AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 1402 West Yakima
Avenue and 1210, 1212 and 1214 Terrace Street in the City
of Yakima from R-3, Multiple Family Residence Zone, to
B-1, Modified Business Zone.
WHEREAS, after proper petition and due notice, a hearing was held
before the City Planning Commission on February 5, 1963, upon the
petition of Mrs. June Buchanan to rezone property located at 1402 West
Yakima Avenue and 1210, 1212 and 1214 Terrace Street in the City of
Yakima, Washington, and more fully described as follows:
Lot 1, Block 14, and Lots 5, 6 and 7, Block 13, all
in Milroys Plat as recorded in Volume "An of Plats,
page 34, records of Yakima County, Washington;
from R-3, Multiple Family Residence Zone, to B-1, Modified Business
Zone, and
WHEREAS, said Planning Commission by letter notified the City
Council of the City of Yakima of its recommendation that such rezone
be granted, and
WHEREAS, a hearing was held by the City Council on the 25th day
0 of February, 1963, after due and proper notice, and the City Council,
as a result of such hearing, disapproved the recommendation of the
Planning Commission and duly requested a further report of the Plan-
ning Commission, and
WHEREAS, after due and proper notice, the City Planning Commis_
sion further considered such rezone in a public hearing held on the
2nd day of April, 1963, and, as a result of such public hearing,
reaffirmed their original recommendation that such rezone be granted
and duly notified the City Council of their decision, and
WHEREAS, the City Council held a hearing on the 22nd day of April
1963, after due and legal notice, upon the reaffirmed recommendation
of the Planning Commission that such property should be rezoned as
B-1, Modified Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the fol-
lowing reasons, to-wit: That such rezoning is in accord with good
planning and with the Comprehensive Plan of the City of Yakima; that
the majority of property owners in the vicinity do not oppose the

change in classification; that the needs of the City and community do
require such change; and that the highest and best use is for Modified
Business purposes, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
• Section 1. That the recommendation of the Planning Commission of
40 the City of Yakima that the following described real property located
at 1402 West Yakima Avenue and 1210, 1212 and 1214 Terrace Street in
the City of Yakima and more particularly described as follows, to-wit:
Lot 1, Block 14, and Lots 5, 6 and 7, Block:13, all
in Milroys Plat as recorded in Volume "A" of Plats,
page 34,reoords of Yakima County, WashingtOn;
be rezoned from R.3, Multiple Family Residence Zone, to B-1, Modified
Business Zone, be, and the same is hereby, approved and said real
property is hereby rezoned to B-1, Modified Business Zone.
Section 2. The above change in zoning shall be included and de-
-, picted on the next regularly amended Use District Map prepared by and
for the said City.
Section.3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance,
• Section 4. This ordinance shall become effective thirty days
after its passage, approval and publication, as provided by law and by
the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 22nd day of
April, 1963.
