HomeMy WebLinkAbout1962-407 V \ ORDINANCE NO. 111 AN ORDINANCE setting forth requirements for off-street parking facilities in residential zones and on lots adjacent • to residential zones; allowing the Board of Adjustment to make certain exceptions; and amending Section 12.566100 and adding a new section to be known as Section 12.56,110, both of the City of Yakima Mianici-, pal Code WHEREAS, the City Council of the City of Yakima heretofore passed a resolution indicating its intention to amend Section 12656.100 . of the City of Yakima Municipal Code, and WHEREAS, the Planning Commission of the City of Yakima due and legal notice, held a public hearing on said proposed amendment and as a result thereof, has recommended to the Council, the passage Of an ordinance amending Section 12656.100 and establishing a new section to be known as Section 12.56.110, both of the City of Yakima • Municipal Code, all as hereinafter set forth, and WHEREAS, on December 28, 1962 after due and legal notdoe, the • the City Council held a public hearing on the recommendations -af-the- Planning Commission and as a result thereof, finds that the passage of such an ordinance would be in the best interests of the people of the City of Yakima, now therefore, BE IT ORDAINED BY THE CITY OF YAKIMA! Sectionl. That Section 12.566100 of the City of Yakima Municipal Code is hereby amended to read as follows: 12.56.100 OFF-STREET PARKING IN R-1 AND R-2 ZONES. Hereafter, any off,-street parking facilities established :in an R-1 or R-2 Zone or on a lot adjacent to a lot in an R-1 cr R-2 Zone shall he developed in accordance with the following requirements: (1) The renting of parking spaces shall be prohibited. Al, (2) Any lighting used to illuminate said parking area shall be so arranged as to reflect the light away from the adjoining residential premises. -1- (3) When such a parking area is located in a residence zone, screening by a tight fence from four to six feet in heighth or a combination of fencing and landscaping shall be provided and maintained along the property line(s) which adjoin any lot in an "R" zone except in the required front yard. Surfacing for such areas may be to the property lines when screening is by a tight fence. Then the re- quired front and side yard setbacks shall be maintained by curbs or suitable bumper guards, When screening is by landscape materials, the required front and side yards shall be maintained with grass or other evergreen ground cover. • (4) Where such a parking area adjoins the side of a lot in an "R" zone, screening shall be provided and main- tained along the side of such lot except in the required front yard. Surfacing for such areas may be to the prop- erty line. Then the required front and side yard setbacks shall be maintained by curbs or suitable bumper guards. (5) Such parking area shall be paved or otherwise surfaced to otherwise eliminate dust and mud. (6) Parking facilities shall be arranged so as not to necessitate the use of any part of adjoining public side- walks, parkways, roadways, boulevards, or thoroughfares, in conducting parking or unparking operations, except for ingress and egress." Section 2 That Chapter 12.56 of the City of Yakima Municipal Code is hereby amended by adding thereto, following Section 12.56.100„. a new section numbered 12.56.110 to read as follows: "12.56.110 OFF-STREET PARKING IN R-3 ZONE. Hereafter, any off-street parking facilities established in an R-3 Zone or on a lot adjacent to a lot in an R-3 Zone, which adjacent lot is zoned other than R-1 or R-2 shall be developed in accordance with the following requirements: (1) The renting of parking spaces shall be prohibited, (2) Any lighting used to illuminate said parking area shall be so arranged as to reflect the light away from the adjoining residential premises. (3) When such a parking area is located in an R-3 Zone, screening by a tight fence at least four feet in heighth„ •by landscaping of such heighth„ or by a combination of fencing and landscaping of such heighth, shall be provided and maintained along the property lines which adjoin all other lots in an R-3 Zone. Such parking areas may be surfaced to the property lines. faCle All parking areas shall be paved or otherwipe sur- d to eliminate dust and mud, and adequate on-site drainage shall be provided. -2- (5) Suitable curbs or bumper guards shall be installed to prevent vehicles from being parked so as to encroach on adjoining private property, public sidewalks or street or alley rights of way in violation of this section and to prevent obstructions to-view at intersection streets, (6) Parking facilities shall be so arranged as not to use any part of adjoining public sidewalks or street or alley rights of way in conducting parking operations, ex- cept ingress and egress; provided, however, that if public sidewalk adjoins the lot on which the parking area is located, the Board of Adjustment may permit the area between the lot and the inner edge of the sidewalk, or any Portion of the area to be surfaced and used for parking,c' Section 3.. This ordinance shall be in full force and effect 30 days after its final passage„ approval and publication as required by law and by the City Charter.
