AN ORDINANCE providing for the improvement of certain property by
constructing the necessary mains, fire hydrants, valves
and other appurtenances for the purpose of supplying
water for domestic use and fire protection; establishing
• a Local Improvement District, providing for the method
of payment thereof, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That certain property in the City of Yakima, Wash-
,
ington, shall be improved by the construction of necessary mains, fire
hydrants, valves and other appurtenances for the purpose of supplying
water for domestic use and fire protection, said improvements to
serve the property within the City of Yakimadescribed as follows:
41, Lots 1 through 10 inclusive, and Lot 12, L. K. Buchanan Addition.
Lots 4 through 14 inclusive, Bel Air Heights Addition.
. (Chisholm Trail from Walnut Street to Bell Avenue. Bell
Avenue from Chisholm Trail to South 44th Avenue. South
44th Avenue from Tieton Drive to Walnut Street. Tieton
Drive from South 44th Avenue approximately 550 feet east.)
All of Tract 11 and the West 100 feet of Tract 10 in Phoebe
D. Adams Subdivision, Section 31, Township 13 North, Range
19, E.W.M. (Pierce Street from Broadway to South First
• Avenue).
Beginning at a point 1019.3 feet East of the Southwest
corner of the Southwest quarter of Section 14, Township
• 13 North, Range 18, E.W.M., and on the South line of said
section;. thence North 54° West a distance of 33.85 feet
to the true point of beginning; thence North 54° West a
distance of 58.5 feet; thence North 40° 49' East a distance
of 287.15 feet; thence South 40° 30' East a distance of
320.4 feet to the North right of way line of Englewood
Avenue; thence West along the North line of Englewood Avenue
and parallel with the South line of said section to the true
point of beginning. (Englewood Avenue from Powerhouse Road
110 approximately 350 feet east).
Beginning at a point 173.36 feet North of the Southeast
corner of the Southwest quarter of the Northwest quarter;
Section 35, Township 13 North, Range 18 E.W.M ®, and on
the East line of said Southwest quarter,. Northwest quarter;
41O thence North along said East line a distance of 310.79 feet;
thence West and parallel with the North line of said South-
west quarter, Northwest quarter, to the West line of the
East half of said Southwest quarter, Northwest quarter; thence
• South along said West line to a point 416.07 feet North of
the Southwest corner of the East half of said Southwest
quarter, Northwest quarter; thence South 70 03° East a
distance of 718.25 feet to the point of beginning; except the
East 30 feet to City for Street right of way. (South 28th
Avenue from Washington Avenue approximately 500 feet north.)
The North 984 feet of the West 819.16 feet of the Southwest
quarter, Northwest quarter, Section 32, Township 13 North,
Range I9 E.W.M., except South 10 feet of East 221.34 feet,
and except right of way for South First Street. Also that
part of the Southeast quarter, Northeast quarter, Section
31, Township 13 North, Range 19 E.W.M., lying Easterly of
South First Street. (South First Street approximately 450
feet South and 550 feet North at Russell Lane.)
The Southeast quarter of the Northwest quarter of the North-
east quarter, Section 23, Township 13 North, Range 18 E.W.M.,
except the West 150 feet of the South 140 feet and except
410 the East 156 feet of the South 396 feet and except the East
185.4 feet of the North 264.7 feet® (North 2Ist Avenue ex-
tended from Lincoln Avenue to McKinley Avenue).
The West 150.7 feet of Tract 49, State Addition to the City
of North Yakima No. 2 (now Yakima) except the South 262.5
feet. (North 58th Avenue from Englewood Hill Place to Tieton
Canal).
The South 110 feet of the North 135 feet of the East two acres
of the West four acres of the Southwest quarter of the South-
west quarter of the Southeast quarter of Section 22, Township
13 North, Range 18 E.W.M. (Walnut Street between South 39th
Avenue and South 40th Avenue).
Section 2. There is hereby created and established a Local Im-
provement District to be called "Local Improvement District No. "
which said district shall include all of the property described and
set forth above.

Section 3. The assessments shall be made according to special
benefits derived from the improvements without regard to the zone and
termini method.

Section 4. A portion of the costs and expenses of said improve-
. ment, including engineering, inspection,"advertising, publication of
notices, if any, and all other expenses incident thereto, shall be(
levied and assessed against all of the property legally and properly
assessable therefor, as provided by law and as above described, and
the balance of the said costs and expenses shall be borne by the City
Water Department in accordance with Resolution No C-I051.
Section 5. All of the aforesaid construction work shall be in
accordance with the Plans and specifications, profiles, maps and de-
tailed drawings which have been prepared by the City Engineer, filed
with the City Clerk,. and which are hereby approved and adopted. All
of the work necessary to be done in connection with the- making of said
Improvements shall be done and made by contract upon competitive bids,
4 1/ and the. City shall have the power to reject any and all bids.
Section 6-. There is hereby created a special fund to be called
"Local ImprovementTund, District into which shall be paid
all sums paid on account of the aforementioned special assessments, in-
cluding all interest and penalties thereon, and, in the event of the
sale of local improvement bonds by the City, all premiums and interest
on said bonds issued for said improvements.
Section 7. Bonds bearing interest at the rate of 4% per annum,
payable on or before 12 years from date of issuance, shall be issued in
payment of the costs and expenses of the said improvements, which bonds
shall be redeemed by the collection of, special assessments to be levied
III and assessed upon the property within said district, payable in-ten .
annual installments, with interest at the rate of 4% per annum, inter-
est payable annually under the mode of payment _"payment by bond's," as

defined by the statutes of the State of Washinoten and the ordinances
of the City of Yakima.; proVided that, this improvement may be financed
by the issuance of promIssory notes, under the authority of R.C.W.
35.45.150.
Section 8 This ordinanc is one fre!ating to local i
