4 1/ AN ORDINANCE authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute an Agreement
with the Washington State Highway Commission for the ac-
quisition of rights of way, and declaring an emergency.
WHEREAS, the City of Yakima and'the Washington State Highway
Commission mutually desire that a portion of Secondary State Highway
No. 11-A from the vicinity of South Sixth Street to the Yakima By-Pass
be improved; and in connection with the contemplated construction of
the Lenox Avenue Overpass, the City Council finds it is desirable
and necessary that revisions be made to the alignment of East Lenox
Avenue from South First Street to the vicinity of South Sixth Street,
and
WHEREAS, the Washington State Highway Commission has consented
to act on behalf of the City to obtain necessary rights of way to
• accomplish the above mentioned improvements and revisions; and the
City Council finds that it is in the best interests of the City to
execute an Agreement with the Washington State Highway Commission
to accomplish these purposes, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the City Manager and City Clerk are hereby
authorized and directed to execute an Agreement with the Washington
State Highway Commission, a copy of which Agreement is attached hereto
and by reference made a part hereof.
Section 2. That the City Council of the City of Yakima does
hereby request and authorize the Washington State Highway Commission
to obtain by purchase all rights of way from Station 10+25.09 to
Station 19+71.13 as required for said improvement of the new alignment
and to construct the roadway with curb, gutter and sidewalk from
Station 10+03 to Station 20+00.00 (BK.) - Station 8+10.96 (Ai,.-) and

to construct the concrete sidewalk from Station 20+00.00 (BK.) = •
111 8+10.96 (AH.) to Station 20+75 as shown by Roadway Sections A and B
on Exhibit A, Sheet 1 of 1 Sheet, all as provided by the aforesaid
Agreement.
Section 3. This Ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel-
fare of the people of the City of Yakima and an emergency is hereby
declared to exist and this Ordinance shall be in full force and effect
immediately upon its passage, approval and publication as provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 28th day
of October, 1963.
