HomeMy WebLinkAbout1964-494 ORDiNANCE O AN ORDINANCE providing for the improvement of certain property by con- structing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, pro- viding for the method of payment thereof, and creating a special fund. BE IT ORDAMED BY THE CiTY OF YAKIMA: Section k. That the property described hereinbelow shall be improved by constructing a pipe sewer with the necessary wye branches and manholes. The property to be improved and specially benefited thereby consists of all of the property lying within the following described boundary line: Beginning at the intersection of the centerline of South 10th Street and the extended South property line of Terrace Heights Way; thence West along said South property 1 ine 410 224.8 feet; thence South to the centerline of Pitcher Street; thence East along said centerline to a point 110 feet West of West property tine of South 10th Street; thence South 90.5 feet; thence East 75.5 feet; thence Southeast to a point on the West property line of South 10th Street which is 107.55 feet South of the South line of Pitcher Street; thence South along the West property line of South /0th Street to a point 150 feet South of East Chestnut Street; thence West 101 feet; thence South , 680.9 feet to the South line of Riverside Street; thence East to a point 290 feet West of Fair Avenue; thence South 122 feet; thence East 160 feet; thence South 57.3 feet; thence East to the centerline of Fair Avenue; thence North along said centerline to the centerline of East Spruce Street; thence East 132 feet; thence North 330 feet; thence East 250.4 feet; thence North 375 feet pore or less to the South Right of Way Line of the Terrace Heights • Interchange; thence Northwesterly and Westerly along said Right of Way line to the centerline of South 10th Street; thence North to the extended South property line of Terrace Heights Way, which is the point of beginning, all within the City of Yakima, Washington. Section 2. There is hereby created a Local Improvement District to be called 'Local improvement District No. L .ttt , which said district shall include ail of the property adjacent to the above mentioned im- II I provements which are subject to assessments, said property being de— scribed above. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the construc- tion of said improvement, including engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against ail of the property legally and properly assessable therefor as provided by law and as above described. Section 5. Ali of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and III detailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 6. Ail of the work necessary to be done in connection with the making of said improvements shall be done and made by contract upon competitive bids, and the City shall have the power to reject any and all bids. Section 7. There is hereby created a special fund, to be called '' " al Loc Improvement Fund, Distr shall be No. , 12_," into which sha be placed all Interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. III Section 6. Bonds bearing interest at the rate of 47 per annum, payable on or before i2 years from the date of issuance, shall be issued in payment of the costs and expenses of said improvements, which bonds shall be redeemed by the collection of special assessments to belevied and assessed upon the property within said district, payable in ten equal annual installments wi-th interest at the rate of 470 per annum, interest payable annually, under the mode of payment "payment by bonds," as defined by the statutes of the State of Washington and the ordinances of the City of Yakima; provided, that this improvement may be financed by the issuance of promissory notes under the authority of R.C.W. 35.45.150. Section 9. This ordinance is one relating to local improvements or assessments therefor and shall become effective immediately upon its Aft passage, approval and publication as provided by law and the City Charter PASSED BY THE CITY COUNCIL, signed and approved this 20th day of January, 1964® or:e_ Mayor ATTEST: // • // City Clerk
