AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguOL! to the City of Yakima, and zoning the same as R -1, Single Family Residence Zone. WHEREAS, proceedings have been had in accordance w Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Commis- _ sion of the City of Yakima, a hearing was had pursuant to legal notice upon the zoning and land use classification of said property herein- after described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and that all of said pro- perty be zoned at the time of such annexation as R -I, Single Family Residence Zone, and WHEREAS, said proposed area to be annexed to the City of Yakima is less than ten acres in area and less than $200,000,00 in assessed III valuation, and WHEREAS, In accordance with the provisions of Chapter 282, Laws of 1961, the Mayor of the City of Yal;lma, the Chairman of the Board of County Commissioners of Yakima County, and the County Superinten- dent of Schools of Yakima County have all been apprised of the petition and have agreed that a review proceeding as provided in said Chapter 282 . is not necessary for the protection of the interests of the various parties, and that such review procedures should be dispensed with, and WHEREAS, pursuant to due and legal notice as provided by law and City Charter, a public hearing was had upon said petition for annexa- tion before the City Council of the City of Yakima on the 23rd day of December, 1963, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the recommenda- tion of the Planning Commission for the zoning and land use classifi- cation of said property should be approved for the reasons that such a► zoning and classification are in accordance with good planning and with the Comprehensive Plan of the City of Yakima, that the majority of the property owners in the vicinity are in favor of the zoning classification and the annexation, that the needs of the City and • community do require the hereinafter set forth zoning classification, and that the highest and best, use for said property is as hereinafter determined, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section I That the following described property contiguous to the City of Yakima, Washington, to -wit: Beginning at the intersection of the center line of Engle- wood Avenue and the center line of North 58th Avenue north from Englewood Avenue; thence North along the center line of North 58th Avenue 287.5 feet to the true point of beginning; thence North 89° 17' 10" West 150.7 feet to the West line of Tract 49 State Addition to City of North Yakima No. 2; thence North along the West 1Ine of said Tract 49 to the center line of the Tieton Irrigation District right -of -way; thence North- easterly along the center line of said Irrigation District right - of -way to the center line of North 58th Avenue; thence South. • along the center line of North 58th Avenue to the true point of beginning; is hereby annexed to the City of Yakima, Washington. Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtednesses of the City of Yakima. Section 3. That in accordance with the recommendations of the Planning Commission of the City of Yakima, said rrop orty is horeby zoned as R -I, Single Family Residence Zone. Section 4. That the next regularly amended Use District Map pre- pared by and for the City of Yakima shall show said property as here - inbefore zoned and classified. • Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and the Board of County Commissioners of Yakima County. Section 6. This ordinance shall be in full force and effect 30 days after its final passage, approval and publication, as provide( -2- by law and by the City Charter.
