EJCDC®C-941,Change Order. Prepared and published 2013 by the Engineers Joint Contract Documents Committee. Page 1 of 2 27 EJCDC ENGINEERS JOINT CONTRACT DOCUMENTS COMMITTEE PHASE 2B ONE-TIME ADJUSTMENT The City of Yakima and Interwest Construction, Inc. mutually agree to remove paragraphs F and H of Article 6.01 of the Executed Agreement (Section 00 52 13) as they pertain to Phase 2B due to substantial changes to the project scope and planned implementation. The original Phase 2B pipeline alignment was to extend across Powerhouse Road with minimal restoration to the roadway and then through private property. Easements could not be acquired for this pipeline alignment outside of Powerhouse Road. Therefore, a revised pipeline alignment was provided to Interwest Construction, Inc. for a price proposal (CPR 008) to extend the pipeline alignment within Powerhouse Road between South Naches Road and Ackley Road. Interwest Construction, Inc. price proposal for the Phase 2B project scope is in 2026 dollars. PHASE 2B ADDITIONAL LABOR, EQUIPMENT,AND MATERIAL COSTS The original contract amount for Phase 2B is$2,520,002.00 (without sales tax). Interwest Construction, Inc. price proposal for Phase 2B is additional to the original contract amount listed above. The original scope of work associated with Phase 2B has been significantly modified due to unforeseen construction logistics associated with easement acquisition near Powerhouse Road. Below is a table summarizing the changes in major work items associated with Phase 2B. Additional labor and equipment costs for the new alignment are associated with additional traffic control, reduced production rates, labor overtime pay(5—12 hour days), Powerhouse Road restoration, limited workspace, haul truck constraints, additional rock excavation, and additional excavation due to deeper pipe. Additional equipment incudes light plants, paver, roller, grader and dump trucks. Additional materials included piping, pipe zone and backfill material, asphalt, aggregates, pipe fittings and shoring. RETAI NAG E The current executed contract (Specification Section 00 52 13) between the City of Yakima and Interwest Construction, Inc. per Article 7.02 indicates that the Owner may withhold prior to Substantial Completion 95 percent of the value of the Work completed (with the balance being retainage) and 95 percent of the cost of material and equipment not incorporated in the Work(with the balance being retainage). The City of Yakima and Interwest Construction, Inc. mutually agree this does not apply as Interwest Construction, Inc. procured a retainage bond for Nelson Dam Removal Phase 2 (all three phases).
