HomeMy WebLinkAbout1962-403 ORDINANCE NO 410 AN ORDINANCE relating to fire prevention; adopting by reference the Fire Prevention Code, Edition of 1960, of the National Board, of Fire Underwriters 4 and making amendments thereto; establishing a Bureau of Fire Preventien, and 'prescribing it duties; defining terms; and repealing Chapters 10.04, 10.12, 10.16 and 10.28, and creating Chapter 10005, all of.the City of Yakima Municipal BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Chapters 10.04, 10012 10.16 and 10.28. of, the City of Yakima Municipal Code are hereby repealed in their entireties. Section 2. There is hereby created a new chapter of the City of YakiMa Municipal Code, to be known as Chapter 10005--FIRE PREVENTION CODE, which chapter Shall read as follows: , • "Chapter 10.05 • - FIRE PREVENTION CODE 10.05.010 ADOPTION OF FIRE PREVENTION CODE, The Fire Pre— vention Code, Edition of 1960 of the National Board of Fire, Underwriters, together with the , November 1961 Amendments Corrections 'to the Fire Prevention Code, 1960 Edition, recom— mended by The National Board of Fire Underwriters,' except as the sane are hereinafter specifically amended or changed, are hereby adopted as the Fire Prevention Code of the City of Yakima; and the provisions and regulations thereof are hereby adopted as the provisions and regulations of the City of Yakima; and the several sections or numbers therein shall constitute the numbers, and may be referred to as the numbers, of this chapter. • 10,05.020 PILING OF CODE, Three copies of the Fire Pre— vention Code, Edition, of 1960,,of the National Board of Fire . . Underwriters, together with three copies of the 'November 1961 Amendments and Corrections to the Fire Prevention Code, 1960. Edition, recommended by The National Board of Fire Underwriters,' shall be filed for use and examination by the public in the office of the City Clerk. 10,.05.030 AMENDMENT TO SECTION 27.1(a) OF THE FIRE PREVENTION CODE. Section 2701(a) of the Fire Prevention Code adopted by this chapter is hereby amended to* read as follows: 27.1 Permit Required. a. No place of assembly as defined in paragraph b of this section shall be maintained ,. operated or used as such without a permit.' • , —1— 10.05.040 AMENDMENT TO SECTION 1.10 OF THE FIRE PREVENTION CODE Section 1.10 of the Fire Prevention Code adopted by this chapter is hereby amended by adding thereto a subsection f to read as follows: 1.10 Permits. f There shall be no charge or fee for the permits required by this code unless the provision requiring the per- mit Specifies a charge or fee to be paid for such permit, in which event such charge or fee shall be 'paid before such per- mit is issued. Unless this code otherwiSe specifies, the effective duration of any permit shall be for an indefinite: period of time until the use or occupancy of a building or premise authorized by the permit, or the activity authorized by the permit, is changed or discontinued; and on the occur- rence of a change or discontinuance of the use or occupancy of a building or premise, or the activity, authorized by a permit, the permit holder shall forthwith notify the Fire Marshal of the City of Yakima of such change or discontinu- ance.' 10.05.050 DELETION OF ARTICLE 13 OF FIRE PREVENTION CODE. Article 13 of the Fire Prevention Code adopted by this chapter is hereby deleted in its entirety from such code. 10.05.060 AMENDMENT TO SECTION 28,7(b) OF FIRE PREVENTION CODE. Section 28.7(b) of the Fire Prevention Code adopted by 110 this chapter is hereby amended to read as follows: 28.7 Storage of Readily Combustible Materials. b. Storage Requirements. Storage in buildings shall be orderly, shall not be within two feet of the ceiling, and not so located as to endanger exit from the building. Storage in the open shall not be more than 24 feet in height, shall be so located, with respect to adjacent buildings, as not to constitute a hazard, and shall be compact and orderly.' 10.05.070 ADDITION OF A NEW SECTION TO THE FIRE PREVENTION CODE. There is hereby added to the Fire Prevention Code adopted by this chapter a new section, to follow Section 1406 of such code, which new section shall be numbered Section 14.7 and shall read as follows: `14 ©7 Certificate of Fitness for Recharging Extinguishers. It shall be unlawful for any person to repair or fill any portable fire extinguisher unless such person has obtained from the Fire Marshal a Certificate of Fitness to do so. Each applicant for a Certificate of Fitness to repair or fill port able fire extinguishers shall be at least twenty-one years of age, able to speak, read and write the English language under- standingly, shall be reliable and have good judgment, and shall be familiar with the necessary work and the materials used in repairing and filling portable fire extinguishers. Whenever -2- the Fire Marshal shall find that a person holding such a certificate'is careless ,'negligent or unfitted ,for the work 411 for which it is issued, the Fire Marshal is hereby authorized to revoke Or Suspend such certificate. . , . 10.0.5080 :BUREAU OF FIRE PREVENTION—ESTABLISHMENT AND DUTIES, There is hereby:created in the Fire:Department a. • Bureau of Fire Prevention. Said Bureau shall be under the control and supervision Of the Chief of the Fire Department and shall consist of a Fire Marshal to be appointed: by the Chief of the:Fire Department, in acbordanceWith Civil Service Rules and Regulations, and as many members of the regularly constituted Fire Department as may be necessary to enforce the provisions of this chapter, The provisions of this chap- ter shall be enforced by the Bureau of Fire Prevention. A report of the Bureau of Fire Prevention shall be Made annually and transmitted to the Chief of the Fire Department, which report shall contain all activities of the Bureau with such statistics as the Chief of the Fire Department may require. The Chief of the Fire Department and the Fire Marshal may adopt and promulgate rules and regulations for the purpose • of carrying out the provisions of this chapter. 10.05.090, DEFINITIONS, (a) Wherever the word "Municipality" is used In the Fire prevention Code adopted by this chapter, such word shall mean the City of Yakima. (b) Wherever the term "corporation counsel" is used in • the Fire Prevention Code adopted by this Olapter, such term shall mean the City Attorney for the City of Yakima. (c) Wherever the term of the Bureau of Fire Pre- vention" is used in the Fire Prevention Code adopted by this chapter, such term shall mean the Fire Marshal of the City of Yakima. . _ 10,05.100 CUMULATIVE PROVISION. The provisions of this chapter shall be cumulative and in addition to any and all provisions of. the Building Code or other codes of the City of Yakima, • 10.05110 SEVERABILITY. If any section,.subdivision, sentence or clause of this chapter is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this chapter. 10.05.120 PENALTY FOR VIOLATIONS--SEPARATE OFFENSES. Any person, owner, tenant or occupant who shall violate or fail to comply with any of the provisions . of this chapter or orders or notices lawfully issued thereunder shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine in any bum not to exceed Three Hundred Dollars ($300.00) or by imprisonment in the City Jail for any term not to exceed ninety days, or by both such fine and imprisonment. The -3- failure of a building to comply with any provisions of this chapter shall be deemed a violation on the part of both the owner and occupant. Every person convicted of a violation of • any of the provisions of this chapter shall deemed guilty of a separate offense for every day such violation, disobedi- ence, neglect or refusal shall continue and shall be subject to the penalty of this section for each and every separate offense." Section 3.
