HomeMy WebLinkAbout1964-595 ORDINANCE NO. 9 AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -2, Two- Family Zone. WHEREAS, proceedings have been held in accordance with Chapter t 128 of the Laws of 1945, as amended, and Chapter 282 of the Laws of 1961 for the annexation of the property hereinafter described, and WHEREAS, at a regularly scheduled meeting of the Planning Commis- sion of the City of Yakima, a hearing was held pursuant to legal notice upon the zoning and land use classification of said property herein- after described and annexed, and WHEREAS, said Planning Commission duly recommended that said property be annexed to the City of Yakima and recommended that said property be zoned R -2, Two - Family Zone. WHEREAS, said proposed area to be annexed to the City of Yakima is more than 10 acres in area, and WHEREAS, the City Council has heretofore determined that it would approve the proposed annexation and that it would require the property owners of such area to assume the existing indebtedness of the City of Yakima, and WHEREAS, in accordance with the provisions of Chapter 282, Laws of 1961, a majority of the review board comprised of the Mayor of the City of Yakima, the Chairman of the Board of Yakima County Com- missioners, the Chairman of the School Board of Yakima School District No. 7, the Representative of the State Department of Commerce and Economic Development, and a Resident and Property Owner of the area proposed to be annexed, met and considered all of the factors set forth in said Chapter 282, Laws of 1961, and at the conclusion of said meet- ing made and entered their unanimous findings and determinations with respect to such annexation and recommended to the City Council of the City of Yakima that said proposed area be annexed to the City of Yakima, and WHEREAS, pursuant to due and legal notice as provided by law and by the City Charter, a public hearing was held upon said petition for annexation before the City Council of the City of Yakima on the 30th day of November, 1964, and was continued to December 7i 1964, and WHEREAS, the City Council finds that such property should be annexed to the City of Yakima and further finds that the property should be zoned as R-2, Two-Family Zone for the reasons that such • zoning is in accord with good planning and with the Comprehensive Plan of the City of Yakima, that the majority of the property owners in the vicinity do not oppose the zoning classification or the annexation, that the needs of the City and community require that such property be zoned as R-2, Two-Family Zone, and that such zoning is the highest and best use for said property, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following described real property contiguous to the City of Yakima, Washington, to-wit: TRI-SKOOL ADDITION according to the Plat thereof, recorded in Volume U of Plats, Page 4, records of Yakima County, Washington; is hereby annexed to the City of Yakima, Washington. Section 2. That the owners of the hereinbefore described real property annexed to the City of Yakima shall be required to assume existing indebtedness of the City of Yakima. Section 3. That the hereinbefore described real property annexed to the City of Yakima is hereby zoned as R-2, Two-Family Zone. Section 4. That the next regularly amended Use District Map prepared by and for the City of Yakima shall show said property to be zoned as R-2, Two-Family Zone. Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County _Auditor of Yakima County and with the Board of County Commissioners of Yakima • County, Washington. Section 6. This Ordinance shal I be in full force and effect 30 days after its final passage, approval and publication as provided by law and by the City Charter.
