AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 1102 South 28th
A%)enue and 2804 Nob Hill Boulevard, in the City of
Yakima, Washington, from R-2, Two Family Residence Zone,
.to B-2, Local Business Zone.
'110 WHEREAS, after proper petition and due notice, a hearing was
held before the City Planning Commission on November 5, 1963, upon
the petition of J. J. Anderson and others, to rezone property located
at 1102 South 28th Avenue and 2804 Nob Hill Boulevard in the City of
Yakima, Washington, from R-2, Two Family Residence Zone, to B-2,
Local Business Zone, and
WHEREAS, as a result of such hearing the Planning Commission
denied said petition and within the time specified by law, the
, petitioner appealed to the City Council from the Planning Commission's
denial of said petition, and
WHEREAS, a hearing was held by the City Council on said appeal
on December 16, 1963, and as a result thereof, the Planning Commission
held a further hearing on January 7, 1964 at the request of the City
Council for the purpose of reconsidering said petition, and the
Planning Commission now recommends that the request of said petition
be granted, and
WHEREAS, pursuant to due and legal notice the City Council of
the City of Yakima held a hearing on the 3rd day of February, 1964
upon the recommendation of the Planning Commission that said petition
be granted, and finds, as a result of said hearing, that the recommen-
dation of the Planning Commission to grant said petition should be
approved for the reasons that such rezoning is in accord with good
planning and with the Comprehensive Plan of the City of Yakima; that
410 the majority of property owners in the vicinity do notcppose the
change in classification; that the needs of the City and community
do require such change; and that the highest and best use of said
property is for Local Business purposes, npw, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section I. That the recommendation of the Planning Commission
of the City of Yakima that the following described real property
located at 1102 South 28th Avenue and 2804 Nob Hill Boulevard in the
City of Yakima, Washington, and more particularly descr i bed as fo l l ows,
;I to-wit:
Parcel I :
Lot 1, Hamilton Acres Replat, according to the Plat -
thereof recorded in Volume T of Plats, Page 6, and
re- recorded in Volume T of Plats, Page 2, records of
Yakima County, Washington.
Parcel 2:
The North 197.1 feet of the East 139 feet of the East
half of the East half of the Northwest Quarter of the
Southwest Quarter of Section 26, Township 13 North,
Range 18, E.W.M., Except right of way for Nob Hill
Boulevard along the North line thereof;
be rezoned from R -2, Two Family Residence Zone, to B -2, Local Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned to B -2, Local Business Zone.
Section 2. The above change in zoning shall be included and de-
picted on the next regularly amended Use District Map prepared by and
for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall become effective thirty days
after its passage, approval and publication, as provided by law and
by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 3rd day of
February, 1964.
