thereto, following Section 11.32.170p a new section numbered 11.32.180 to read as follows: . "11.32.180 PENALTY FOR VIOLATION--$EPARATE OFFENSES. Any person, firm or corporation who shall violate or fail to comply . with any of the provisions of this ohapter, or who shall counsel, • aid or abet any such violation or failure to Comply, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall. be punished by a fine in any sum not exceeding Three Hundred Dias ($300.00) or by imprisonment in the City Jail for a term not exceeding ninety (90) days, or by both such 'fine and imprisonment; and every person, firm or corporation shall be deemed guilty of a separate offense for every day such violation, disobedience, neglect-or refusal shall continue and shall be subject to the penalty of the section for each and separate offense." Section 19. That Chapter 11.32 of the City of Yakima Municipal Code is hereby amended by adding thereto, following Section 11,32.180p a new section numbered 11.32.190 to read as follows: "11.32a90 SEVERABILITY. If any section or provision or part thereof, of this chapter shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the act as a whole any section provision or part thereof not adjudged invalid or unconstitutional." Section 20. This ordinance shall be in full force and effect 30 • days after its final. Passage, - approval and publication, as provided by . law and by the City Charter. • -8- . .
