HomeMy WebLinkAbout1963-441 -.` ORDINANCE NO. • AN ORDINANCE regulating garbage storage, collection and disposal and /,-- defining terms; and amending Sections 4.16.010, .130, .140, .180, and .210 and repealing Section 4.16.200 and Chapter 4.20, all of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Section 4.16.010 of the City of Yakima Municipal Code is hereby amended by changing paragraph (c) thereof to read as follows: 4.16.010 DEFINITIONS. (c) RAW GARBAGE: Waste material from kitchens, dining rooms and similar places from which liquids have been drained." Section 2. That Section 4.16.130 of the City of Yakima Municipal Code is hereby amended to read as follows: "4.16.130 PREPARATION OF GARBAGE FOF. COLLECTION--REGULATIONS • TO BE FOLLOWED. (a) It shall be unlawful for any person, firm or corporation in the Residential Classification, as hereinafter classified, to dispose of or store garbage in refuse containers unless such garbage has been prepared for collection, removal and disposal and complies with the definition of 'prepared garbage' as set out in this chapter; except, however, that fruit and vegetable wastes which contain a high moisture content and are not sus- ceptible to ready draining shall be deposited as near as possible with ashes or other refuse of a dry nature. (b) It shall be unlawful for any person, firm or corporation in the Business Classification, as hereinafter classified, to dispose of or store garbage in refuse containers unless such garbage has been prepared for collection, removal and disposal and complies with the definition of 'raw garbage' as set out in this chapter; except, however, that fruit and vegetable wastes which contain a high moisture content and are not susceptible to ready draining shall be deposited as near as possible with ashes or other refuse of a dry nature," Section 3. That Section 4.16.140 of the City of Yakima Municipal • Code is hereby amended by changing paragraph (b) thereof to read as follow: _1_ "4.16.140 CLASSIFICATION OF PRENISES—CHAEGES (b) The collection of all refuse in the Pusiness Classifice, tion shall be made only by licensed collectcrs, hereinafter provided for at rates to be agreed upon between such collectee and the business houses served by him." Section 4 That Section 4.16.180 of the City of Yakima Muni ::L Code is hereby amended by changing paragraphs (c) and (f) thereof ie read as follows "4.16.180 COLLECTION OF GARBAGE IN BUSINESS CLASS--REGULATIMS, (c) Applications for such license shall be made to the City Clerk upon forms to be provided by the City. Such license sliee be issued for each individual truck used ane shall include male:, year, type, model and truck number, Said truck number shall plainly marked on doors and tailgate of each truck. City license for each individual truck shall be carried on the vehicle at en times. No license shall be granted unless the applicant thereCor shall comply with the following requirements: 1. Applicant shall furnish a bond in the sum of $5,000.00 with good and sufficient sureties, to be approved by tkw 4111 City Attorney, conditioned on the faithful compliance b applicant with the provision e of this chapter and further conditioned that the collectflon, transportation and die- posal of garbage, refuse and debris shall be carried on by such applicant according eo the lav's of the State of. Washington, the ordinances of the City of Yakima, and such rules and regulations ae may, from time to time, ne made by the Health Officer of the City of Yakima. 2 All trucks of applicant shall be of the 'dump' type, and beds thereof must be of metal construction and completc:,y watertight. Truck beds must be kept clean and free of any accumulation of garbage or other refuse. 3. Applicant must have each truck manned by at least two able-bodied men in Fire Zone No. 1 to the end that loadena; or unloading may be accomplished in the quickest possihi,e time. (f) The owner or person in control or charge of each build ,n4 in the Business Class shall maintain for garbage storage and ii posal metallic cans of the same ty?e as provided in Section 4.1:).1.7 paragraph (c) thereof, or such other type of container as may 1 r.) , approved by the Health Officer of ehe City of Yakima for the 1 posit therein of all garbage and refuse. Garbage containers dean be placed on the premises in such a manner and at such a locaei)n 0') so as to be readily accessible for collection and shall not LH a kept on the street, alley, sidewaie or other public place; p that such garbage cans or other approved containers may be pleed -2- on a platform or rack in the alley in back of the premises in a location approved by the Chief of the Fire Department with the lids for the cans or containers chained and locked or otherwise secured to the platform or rack. Lids shall not be removed except while garbage is being placed in or removed from the receptacles. At the option of the owner or other person in control or charge of such building, trash, only, may be kept on the premises in any suitable receptacle capable of ready handling. Upon permit first being obtained therefor from the City Fire Department, such person may maintain in the alley in back of such premises an all-metal box with tight-fitting lid for the deposit therein of trash only. Such metal boxes shall be constructed and placed as directed by the Fire Department. Lids thereof must be kept closed at all times except while refuse is being placed therein or removed therefrom." Section 5. That Section 4.16.210 of the City of Yakima Municipal Code is hereby amended to read as follows: "4.16.210 FRUIT REFUSE IN BUSINESS CLASS. There is hereby excepted from the Business Class of collection all fruit refuse from any fruit processing plant or warehouse in the City of Yakima. Such fruit refuse shall be disposed of by such fruit processing plants or warehouses in such a manner so as not to create a nuisance." Section 6. That Section 4.16.200 and Chapter 4.20 of the City of Yakima Municipal Code are hereby repealed. Section 7. This ordinance shall be in full force and effect 30 days after its final passage, approval and publication as provided 5y law and by the City Charter.
