AN ORDINANCE continuing in force all ordinances and resolutions not inconsistent with the Council - Manager form of government; defining certain administrative and leg- islative functions and declaring an emergency. • WHEREAS, on November 4, 1958, the people of the City of Yakima, Washington, amended the charter thereof by changing the form of government from the commission form to the council - man- ager form, and WHEREAS, it is necessary to continue certain ordinances and resolutions in force and to define certain terms used there- in, now, therefore, BE IT ORDAINED BY. THE CITY OF YAKIMA: Section 1. All ordinances and resolutions in force on the effective date of the amendment to the Charter of the City of Yak- ima, a dopted November 4, 1958 providing for the government of said city under the Council - Manager plan, and not inconsistent therewith, shall continue in full force until amended or repealed • or until they expire by limitation. All rights and obligations in favor of or against the city existing at the time said charter amendment went into effect, shall continue without modification. All street and other improvements, all vacations of public streets, alleys or places, all assessments for improvements, all suits and actions in court, all fines and forfeitures, and all other mat- ters, relating to the city that have been begun and not completed, shall be completed according to the charter, ordinances and laws existing prior to the effective date of said charter amendment. All taxes and assessments levied and remaining unpaid upon the effective date of said charter amendment shall be collected as provided by the charter, ordinances and laws in effect at the time • the same were levied. Section 2. Wherever in said ordinances or resolutions con- tinued in full force, the term "Mayor", "Commissioner of Finance and Accounting" or "Commissioner of Public Works" shall appear, , . . . the same shall be interpreted to mean "City Manager", and all such functions, obligations and duties shall be performed by him, unless otherwise provided by law or the city charter, as amended. Wherever the term "City Commission" shall appear, the same shall be inter- preted to mean "City Manager" or "City Council" as the context there- III of shall determine. Section 3. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety, and an emergency is hereby declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and the City Charter.
