For Meeting of: May 16, 2017 ITEM TITLE: Resolution approving supplemental agreement No. 2 with Yakima County, in an amount not to exceed $1,066,405, intended to apportion the costs of work previously agreed upon in Contract Number 2011-66, relating to road design and development for an East-West Corridor SUBMITTED BY: Brett Sheffield, Chief Engineer, 576-6797 Scott Schafer, Director of Public Works SUMMARY EXPLANATION: The City and Yakima County previously entered into an I nterlocal Agreement (I LA) identified as City Contract Number 2011-66 in J my of 2011, which was previously supplemented in October 2012, for the joint planning and development of an arterial corridor known as the East-West Corridor, which stretches from 1St Street in Yakima to Butterfield Road in Terrace Heights. The I LA and previous supplemental provided for the allocation of costs between the City and County for the design work to be performed on the East-West Corridor to a 30% design. This current request for an additional supplemental to the I LA provides for the complete design of the East-West Corridor in three phases. The City's cost of this work is $1,066,405, which amounts to 21 % of the total cost and will occur between 2017 and 2020. Funding for this work will come from Local Investment Financing Tool (LIFT funds), of which the City receives approximately $1,000,000 annually. Attached for City Council review is the Supplemental I LA with Yakima County for the purpose of completing the design of this important project. R -2017- A RESOLUTION approving Supplemental Interlocal Agreement No. 2 between the City and Yakima County, in an amount not to exceed $1,066,405, intended to apportion the costs of work previously agreed upon between the City and County in City Contract Number 2011-66, relating to road design and development of the East-West Corridor. WHEREAS, the City and Yakima County previously entered into an Interlocal Agreement identified as City Contract Number 2011-66 for the joint planning and development of the arterial corridor known as the East-West Corridor; and WHEREAS, the City and Yakima County previously entered into Supplemental Agreement No. 1 of this contract, which apportioned out the cost of work to produce an Interchange Justification Report, along with the first phase of work (30% design) of the East-West Corridor from North 1St Street to Butterfield Road; and, WHEREAS, the terms of the cost allocation between the City and County have been determined for the work required to completed the design of the East-West Corridor and are provided in the attached and incorporated Supplemental Interlocal Agreement No. 2; and WHEREAS, the City Council finds that it is in the best interest of the City and toward the furtherance of the project for the City to approve the attached Supplemental Interlocal Agreement No. 2 for the purpose of defining the allocation of project costs; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute the attached and incorporated Supplemental Interlocal Agreement No. 2 providing for the allocation of costs for the East-West Corridor project between the City and County as set forth therein. Kathy Coffey, Mayor ATTEST: City Clerk 4 SUPPLEMENT #2 TO INTERLOCAL AGREEMENT BETWEEN YAKIMA COUNTY AND THE CITY OF YAKIMA REGARDING THE DEVELOPMENT OF IMPROVEMENTS KNOWN AS THE EAST — WEST CORRIDOR / CASCADE MILL DISTRICT REDEVELOPMENT PROJECT This Supplemental Interlocal Agreement is entered into by and between Yakima County, hereinafter referred to as the "County" and the City of Yakima, hereinafter referred to as the "City" for the purpose of apportioning the Costs for the work agreed to in the Interlocal Agreement identified as City Contract #2011-66 and County Contract #408-2011. WHEREAS, the City and the County have entered into an Interlocal Agreement to jointly undertake planning and development of an arterial corridor known as the East-West Corridor for development of an Interchange Justification Report for access modifications to the Interstate 82 / Yakima Avenue Interchange, and planning level design for the East-West Corridor; 1st Street to Butterfield Road; and, WHEREAS, the City and the County have completed work on the Interchange Justification Report and the planning level design for the East-West Corridor; 1st Street to Butterfield Road and now desire to undertake final environmental review and construction document preparation; and, WHEREAS, the County has entered into an Agreement with the Consultant Team lead by H.W. Lochner ("Consultant") for the final environmental review and construction document preparation for portions of the East-West Corridor in the City and the County; and, WHEREAS, said Interlocal Agreement identified that the apportionment of the Costs for the completion of the work for the East-West Corridor; 1st Street to Butterfield Road would be determined at a future time and agreed to as a supplement to said Agreement; and, WHEREAS, under RCW Chapter 39.34, the parties are each authorized to ether into an interlocal agreement, NOW THEREFORE, it is agreed by the parties as follows: 1. The City shall be solely responsible for all costs related to the Fair Avenue Extension (now known as Bravo Company Boulevard) under the City's contract with their Consultant; 2. The County and the City shall share in the costs incurred by the County under the County's contract with the Consultant for the East-West Corridor; 1st Street to Butterfield Road elements of the work, including the Consultant's Project Management and markup costs, in the proportions set forth in Exhibit "A", attached, with the aggregate City cost share to be 21% of the total Consultant Contract amount which is: $1,066,405. 5/4/2017 8:39 AM 3. The County Agrees to pay all monies due to the Consultant under the terms of the Consultant Agreement out of the County Road Fund. The County shall submit a request for reimbursement to the City, at least on a monthly basis, with the appropriate documentation of the costs payable to the Consultant for the work described above, in the proportions set forth in Exhibit "A". The City agrees to remit payment to the County within 30 days of receipt of the request for reimbursement. 4. The County agrees that it will not enter into any supplemental agreement with the Consultant for additional work that will be paid for by the City under the terms of this Agreement without written concurrence form the City. Any supplemental work that will be paid for solely by the County shall not require concurrence from the City. 5. The City and County agree that the terms of this supplemental agreement shall be retroactive to the date of the County's Notice to Proceed to the Consultant, or April 10, 2017. 6. Either the City or the County may terminate this Agreement by giving Sixty (60) days written notice to the other party. If the contract is terminated the City will compensate the County for its allocated share of that portion of the work performed by the Consultant up to the date of Termination.
