AN ORDINANCE relating to the enforcement of moving traffic regulations of the City of Yakima, authorizing the issuance of cita- tions for violations thereof, and prescribing the form of such citatidns; declaring a misdemeanor for failure to comply with such citations; amending Section 9.16.010, .020 and .030, of the City of Yakima Municipal Code; repealing Section 9.16.040, .050, .060, .070 and .080 • of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That Section 9.16.010 of the City of Yakima Municipal Code is hereby amended to read as follows: °`9.16.010 CITATION TO OFFENDERS—PROMISE TO REPORT TO TRAFFIC VIOLATIONS BUREAU. Whenever any person is arrested for a moving traffic offense commited in violation of the City of Yakima Municipal Code, the arresting officer shalt fill out a complaint and citation form which shall be substan- tially in the form known as the "Uniform Traffic Ticket and Complaint" specified by the Washington State Traffic Rules for Courts of Limited Jurisdiction, and serve a copy thereof on the person arrested. Such complaint and citation shall contain a provision for the person arrested to give his written promise to report to the • Traffic Violations Bureau of the City of Yakima within five days from the date the citation is issued. The person arrested, in order to secure his release, and when permitted by the arresting officer, must give his written promise to report as contained on the complaint and citation form." Section 2. Section 9.16.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "9.1 6.020 NONAPPEARANCE AFTER WRITTEN PROMISE— MISDEMEANOR. Any person wilfully violating his written promise to report, as provided by Section 9.16.010 hereof, shall be guilty of a misdemeanor regardless of the disposition of the charge upon which he was originally arrested: Provided, That such a written promise to report may be complied with by an appearance by counsel for the per- son arrested." Section 3. That Section 9.16.030 of the City of Yakima Municipal • Code is hereby amended to read as follows: "9.16.030 COMPLIANCE WITH TRAFFIC RULES FOR COURTS OF LIMITED JURISDICTION. The provisions of the Washington State Traffic Rules for Courts of Limited Jurisdiction shall govern the issuance of traffic citations for moving traffic offenses committed in violation of the City of Yakima Municipal Code, and nothing herein cost ai: -ned shall be construed so as to alter or restrict such Traffic Rules or their application within the City of Yakima." Section 4. Sections 9.16.040, .050, .060, .070 and .080 are hereby repealed. Section 5. This Ordinance is one to provide for the immediate 411 preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this Ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
