BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. There is hereby created a new chapter to the City of Yakima Municipal Code to be known as Chapter 5.09, AMBULANCES, which , chapter shall read as follows: "Chapter 5.09 . • AMBULANCES III • 5 AMBULANCE SERVICE BUSINESS LICENSE REQUIRED. It shall be for any person, firm or corporation to engage in the business of conducting an ambulance service to carry or transport any sick or injured persons from the scene of any accident, dis- aster, home, building, or other place within the City of Yakima - without first obtaining and being the holder of a valid Ambulance Service Business LiOthse pursuant to this chapter. . ,.. . 5.09,020 APPLIC4:n6N FOR LICENSE—FEE. Any person, firm or :: e corporation d - eS'ito obtain an Ambulance Service Business License ShaIliie with the Clerk of the City of Yakima an appli- _ cation on:4EMS to be furnished by him containing the following information: - • , . . . enn. n : I. Name of applicant. 2. Address of applicant. . 3. Business address or location from which business will be operated. • 4. A list of all vehicles to be used in connection with the business, with make and model of each. . . • 5. A list of all personnel to be engaged as employees in the business, with a designation of the position of each - employee. 6. Whether any owner of business (or any officer if applicant ll" ,„ is a corporation) has ever been charged with or convicted _ of any felony misdemeanor, including violations of City ordinances and moving traffic offenses; and, if so, details as to when, where and for what offense. . , . :-n . . , . . . • . . „--- 7. Whether applicant has engaged in ambulance service business prior to making the application) and, if so, when and where. -- , .Le P a An application hereunder shall be accompanied by an application fee of $ 75 , which fee shall be retained by the City regardless of whether ' ,, the license applied for ie issu i ed. Such license shall be valid for a period of one year from its date of issue unless revoked as Provided in this chapter, and may be renewed from year to .year thereafter by an appli- cation to the City Clerk accompanied by a renewal fee of $_35.00 for each annual renewal. 5.09.030 INVESTIGATION OF APPLICANT-STANDARDS FOR ISSUING LICENSE. When an application for an Ambulance Service Business License is received, the City Clerk, with the assistance of the Chief of Police, shall investi- gate the applicant, business premises and vehicles and equipment to be utilized in the business and make a report of his investigation to the City Manager. Upon a determination by the City Manager that the applicant and all attendants and drivers are fit and proper persons to conductor work in the proposed bueiness, that the business premises are suitable to furnish adequate service to the public and meet the requirements of all applicable laws and regulations, that the vehicles and-equipment are suitable to fureish adequate service to the public and meet the require- ments of all applicable laws and regylations, and that applicant has filed with the City Clerk the proof of insurance required by this chap- ter, the City Clerk shall issue an Service Business License to applicant. Nothing in this Chapter shall be construed so as to require 0 any applicant for a' license hereunder to be the owner of any equipment or premises intended..to.be used in such business, or to have hired any personnel , prior to the time such license is granted. 5.00,040 INSURANCE. Before engaging in business in the City of Yakima, the operator of any ambulance service business shall file with the City Clerk a copy of an insurance poi c' issued by a responsible insurance company authorized to do business in the State of Washington, which policy shall be subject to approval as to form be the City Attorney, providing -indemnity for or protection of the City with the City of Yakima as a named insured in the peliey, and providing indemnity for or protection of persons and property io the care, custody and control of licensee against loss as follows: A legal liability policy covering the operation of the licensee's business, equipment or vehicles for any bodily injury • • or property damage with minimum coverage of $100,000.00 for any one person killed or injured in any one accident or occurrence and $300,000.00' . for more than one person injured or killed in any one accident or occur- rence. Such policy shall also provide $10,000.00 minimum coverage for all damage arising out of injury to or destruction of property. The policy must contain an endorsement providing for 10 days written notice to the City in the event of material change in or cancellation of the policye. III 5.09.050 REVOCATION OF AMBULANCE SERViCE BUSINESS LICENSE—APPEAL e FROM REVOCATION. The City Manager shall have the authority to revoke )any Ambulance Service Business License issued by the City if, after a 7 hearing by the City Manager, any of the following grounds are found to exist: • -2- . , . . . • . . . ..,-. 1. If said license was procured by fraud, or if the applica® t - o 2 k ; tion therefor contains any false statement of a material . il- fact, or if a fact concerning the applicant or his business was not disclosed at the time of his making the application when such fact would have constituted just cause for refusing to issue said license. . . 2. If the licensee fails to keep in full force and effect the insurance coverage required by this chapter. 3. If the licensee fails to maintain the standards required • by Section 5.09.030 of this chapter for issuing a license. 4. If the licensee violates any provision of this chapter. • An order of revocation shall be made in writing by the City Manager . and a.copy thereof served on or mailed to licensee. Such order shall include a statement of reasons for the revocation and shall terminate all authority theretofore granted by the license to the licensee, unless the licensee shall appeal to the City Council in accordance with the provisions of this section. . . The decision and order of the City Manager revoking an Ambulance • Service Business License shall be final unless the licensee appeals the order to the City Council. Such appeal shall be made by the • filing of a written notice of appeal with the City Clerk within five (5) days from the date of serving or mailing the order of revocation referred to in this section. Upon such an appeal being filed, the City Council shall conduct a hearing, to be held at a regular meeting of the City Council. The City Clerk shall serve or mail to licensee a written notice of such hearing at least five III (5) days prior to the hearing. At the conclusion of such hearing, the City Council shall either affirm or overrule the decision and • • order of the City Manager by the passage of a resolution by a' simple majority of a quorum of the City Council. The decision of the City Council shall be final. • . 5.09.060 AMBULANCE DRIVER AND ATTENDANT PERMIT REQUIRED. It shall be unlawful for any person to drive, operate or use any • vehicle as an ambulance or serve as an attendant therein unless such person is the holder of a valid. Ambulance Driver and Attendant Permit issued pursuant to this chapter, or the holder of a temporary . permit, which the City Clerk is hereby authorized to issued, pro- / vid9dthat such a temporary permit shall be valid for a period not V to exceed 30 days from its date of issue and shall be issued only while an application is pending for an Ambulance Driver and Atten dant Permit. . . • 5.09.070 APPLICATION FOR PERMIT--FEE. Any person desiring to obtain an Ambulance Driver and Attendant Permit shall file with the City Clerk an application on forms to be furnished by him containing the following information: 1. Name of applicant. 2. Address of applicant. 3. Date and place of birth. • 4. Applicant's places of residence for three years immediately previous to the time of making application. • 5. Marital status. • . . -3- . 6. Physical description of applicant, including height, weight, color of eyes and hair, and distinguishing or identifying marks, scars or tatoos. 7 41/0*Ireee ' . _ been convicted of or charged with ' k n Whether apPlicant has ev x vi any crime, including misdemeanors and violations of City 'ordinances and including moving traffic offenses 8. Whether applicant's driver's license has ever been suspended or revoked, and; it so, when, where and for what cause. 9. Whether applicant holds a valid Washington State Motor Vehicle Operators Permit. 10. Whether applicant does now suffer or has ever suffered from epilepsy, vertigo, heart trouble, color blindness, or tuberculosis; and, if so, when the condition existed and the name and address of the treating doctor. 11. Whether the applicant is addicted to the use of narcotics or intoxicating liquor. 12. A list of all illnesses suffered by applicant within a year • preceding the date of application, together with the name and address of treating doctor. • . 13. Any physical defects of applicant. 14. Whether applicant has successfully completed an advanced • first aid course as prescribed by the American Red Cross. 15. Whether applicant has ever been engaged as an ambulance driver or attendant, and; if so, when, where, and name and address of prior employer. An appie hereunder shall be accompanied by an application fee of $ '. which fee shall be retained by the City regardless of weeter tee permit applied for is issued. Such a permit shall be 010 valid for a period of one year from its date of issue unless revoked as provided in this chapter, and may be renewed from year to year thereafter by an application to the City Clerk accompanied by a renewal fee of $5.00 for each annual renewal. 5.09.080 INVESTIGATION OF APPLICANT-- OF APPLICANT FOR ISSUANCE OF PERMIT. When an application for an Ambulance Driver and Attendant Permit is received, the City Clerk, with the assistance of the Chief of Police, shall investigate the applicant, and a permit shall not be issued unless the applicant meets the following qualifica- tions: 1. Applicant must be of the age of 18 years or over. 2. Applicant must be the holder of a valid Washington State Motor Vehicle Operator's License and have knowledge of driving safety regulations and, shall demonstrate to the satisfaction of the Chief of Police that applicant has the ability to safely operate an ambulance. 3. Applicant must be able to speak, read and write the English language. 4. Applicant must be of sound physique, with good eyesight, and not subject to epilepsy, vertigo, heart trouble, color blindness, or any other infirmity of body or mind which might render him unfit for the safe operation of an ambu- lance. 5. Applicant must be clean of dress and person and not addicted ID to the use of intoxicating liquor or narcotics. . , • -4- • • • , . . • . , , . . . . , . . . . . - 6. Applicant must have successfully completed an advanced first aid course as prescribed by the American Red Cross. '1 7. Applicant shall not have been convicted of any offense in- eakelete...:‘ • t" •s, volving moral turpitude, nor within a period, of one year prior to his application have been convicted of the 't offenses of negligent driving, reckless driving, or .,f47efieeeel . driving while under the influence of intoxicating liquor vIpL.J . .or.drugs. • . 8. Applicant must demonstrate to the satisfaction of the Chief of Police that applicant has sufficient knowledge of street names and residences in the city to enable him to promptly locate addresses within the city. 5.09.090 FINGERPRINTS AND PHOTOGRAPHS REQUIRED. Every applicant for an Ambulance Driver and Attendant. Permit must submit to finger- . printing by the Police Department and must further submit to having • his photograph taken by the Police Department. . One set of finger- prints and one such photograph of applicant shall be filed with the application. . . . 509.100 IDENTIFICATION CARD AS PERMIT—EXHIBITING. IDENTIFICATION - CARD. The permit issued hereunder shall consist of an identification card encased in a sealed ,. transparent holder and shall include the ' - signature of the permit holder, together with his photograph, name, . . address age, . ,. age and physical description. . . , • .. . • . A permit holder must have his permit in his possession at all times . . while he is on duty as an ambulance driver or attendant and must exhibit:the permit at any reasonable time at the request of the City III Clerk, Chief of Police, or any Police Officer of the City of Yakima, or any other official or employee of the City charged with enforcing the provisions of this code, and also at the request of any person • . doing business with the ambulance service by which a permit holder . is engaged as a driver or attendant. 5.09.110ePERMITS—UNLAWFUL ACTS. It shall be unlawful for any person to intentionally alter or deface any Ambulance Driver and • Attendant Permit issued pursuant to this chapter, or for a permit holder to allow his permit to be used by any other person, or for any person to use such a permit when it has not been issued to ,him pursuant to this chapter. . . 5.09.120. REVOCATION OF AMBULANCE DRIVER AND ATTENDANT PERMIT. The City Manager shall have the authority to summarily revoke any Ambulance Driver and Attendant Permit issued by the City on any of the following grounds: l. If the permit holder is convicted of, or forfeits bail for • . any of the following, driving violations, whether or not in connection with driving an ambulance: • a. Negligent Driving. . . . b. •Reckless Driving. c. Driving under the influence of intoxicating liquor 4111 or drugs. 2. ,If the permit holder is convicted of any felony or any ' • • offense involving moral turpitude. . r -)- .. „ . 3. If the permit was obtained by fraud or if the application therefor contains any false statement, or if a fact con- ,. , cerningthe applicant was not disclosed at the time of ' his making the application when such fact would have con- stituted just cause for refusing to issue said permit. 4. If the permit holder fails to maintain the qualifications prescribed by Section 5.09.080 of this chapter for the ' issuance of a permit. 5. If the permit holder violates any provision of thischapter. 5,09.130 RULES AND REGULATIONS. There are hereby established the followifig rules and regulations pertaining to ambulance service within the City of Yakima: 1. EQUIPMENT. All vehicles used for emergency ambulance service E6T5I in good mechanical condition and available 24 hours per day, seven days per week. Each ambulance vehicle must be • . equipped with the following minimum emergency equipment: • (a) Emergency work lights, red lights and siren, as, approved by the Washington State Highway Safety- • Commission. (b) Two-way shortwave radio. • (c) Fire extinguisher and flashlight. (d) First aid equipment as follows: (1) An approved standard 24-unit first aid kit, as prescribed by the American Red Cross. (2) One cot-type wheeled stretcher with mattress. (3) One emergency folding stretcher. (4) Oxygen inhalation equipment, including resusci- tator with aspirator. (5.) Sufficient clean linen and blankets for two patients. Vehicles may be used to provide transportation for ambu- . lances to transport patients to and from nursing homes, and for other similar non-emergency uses, without complying with the requirements for equipment for emergency ambulance ser- vice set out above. Provided that such non-emergency.vehicles shall be equipped with a cot-type wheeled stretcher with • mattress, clean linen and blankets'. Such ,non-emergency vehicles shall not be used for emergency ambulance service except at a time when all emergency vehicles are in service and an additional emergency occurs which requires the use of such a non-emergency vehicle in order to .give immediate ser- vice. 2. PERSONNEL. All ambulances must be manned by a crew of at least two persons, to consist Of a driver and an 'attendant. During times when a patient is being transported, at least one attendant must ride in the back of the ambulance with • the patient. • 3. OPERATION OF AMBULANCES. Ambulances must be operated in a sane aria Excessive speeding, reckless 4110 driving or indiscriminate use of sirens is prohibited. Handling of the ambulance must, at all times, be governed by the rules of safe driving consistent with prompt and efficient service. • -6- . . 4. OPF4tATION OF BUSINESS ANDTROE6SING CALLS. The ambulance service business prt.,.- ' aises, vehicles and equipment shall be open to inspection by the City t City Clerk, Chief of Police, Chief of Fire Department, or other authorized City official or employee, - .-it all reazionable times. 5. RATE‘.3. Each ambulance servic;e business shall file with the ---- C9Ty Clork a schedule of rates charged by the businegs In the event of any change in rates, the roved schedule shall be filed with the City Clerk at least 24 hours prior to the effective time of suchchange. 6. CHANGE TN PERSONNEL OR EIPMENT. Any person, firm or Corporation III violating any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine in any d,urn not exceeding $300.00, or by imprisonment in the City • Jail for a period riot exceeding 90 days, or by both such fine and imprisonment.'• Section 2. This ordinance shall be in full force and effect 30 days ,fter its final passage, approval and publication as required by law and 1 the City Charter.
