AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R-2, Two-Family Zone. WHEREAS, proceedings have been held in accordance with Chapter 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Commis- sion of the City of Yakima, a hearing was held pursuant to legal notice upon the zoning and land use classification of said property hereinafter described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and recommended that said property be zoned R-2, Two-Family Zone. WHEREAS, said proposed area to be annexed to the City of Yakima is less than ten acres in area and less than $200,000.00 in assessed valuation, and 111 WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, the Mayor of the City of Yakima, the Chairman of the Board of County Commissioners of Yakima County, and the County Superintendent of Schools of Yakima County have al I been apprised of the petition and have agreed that a review proceeding as provided in said Chapter 282 is not necessary for the protection of the interests of the various parties, and that such review procedures should be dispensed with, and WHEREAS, pursuant to due and legal notice as provided by law and City Charter, a public hearing was had upon said petition for annexa- tion before the City Council of the City of Yakima on the 30th day of November, 1964, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the recommenda- tion of the Planning Commission for the zoning and land use classifica- tion of said property should be approved for the reasons that such zoning and classification are in accordance with good planning and with the Comprehensive Plan of the City of Yakima, that the majority • of the property owners in the vicinity are in favor of the zoning classification' and the annexation, that the needs of the City and community do require the hereinafter set forth zoning c l a s s i f i c a t i o n , and that the highest and best use for said property is as hereinafter determined, now, therefore, • BE IT ORDAINED BY THE CITY OF YAK I MA : Section 1. That the following described property contiguous to the City of Yakima, Washington, to -wit: Beginning at a point on the North line of West Pierce Street 25 feet West of the East line of Cornell Avenue; thence West, along the North line of West Pierce Street to a point 145 feet East of the East line of South 8th Avenue; thence North, parallel to the West line of Coonse State Addition according to plat thereof recorded in Volume "H" of plats, page 33, records of Yakima County, Washington, to the North line of Lot 10 of said Coonse State Addition; thence West, along the North line of Lot 10 of said Coonse State Addition, to the East line of South 8th Avenue; thence North, along the East line of South 8th Avenue, to a point 40 feet North of, when measured at .right angles to, the North line of Lot 17, Remsen Acres according to plat thereof recorded in Volume "H" of plats, page 28, records of Yakima County, Washington; thence West, parallel to the North line of Lot 17 of said Remsen Acres, 144.375 feet; thence South, p a r a l l e l to the East line of s a i d Remsen Acres, 40 feet to the North line of Lot 17 of said Remsen Acres; thence West, along the North line of said Remsen Acres, to the East l i n e of South 9th Avenue; thence South, along the East Fine of South 9th Avenue, to the South line of Lot i6 of said Remsen Acres; thence Ea$t, .-along the South line of Lot 16 of said Remsen Acres, to the West line of South 8th Avenue; thence South, along the West line of South 8th Avenue, to the South line extended of Lot 18, Chandler Addition accord - ing to plat thereof recorded in Volume "H" of plats, page 40, records of Yakima County, Washington; thence East, along the South lines and South lines extended of Lots 18 and 3 of said Chandler Addition to the West line of the East half of Lot 3 of said Chandler Addition; thence North, along the West line of the East half of Lot 3 of said Chandler Addition, to the North line of said Lot 3; thence East, along the North line of Lot 3 of said Chandler Addition to the West line of Block 18 Plat of Section 36, Township 13 north, Range 18, E.W.M. according to plat thereof recorded in Volume "E" of plats, page 81, records of Yakima County, Washington; thence North, along the West line of said Block 18, to the Northwest corner of said Block 18; thence West, along the North line extended of said Block 18, 25 feet; thence North, parallel to the East line of Cornell Avenue to the point of beginning; is hereby annexed to the City of Yakima, Washington. Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtednesses of the City of Yakima. Section 3. That in accordance with the recommendations of the Planning Commission of the City of Yakima, said property is hereby zoned as R -2, Two - Family Zone. -2- Section 4. That the next regularly amended Use District Map prepared by and for the City of Yakima shall show said property as hereinbefore zoned and classified. Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and the Board of County Commissioners of Yakima County. Section 6. This ordinance shall be in full force and effect 30 days after its final passage, approval and publication, as provided by law and by the City Charter.
