My name is Anne Knapp; I live in Yakima. I'm pleased to see that a new Yakima Valley Trolleys Executive Director is on board. I'm perplexed by recent inaccurate 6th Avenue trolley cost estimates, postponement of a correction to the Yakima Valley Transportation Company's listing on the National Register of Historic Places, and transportation improvement program listings. The credibility of the trolley and the City is very important to the trolley, City, potential and actual donors, potential grantors, state and federal agencies, and last but not least the public. Monthly Council updates on City trolley work and Yakima Valley Trolleys' fund raising would help ensure accurate and timely info. 1. Conflicting Cost Estimates: $5 Million vs $8.4 Million vs $20 Million Does the City provide accurate cost info to the trolley? Has YVT secured the needed funds for design and construction? Or will taxpayers end up covering the cost to provide tracks and accessories? • The VVT Executive Director states $5 Million is needed too to Selah See Yakima Herald story 10/17/2026 Racal business womei in business attie raffe-brie s -a - con ma nit -focus ttow re ervin " akima-valle -trolls' s "The organization is currently working to raise $5 million to restore a route from Selah to Yakima. This would include rebuilding the line along Sixth Avenue. Yakima Valley Trolleys are the last intact example of an early 1900 interurban electric railway in the country." • Hl 's detailed estimate is R.4 million for a portion of 6ta, Ave. Going to Selah is likely 20 million See the 11/6/2025 HLA 6th Avenue Rebuild and Rail Renovation "Engineer's Opinion of Construction Cost". $8.4 Million for just 1.5 miles of the four -mile run to Selah - about $5 Million/mile. Four miles = $20 Million for a tourist attraction. How much has been raised? Is 6th Avenue design underway and does it include the trolley and provisions? Is YVT contributing less than one -quarter of the costs for the run to Selah? • September 2026 informal estimate of $7 Million just for track along 6tt' Avenue See email from Mr. Bill Preston, P.E., SC Director, City of Yakima to Dr. Allyson Brooks, WA Dept of Archology and Historic Preservation. Mr. Preston made it clear no City funds will be used to replace trolley tracks. "The City is actively working on our 6th Ave Reconstruction project which is a total rebuild of 6t' Ave. The Yakima Valley Transportation Co (Trolley) tracks run down the center of 6t" Ave and will need to be removed as part of the project. The Yakima City Council has determined that the City will not use City funds for the replacement of the tracks. We currently have an Operations and Maintenance Agreement with the Yakima Valley Trolley Association to operate the City's trolley system. The City Council has given the Trolley Association until August 17, 2027 to obtain the funds to reinstall the tracks as part of the project. The total cost is estimated at $7 million. They are actively seeking donations at this time." Comments 10 20 26 City of Yakima City Council Comments October 20, 2026 2. Why Delay My September 2025 Petition For Removal (Petition) to the Dept. of Archeology and Historic Preservation (DAHP)? I appreciate the work done by folks on helping achieve the Register listing for the YVT Co. However, I became perplexed when I read Mr. Ken Johnsen's nomination. After diligent research, I sent a petition to DAHP on September 19, 2025 to correct significant errors in that nomination. On September 2, 2026, the City asked DAHP °... the City respectfully requests that `DAHP delay the review until next year when we know whether the tracks will be replaced or not... At this time, the City cannot confirm whether or not the tracks in 6th Ave, or those out to Selah, will remain.......... Postponing the Petition may harm private property owners because the City has yet to determine who owns the land under the tracks. Private property owners need this info to conduct their own business and make their own property decisions. I filed the petition to protect private property rights. Postponing the Petition provides no historic preservation benefit. The City said they are removing the rails from 6th Avenue but may or may not reconstruct the railroad tracks, wires, and overhead electric power system. If the tracks are removed and not reconstructed, they cannot be listed on the Register. If electrified tracks are reconstructed, then they cannot be listed per 36 C.F.R. § 6O.4(e) because tracks with the same association have survived on Pine Street. Either way, a postponement would have no effect on removal based on prejudicial procedural errors in the 1992 listing. The YVT Co is on the National Register of Historic Places (Register), not YVT. Two other companies preceded the YVT. Unfortunately, the YVT's'site, under General Information, incorrectly states "The Yakima Valley Trolleys operate on the tracks of the former Yakima Valley Transportation Company (YVT Co) in Yakima, Washington, U.S.A. The YVT is listed on the National Register of Historic Places....... Bold shows the incorrect claim. hops:/`www.yakimavalleytro{le s.orgjvt histaryl. There continue to be claims that YVT is listed. A key focus is errors in the original nomination and listing such as inclusion of private property without any notice to private landowners and the 15 miles of railroad track, wires, and poles that were completely removed in 1987 were nevertheless listed on the National Register in 1992. The trolley hasn't operated with the electric power lines on 6th Avenue for 21 years. Overall, almost 99% of the original tracks are gone. For example, years before the 1992 listing, the court ruled the City and trolley group had no property interests in the sprawling orchard lands owned in fee simple by Congdon Orchards, Inc. Congdon's properties, including the Wide Hollow Substation, were listed on the National Register contrary to the landowner's 1987 notarized objection to listing. The 15 miles of railroad track, wires, and poles that were completely removed in 1987. The trolley group was a named defendant in the Congdon litigation and was fully aware of the Court's 1987 decision but failed to inform SHPO in 1992 that Congdon Orchards objected to listing their private properties and the private Wide Hollow Substation. Comments 10 20"26 2 City of Yakima City Council Comments October 20, 2026 The City and trolleys should recognize the complex nature of documenting historic resources. We should work together to correct errors, which may result in harm to property owners. The Yakima Valley Transportation Company was an asset to our valley and remains an asset to our community. Inaccuracies damage our credibility and may mean loss of grants and other funding. 3. Secured Funding Stated In YVCOG Municipal / Regional Transportation Improvement Program (TIP) See green row below. Only the City can correct these mistakes, per the YVCOG staff and its Transportation Policy Committee, when I commented October 3 and October 19, 2026. 9kakktl a , $ SAfTF+A4 HS FM A4y ©sa. d ! Per Council directive no City funds shall be used for trolley track infrastructure consistent with Council's previous direction regarding TBD funds, this does not apply to donated specific funds or Council approved funds." YVCOG: Omitted the language "Per Council directive... approved funds". It stated local funding is secured, see 6th column. Has YVT secured the needed funds for design and construction? Or will taxpayers end up covering three quarters of the cost to provide tracks and accessories for a seasonal tourist attraction to Selah? 4. The Trolley Is Not Transportation and Should Not Be On Any TIP Some confusion can be remedied by recognizing that the trolley is not transportation and not a rail line. Clarity helps focus on mode appropriate grants and target local, state, and federal funds. Scoring on the City's recent application for a Washington Heritage Capital Grant were generally supportive but also noted questions about operations, funding, and is it a trolley or train. Scoring also indicated that the application seemed to be for a public infrastructure and not history such as a museum. Kudos to the City for trying for this grant after the YVT application was declined. FEDERAL LAW Yakima's tourist trolley streetcar is not "public transportation" because the trolley provides sightseeing services and does not provide regular, functional, and continuing mobility. 49 U.S. Code § 5302(15), 23 C.F.R. § 450.104. The predominately seasonal operations on summer weekends/holidays fail continuity/mobility requirements. 23 U.S.C. § 134(c) 23 C.F.R. § 450.200. Federal STIP projects must meet ADA requirements (42 U.S.C. § 12141; 49 C.F.R. Part 37). But Non- ADA-accessible trolleys (e.g., trolley with steep, narrow stairs only) cannot serve all potential riders, failing accessibility standards. STATE LAW Under RCW 81.104.015, Yakima's trolley streetcar "is not public transportation" because it is a seasonal tourist attraction. Under RCW 46.04.440, RCW 46.04.570, and RCW 36.75.010, Yakima's tourist trolley is not a'"railroad" but instead is a streetcar operating upon stationary rails almost entirely within the Cities of Yakima and Selah. Comments 10 20 26 3 City of Yakima City Council Comments October 20, 2026 CITY F YAKIMA LAW AND ACTION Under both City Ordinances and State statutes, the trolley is not eligible for City Transportation Benefit District funds: (I) ) the trolley is not a railroad, (2) the trolley is a seasonal tourist attraction, (3) the trolley is not "Public Transportation," (4) the trolley is not a "Transportation Improvement," (5) building trolley tracks is not "necessitated by existing or reasonably foreseeable congestion levels," (6) the seasonal trolley will not "alleviate congestion," and (7) the trolley docs not satisfy the criteria in RCW 36.73.020(1). Moreover, there is no evidence that new trolley tracks on 6th Avenue between Walnut and River Road will be "Regionally Significant" as required under state law. There is no evidence that 6th Avenue trolley tracks are part of a regional plan nor is there evidence of regional coordination with Selah, Yakima County, and the State of Washington. Gwm MN*n.
