HomeMy WebLinkAbout1964-525 ORDINANCE NO. AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property. WHEREAS, proceedings have been held in accordance with Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Commis- sion of the City of Yakima, a hearing was held pursuant to legal notice, upon the zoning and land use classification of said property hereinafter described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and made recommendations as to the zoning for said property, and WHEREAS, said proposed area to be annexed to the City of Yakima is more than 10 acres in area, and WHEREAS, the City Council has heretofore determined that it would approve the proposed annexation and that it would require the property • owners of such area to assume the existing ,indebtedness of the City of Yakima, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, a review board comprised of the Mayor of the City of Yakima, the Chairman of the Board of Yakima County Commissioners, the Director of the State Department of Commerce and Economic Development or an alternate designated by him, the Chairman or Chairmen of the Board of School Directors of any or all School Districts situated in all or in part of the area to be annexed, and a Resident and Property Owner of the area proposed to be annexed, met and considered all of the factors set forth in Chapter 282, Laws of 1961, and at the conclusion 411 of said meeting made and entered their unanimous findings and deter- minations with respect to such annexation and recommended to the City Council of the City of Yakima that said proposed area be annexed to the City of Yakima; and WHEREAS, pursuant to due and legal notice as provided by law and by the City Charter, a public hearing was held upon said petition for annexation before the City Council of the City of Yakima on the 25th day of May, 1964; and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as hereinafter set forth for the reasons that such zoning and classification is in accord with good planning and with the • comprehensive plan of the City of Yakima, that the majority of the property owners in the vicinity do not oppose the classification or the annexation, that the needs of the City and Community do require the hereinafter set forth zoning classifications, and that the highest and best use for said property is as hereinafter determined, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described property contiguous to the City of Yakima, Washington, to-wit: Beginning at the intersection of the centerline of South 46th Avenue and centerline of West Chestnut Street; thence North 20 feet to the North line of Orchard Avenue, also known as W. Chestnut Street; thence West along the North line of Orchard Avenue and the North line extended of 111 Orchard Avenue to the West line of Glenside Avenue; •thence South along the West line of Glenside Avenue to a point lying 425 feet North of the centerl ine of Tieton Drive; then West to a point on the East line of West Hill Court, said point lying 235.4 feet South of the Northeast corner of West Hill Court; thence South along the East line of West Hill Court and the East line extended of West Hill Court to the South line of Tieton Drive; thence East along the South line of Tieton Drive to the West line of the Northeast quar- ter of the Northwest quarter of Section 27, Township 13 North, Range 18, E.W.M.; thence North along West line of said subdivision. 30 feet to the centerline of Tieton Drive; thence East along the Centerline of Tieton Drive to a point 561 feet West of the Southeast corner of the Southwest quarter of Section 22, Township 13 North, Range 18, E.W.M.; thence North 660.4 feet to the centerline of West Walnut Avenue; thence West along the centerl ine of West Walnut Avenue to the centerline of South 46th Avenue; thence North along the centerline of South 46th Avenue to the centerline of West Chestnut Street; which is the point of beginning, is hereby annexed to the City of Yakima, Washington. 411 Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtedness of the City of Yakima. Section 3. That the hereinbefore described real property annexed to the City of Yakima is hereby zoned as follows: (a) The following described property is hereby zoned as B-I, Modified Business Zone: -2- _ Lots 1 and 2, Block 1, Highland Hills Addition, according to plat thereof recorded in Volume "Q" of Plats, Page 19, records of Yakima County, Washington. (b) That the following described property is hereby zoned 6-2, Local Business Zone: Beginning at the intersection of the North line of 411 Tieton Drive and the West line of Glenside Avenue; thence North, along the West line of Glenside.Avenue, 395 feet; thence West, to a point on the East line of West Hill Court, said point lying 235.4 feet South of the Northeast corner of West Hill Court; thence South, along the East line of West Hill Court, 262.76 feet; thence Ea parallel to the South line of Section 21, Township 13 North, Range 18, E.W.M., 75 feet; thence South, parallel to the East line of said Section 21, to the North line of Tieton Drive; thence East, along the North line of Tieton Drive to the point of beginning. (c) That the following described property is hereby zoned R-2, Two-Family Zone: Lot 12, of Sweitz Second Addition, according to the plat thereof recorded in Volume T of Plats, Page 42, records of Yakima County, Washington. (d) That all of the real property described hereinabove in Section I annexed to the City of Yakima, except those parcels described hereinabove in this Section, zoned as B-I, Modified Business Zone, B-2, Local Business Zone, and R-2, Two-Family Zone, is hereby zoned as R-I, One-Family Zone. Section 4. That the next regularly amended Use District Map prepared by and for the City of Yakima shall show said property as hereinbefore zoned and classified. Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Washington. Section 6. This ordinance shall be in full force and effect 0 30 days after its final passage, approval and publication as provided by law and by the City Charter.
