AN ORDINANCE providing for the organization of the Administrative Departments of the City of Yakima, providing for the appointment of the Directors of said Departments, defining the functions, duties and responsibilities • thereof and repealing Ordinances No. B-194 as amended by B-1502, B-195, A-251, B-228, B-2234, B-2235, and. B-2261 and all other ordinances and parts of ordinances in conflict herewith and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. CITY MANAGER - POWERS AND DUTIES a 04411 The City Manager shall be the chief executive officer and the head of the administrative branch of the city government. He shall be responsible to the Council for the proper administration of all administrative affairs of the city and to that end he shall have power and shall be required to: (1) Plan, direct and coordinate the administrative functions of the city and administer and execute the laws and ordinances of the city; !:410 (2) Appoint and when necessary for the good of the service remove all administrative officers and employees of the city, all in compliance with Civil Service rules, regulations and laws; he may authorize the head of the department or office to appoint and remove sub- ordinates in such department or office; (3) Prepare the budget annually and submit it to the Council and be responsible for its administration after adoption; (4) Prepare and submit to the Council as of the end of the fiscal year a complete report of the finances and administrative activities of the city for the preceding year; (5) Keep the Council advised of the financial condition of future needs of the city and make such recommendations as may seem to him desirable; (6) Administer all finance and fiscal matters of the city and countersign all warrants and approve all claim vouchers and authorize all travel for administrative personnel; (7) Perform such other duties as may be prescribed by this ordinance or required by him by the Council, not incon- sistent with the Charter; (8) Prepare and submit to the Council such reports as may be required by that body or he may deem it advisable to submit; The Manager may have one confidential secretary, and if the volume of business justifies it he may have an administrative assistant. Section 2. ADMINISTRATIVE DEPARTMENTS - GENERAL (1) Administrative department S shall be created by the City Council as the public business may demand, upon proper recommendation by the City Manager. (2) At the head of each of the departments there shall be • a director who shall be an officer of the city and shall have supervision and control of the department subject to the City Manager. Two or more departments may be headed by the same individual. The Manager may head one or more departments. Directors of departments may also serve as chiefs of divisions. (3) The work of each department may be distributed among Such divisions thereof as may be established by ordi- nance upon recommendation of the City Manager. Each division shall be headed by a supervisor who shall be charged with the responsibility of the functions of the division. Section 3. STAFF OR AUXILIARY DEPARTMENTS There shall be*a Persannel Departtent, Records and Elections Department, Finance Department, Legal Department and Planning Department. -2- Section 4. PERSONNEL DEPARTMENT (1) The head,of this department shall be the Personnel Director, who shall be appointed by the City Manager, unless he himself assumes the position. Appointments and promotions in the administrative service of the city shall be made according to merit and fitness, to be ascertained so far as practical by competitive examinations. (2) The Personnel Director shall have had training and experience in Personnel administration. (3) The Personnel Director shall have power and be required to: (a) Cooperate with the Civil Service Commissions in -preparing and drafting such rules and regulations as may be necessary, appropriate or desirable to carry out the provisions of the Civil Service Laws and a sound personnel program; 111 . (b) Assist in the preparation of a classification plan based on the duties, authority and responsibility of positions in the municipal service; (c) Prepare and maintain a pay plan in the municipal Service; (d) Prepare and enforce the procedures for the assign- Ment of personnel to their respective positions; (e) Establish and maintain a roster of all persons. in the municipal service in which there shall be set forth, as to each office and employee: (1) the class title of the position held, (2) salary or pay, (3) any changes in class title, pay or • status, (4) such other data as may be deemed desirable or useful to produce significant facts pertaining to personnel administration; • -3- , • (f) Certify all payrolls for persons in the Civil Service. No payment for personal service to any person in the Civil Service of the City shall be made unless the payroll voucher bears the certi- . • - fication of the personnel director or his autho- rized agent that the persons mentioned therein have been appointed and employed in accordance with the provisions of this article; (g) Develop and establish training and educational programs for persons in municipal service; (h) Investigate periodically the operation and effect Of the personnel rules and regulations and report his findings to the City Manager at least once a year; (i) Perform such other and different lawful acts and functions as he may deem necessary or desirable to enforce the purposes and provisions of the 110 article. Section 5. RECORDS DEPARTMENT '(1) The head of this department shall be the City Clerk. Upon proper appointment by the City Council he shall be Clerk of the City Council. (2) He shall give notice of the meetings of the Council, shall keep the journal of its proceedings and shall authenticate by his signature and record in full in a book kept for the purpose all ordinances and resolutions. (3) He shall attend all meetings of the City Council. (4) He shall keep all records, books, paPers, bonds and other valuable documents belonging to the City, unless otherwise provided by ordinance. He shall be the keeper of the City Seal and attest the signature of all City officials. -4- • , • (5) He. shall file all cancelled warrants, bonds and coupons paid by the City Treasurer and delivered to him by said City Treasurer. (6) He shall issue all licenses for the City unless otherwise provided. 411 .(7) He shall certify to the City Treasurer all local improvement tax rolls, as passed by the City Council. (8) He shall file all copies of ordinances, resolutions, notices and official publications pertaining to each local improvement district so that all papers per- taining t,o said district may be grouped together. (9) He shall cause to be published ordinances and notices in the official daily newspaper as required by law. (10) He shall file all reports made by departments or the City Manager. (11) He shall administer the oath of office to all officers of the City required by law to take an oath of office. • (12) He shall keep the registration books as prescribed by law and register therein all voters entitled to register. (13) He shall have charge of all matters pertaining to city elections and keep such records as are necessary relative thereto. (14) He shall perform such other duties and keep such other records as may be required by the City Council or the City Manager. Section 6. FINANCE DEPARTMENT (1) The Finance Department, under the supervision of the Director of Finance, shall consist of the Division of General Accounting, Division of Utility Accounting, Division of Purchasing and Division of City Treasurer; and, subject to the provisions of the charter, state law, and ordinances, shall: (a) Compile and prepare estimates for the annual budget; - 5 - (b) Prepare and submit all financial statements and reports required by law or requested by the City Manager; (c) Maintain a general accounting system for the city government and its departments and officers and maintain central accounts for all departments, including the water utility; (d) Audit currently all departmental, special and trust funds of the City; (e) Pre-audit all purchase orders and expenditures; (f) Audit all payrolls which have been prepared and submitted by the several departments; (g) Audit all claims against the City; (h) Maintain adequate records of all receipts, dis- bursements and status of all municipal funds; (i) Purchase all supplies, materials and services for the City except the services of specialists, upon properly executed requisition; 411 (j) Store all supplies and materials not delivered to • the various departments; • (k) Maintain control and a running inventory of all fixed assets of the City; (1) Conduct all sales of general obligation and revenue bonds issued by the authorization of the City Council; (m) Prepare a monthly report of the fiscal activities bf all funds for the preceding month and such other reports as may be required by the City Manager. (2) The Director of Finance, or in case of his absence or inability to act, his representative designated by him in writing, shall sign all warrants. • (3) The Director of Finance and the City Treasurer shall each such other duties as may be prescribed by law or the City Manager. -6- • (4) The Director of Finance shall be responsible for the compilation of the budget. The budget shall be prepared in the manner and form and at the times provided by law and in accordance with the rules and 111 regulations of Division of Municipal Corporations of the office of the State Auditor. (5) The general accounting system to be employed by the Director of Finance shall be in conformity with the best recognized practices in governmental accounting and shall comply with all regulations prescribed for cities of the first class by the Division of Municipal Corporations of the office of the State Auditor. Each department and office of the city shall maintain accounts and records of financial transactions in the manner prescribed by the Director of Finance. (6) The Director of Finance shall be responsible for-all purchasing. The City Manager shall appoint a Pur- 1, chasing Agent, upon recommendation of the Director of Finance, who shall be the head of the purchasing divi- sion of the Finance Department. He shall make all purchases of materials, supplies, equipment and con- tractural services except specialized services, for all departments, offices, boards, and other agencies of the City and shall be responsible for the main- tenance of parking meters. ri/3 Section 7. CITY TREASURER (1) The City Treasurer shall: (a) Be responsible for the receipt, custody and dis- bursement of all city funds and all local improve- . ment district funds and other trust funds; (b) Receive all utility accounts; (c) Collect all proceeds from parking meters; -7- (d) Collect all business license fees and occupational taxes due the City; (e) Be the custodian of all departmental investments - and bank collateral; (f) Keep an accurate and detailed account of all col- .. lections and disbursements in the manner prescribed by the Director of Finance; (g) Prescribe the times at and manner in which moneys received by the several departments of the City shall be paid into the Treasury or deposited in the bank; (h) Make all deposits of city funds in banks in the manner prescribed by law; (i) Keep separate and distinct accounts for each fund as required by law or city charter; (j) Purchase and sell bonds for benefit of local improvement district funds and the local improve- ment district guaranty fund; all checks of the 410 City shall be signed by the City Treasurer or, in case of his absence or inability to act, by his representative designated by him in writing. Section 8. LEGAL DEPARTMENT The Legal DePartmentunder the supervision of the City Attorney shall: (1) Advise and assist in the preparation of and prepare in final form and certify as to legality, all ordinances, orders and regulations; (2) Prepare and pass on the legality and correctness and form of all contracts, bonds, and other legal instru- ments to which the city is a party; (3) Advise the Council, the City Manager, all department heads and other administrati officials and all boards and commissions regarding legal matters; -8 - (4) Be responsible for all prosecutions under ordinance of the city; (5) Represent the city as attorney in all legal proceedings in which the city is a party; (6) Recommend settlement or compromise of claims or suits 411 at law or equity to which the city may be a party involving property rights or money claims; (7) Preserve in its office copies of all opinions rendered by the department; (8) Perform such other legal duties as may be required by the Charter, ordinance, the Council, or the City Manager. The City Attorney or an Assistant City Attorney desig- nated by him, shall attend all meetings of the City Council and, upon invitation, any meeting of any com- mittee or advisory board of the Council. Section 9. CITY PLANNING DEPARTMENT The City Planning Department shall be under the supervision of the City Planner, and shall: • 411 (1) Make studies and conduct research relative to the dev- elopment of the master plan of the City of Yakima, zoning and rezoning, and development and extension of streets, parkways and drives; (2) Provide all staff assistants and counsel, secretarial and clerical services required by the City Planning Commission; (3) Carry out research and planning to any other development projects as directed by the City Manager. Section 10. LINE DEPARTMENTS There shall be a Police Department, Fire Department, Engineer- ing Department, Street and Sewer Department, Waterworks Department, Inspection Department, Municipal Airport Department, Cemetery Depart- Ment and CiVil Defense Department. -. Section 11. POLICE DEPARTMENT The Police Department shall be under a director who shall be known as Chief of Police. He shall; (1) Prevent crime; (2) Enforce all traffic ordinances and regulations; (3) Enforce all criminal laws and ordinances; (4) Detect and apprehend offenders and suspected (5) Preserve peace and order in the city; (6) Protect persons and property; (7) Maintain proper records of crime and criminals and matters relating thereto; (8) Maintain a youth guidance and counseling service within the department; (9) Maintain an adequate service training program; (10) Perform such other duties as the City Manager may direct; (11) Have control of the assignment of all members of the force and the direction of all police work in the city, subject to the approval of the City Manager. 411 Section 12. FIRE DEPARTMENT The Fire Department shall be under the supervision of a director who shall be known as Fire Chief and shall: (1) Prevent and extinguish fires; (2) Protect lives and property against loss from fire; (3) Remove and control fire hazards; (4) Enforce laws or ordinances relating to fires or fire hazards; (5) Maintain proper records of fire hazards and fires; (6) Maintain an adequate service training program; (7) Maintain an adequate fire alarm system and radio com- munication system; 411 (8) Perform all duties and_make all reports required by the City Manager and also such other duties as may be directed by him; • - 10 - 4 (9) Have control of the assignment of all members of the force and the direction of fire work in the city, sub- ject to the approval of the City Manager; (10) Have all power provided by law relative to the pro- ' tection of persons and property and the elimination of fire hazards; (11) Be responsible for the construction, repair and main- tenance of the signal and communication systems, in- cluding traffic signals. Section 13. ENGINEERING DEPARTMENT The Engineering Department under the supervision of the City Engineer shall: . (1) Provide for the preparation of all estimates, plans and specifications for all types of public construction projects; (2) Check and maintain a suitable file on record of all official maps, plats, surveys and construction projects; (3) Establish and maintain all monuments and bench marks; • (4) Prepare all public descriptions and arrange for the acquisition of all street rights of way by dedication, purchase or condemnation; (5) Negotiate with property owners and prepare cost esti- mates and assessment rolls for all local improvement district projects; (6) Investigate and arrange for the repair of all broken or substandard sidewalks; (7) Maintain a file of suitable projects of the City of Yakima; estimate and design for such contemplated future work as directed; (8) Coordinate with other departments surveys needed in planning projects and maintaining proper records; (9) Cooperate with Inspection Department when needed and Perform such other service S as may be required by law or the City Manager. - 11 - 1 Section 14. STREET-SEWER DEPARTMENT This department Shall be under the supervision of a director, who shall be known as the Public Works Superintendent. He shall: (1) Maintain, repair, clean and remove snow from the streets; (2) Operate and maintain the sewers, both sanitary and storm; (3) Collect and dispose of garbage; (4) Operate the City paint shop; (5) Maintain parking meter standards; (6) Perform such other services as may be required by law or the City Manager. Section 15. WATERWORKS DEPARTMENT This department shall be under the supervision of a director who shall be known as Water Superintendent. He shall: (1) Maintain and operate all water lines, pumps, distri- bution system, water meters, service lines and appur- tenances; (2) Lay all new lines and extension of lines as planned by the city and designed by the City Engineering Department; 111 (3) Supervise the Irrigation Division; (4) Install and maintain firehydrants; (5) Be responsible for all equipment and facilities of the Water Department, both domestic and irrigation; (6) Have general charge of the operation and maintenance of the Sewage Disposal Plant; (7) Perform such other services as may be required by law or the City Manager. Section 16. INSPECTION DEPARTMENT This department shall be under the supervision of a director to be known as the Building Inspector. He shall: (1) Supervise the general activities of the department; (2) Enforce all the laws, rules and regulations relative to oning, and all construction codes; (3) Perform such other services as may be reauired by law or the City Manager. • - 12 - . - - I Section 17. MUNICIPAL AIRPORT DEPARTMENT This department shall be under a director who shall be known as Airport Manager. He shall: (1) Exercise all the powers and duties which are inherent in the responsibilities of an Airport Manager; (2) Have general supervision of the Airport; (3) Establish procedures and practices conforming with state law, city ordinances and Federal Aviation Agency Regu- lations; (4) Maintain and police the airport runways; (5) Perform such other services as may be required by law or the City Manager. Section 18. CEMETERY DEPARTMENT This department shall be under a director who shall be known as Cemetery Superintendent. He shall: (1) Supervise the Cemetery; (2) Maintain and improve the Cemetery; • (3) Keep a correct record of all interments, showing the name, age, nativity, residence, whether married or single, and time of interment, of all persons buried in the cemetery, and of the lot, block and section in which.each person is interred; (4) Collect and pay to the City Treasurer all money due the city from the sale of blocks or parts thereof or labor performed for lot owners in or about the Cemetery; (5) Perform all such services as may be required by law or the City Manager. Section 19. CIVIL DEFENSE DEPARTMENT The Director of Civil Defense shall: (1) 'Administer and carry out the plans for civil defense adopted by the city; (2) Coordinate civil defense functions and activities of the city with all other public agencies and affected -13- private persons, corporations and organizations; (3) In the event of an emergency or disaster, issue rules and regulations related to the protection of life and property as approved by the Council, obtain vital • supplies and equipment required, require emergency services of any City officer or employee, requisition necessary personnel or material of any city department or agency, and execute all powers conferred by ordinances, state law, or other lawful authority in cases of emergency; (4) Perform such other services as may be required by law or the City Manager. Section 20. With the approval of the City Council, other departments may be created by the City Manager as the needs of the City of Yakima require. Section 21. Ordinances No. B -194 as amended by B -1502, B -195, A -251, B- 228, -2234, B -2235, B -2261 and such other ordinances • or parts of ordinances in conflict herewith'are hereby repealed. Section 22. This ordinance is necessary for the immediate preservation of the public peace, health, welfare and safety and an emergency is hereby declared to exist and this ordinance shall be in effect immediately upon its passage, approval and publication as provided by law and the City Charter.
