AN ORDINANCE classifying the zone of a certain area annexed to
the City of Yakima under Ordinance No. II
and declaring an emergency.
WHEREAS, in Ordinance No. / 4 / the City Council of
the City of Yakima annexed to the City of Yakima the following
,described property contiguous thereto, to-wit:
Lots 2, 3, 4, 5, 6, 7 and 8 of the Ontario Land
Company's Subdivision according to the official plat
thereof, now on file and of record in the office of the
Auditor of Yakima County, Washington; and also the
following;
Beginning at a point 206.1 feet East and 1258 feet South
of the NW Corner of the NE Quarter of Section 22, Township
13 N., Range 18, E.W.M.; thence North 222.8 feet; thence
East 25 feet; thence North to the South line of Lot 8 of
The Ontario Land Company's Subdivision; thence in an
easterly direction along the Southerly line of Lots 8,
7, 6 and 5 of said subdivision; thence South to the
center line of Lincoln Avenue; thence West along the
center line of Lincoln Avenue to a point 206.1 feet
East of the West line of NE Quarter of said Section 22;
thence North to the point of beginning.
and,
WHEREAS, Lots 3, 4, 5, 6, 7 and 8 of the said Ontario
• Land. Company's Subdivision, together with a portion of the I\TIA
of Section 22, Township 13 N., Range 18, E.W.M. have been re-
platted as Kern Addition, the same having been duly filed,
recorded and accepted as an official plat, and
WHEREAS, Section 306 of Ordinance No. B-2095, as amended,
provides that unless otherwise classified by City ordinance after
a recommendation from the Planning Commission, all land or terri-
tory annexed to the City of Yakima shall immediately upon annexation
be classified as being in a R-1 Zone, and
WHEREAS, on July 24, 1959 the Planning Commission of the
City of Yakima recommended to the City Council that Lot 1 of said
Kern Addition be classified as R-3 Zone, Multiple Family Residential,
upon annexation, and
111 WHEREAS, the City Council finds that such zoning of said.
Lot 1 of Kern Addition would not have the effect of depreciating
residential property values in the adjacent area; that the
majority of property owners in the immediate vicinity favor such
classification; and that the highest and best use of said parcel
is for such use, and that such classification is in the best
interest of the people of the City of Yakima, now, therefore,

BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Lot 1 of Kern Addition, the same being
a re-plat of the area annexed to the City of Yakima in Ordinance
No. is hereby classified as R-3 Zone, Multiple
Family Residential, and all of the remainder of said annexed
area is hereby classified as R-1 Zone, Single Family Residential.
Section 2. This ordinance is one to provide for the
- immediate preservation of the public peace, property, health
and safety and an emergency is hereby declared to exist, and
this ordinance shall be in full force and effect immediately
upon its passage, aproval and publication as provided by law
and the City Charter.
