AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located at 1208 Fruitvale
Boulevard in the City of Yakima, Washington, from R-3,
Multiple-Family Zone, to B-2, Local Business Zone.
411 WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 28th day of September, 1964,
upon the recommendation of the Planning Commission that real property
located at 1208 Fruitvale Boulevard, within the City of Yakima, Wash-
; ington, the legal description of which is set out hereinbelow, be
rezoned from R Multiple Zone, to B-2, Local Business Zone,
and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the rea-
sons that such rezoning is in accord with good planning and with the
Comprehensive Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification;
111 that the needs of the City and community do require such change and
that the highest and best use of said property is for local business

purposes, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Sectonl. That the recommendation of the Planning Commission of
the City of Yakima that the following described real property located
at 1208 Fruitvale Boulevard in the City of Yakima, Washington, and more
particularly described as follows, to
The east 90 feet of Tract 30, north of the Old Union Ditch,
except the north 10 feet; also the west 55 feet of the east
145 feet of the south 135 feet of the north 145 feet of
Tract 30, all in J. H. Hathaways Five Acre Tracts, according
to the Plat thereof recorded in Volume "A" of Plats, page 30;
410 be approved and that said property be rezoned from R-3, Multiple-Family
Zone, to B-2, Local Business Zone, be, and the same is hereby, approved
and said real property is hereby rezoned, to B-2, Local Business Zone.
Section 2. The above change in zoning shall be included and de-
picted on the next regularly amended Use District Map prepared by and
for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this Ordinance.
Section 4. This Ordinance shall be in full force and effect thir-
ty days after its passage, approval and publication as provided by law
and by the City Charter.
