HomeMy WebLinkAbout1963-432 ORDINANCE NO. 42Z AN ORDINANCE vacating a public utility easement located within Ham- berg's Addition to the City of and declaring an emergency. WHEREAS, the City of Yakima presently holds a public utility ease- ment 20 feet wide across Lots 19, 20, 25 and 26 of Hamberg'sAddition to the City of Yakima, and WHEREAS, the owners of said lots desire that said easement be reduced in width from 20 feet to 12 feet, and said owners have executes and delivered to the City easement deeds for the purpose of reinstatin{ a 12-foot easement as a substitute for the easement vacated by this ordinance, and WHEREAS, the City Council finds such a 12-foot easement is ade- quate to meet the requirements of the City for the continued operation and maintenance of the utility existing in said easement and for the construction of any new utility which may hereafter be installed; and further finds that it is in the best interests of the City to vacate said existing easement and to accept said easement deeds to reinstate said 12-foot easement, and hereby declares and emergency to exist, now • therefore, BE IT ORDAINED BY THE CITY OF,YAKIMA: Section 1. That the public utility easement across the following described real property situated in the City of Yakima, Washington, to-wit: A strip of land 20 feet wide, the center line of which is described as follows: Beginning at a point on the East line of the West Half of the West Half of the. Southeast Quarter of the Northwest Quarter of Section 23, Township 13 North, Range 18, E.W.M., 200,8 feet South of the Northeast corner thereof; thence West parallel with Summitview Avenue to the West line of said subdivision; ALSO DESCRIBED AS: The South 10 feet of Lots 20 and 25 and the North 10 feet of Lots 19 and 26, all in Hamberg's Addition to the City of Yakima, County of Yakima, State of Washington, -according to the plat thereof recorded in Volume "I-P of Plats, page 48, records of Yakima County, Washington; be, and the same is hereby, vacated. Section. 2.
