BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT f 0 Item No. For Meeting of August 17, 2010 ITEM TITLE: Consideration of a right -of -way use permit application submitted by Joe Park Construction on behalf of the Eerkes, property owner at 212 N. 5 Ave. (former 5 Ave. Shell Station) to install a monitoring well within the City's right -of -way in the west alley of North 5 Avenue between Walnut and Spruce Streets. SUBMITTED BY: Michael Morales, Director of Community and Economic Development Department CONTACT PERSON/TELEPHONE: Michael Morales, Director of Community and Economic Development / 509 - 575 -3533 SUMMARY EXPLANATION: Joe Park Construction, on behalf of Mr. Craig Eerkes, has applied to install a monitoring well within the City of Yakima right -of -way in the west alley of North 5 Avenue between Walnut and Spruce Streets. Contamination cleanup actions by the owner of the property warrant the placement of the monitoring well. The monitoring well will help characterize the extent of contamination at 212 N. 5 Avenue, and determine if upstream contamination is entering the property. The alley to the west of the property is the best area to determine if upstream contamination exists. The required proof of ownership and liability insurance outlined in Chapter 8.20 of the Yakima Municipal Code is on file in the Office of Code Administration and Planning.
