HomeMy WebLinkAbout1964-519 ORDINANCE NO. 5---/F - AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property located at 9, 11, 13 and 15 Fair Avenue in the City of Yakima, Washington, from R-3, Multiple-Family Zone to B-3, General Business Zone. WHEREAS, pursuant to due and legal notice, the City Council of 411 the City of Yakima held a hearing on the 27th day of April, 1964, upon the recommendation of the Planning Commission that real property located at 9, 11, 13 and 15 Fair Avenue, within the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple-Family Zone to B-3, General Business Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the Comprehensive Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classifi- cation; that the needs of the City and community do require such 411 change; and that the highest and best use of said property is for gen- eraL business purposes, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section I. That the recommendation of the Planning Commission of the City of Yakima that the following described real property located at 9, 11, 13 and 15 Fair Avenue in the City • of Yakima, Washing- ton, and more particularly described as follows, to-wit: Beginning at a point 157.25 feet South of the Northwest corner of the Southwest quarter of the Northwest quarter of the Northwest quarter of Section 20, Township 13 North, Range 19, E.W.M., in Yakima County, Washington. Thence East 30 feet to the Easterly right of way line of Fair Avenue which is the true point of beginning. From said point of beginning South 238.8 feet, thence East 231.7 feet, thence North 28 feet thence East, 65.2 feet, thence North 50 feet, thence West 65.2 feet, thence North to the Southerly right of way line of Primary State Highway Number 3, also known as U.S. 97 Bypass, thence Northwesterly along the right of way line of said State Highway to a point East of the true point of beginning thence West to the true point of beginning. be rezoned from R-3, Multiple-Family Zone to B-3, General Business Zone, be, and the same is hereby, approved and said real property is hereby rezoned, to B-3, General Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this Ordinance. Section 4. This Ordinance shall be in full force and effect thir- ty days after its passage, approval and publication as provided by • law and by the City Charter.
