ITEM TITLE: Resolution authorizing Right of Way Use Permit Application
RL260006 for Minado Buffet Inc at 501 N Front St

SUMMARY EXPLANATION:
Suncan Yan of Minado Buffet Inc is requesting approval of a Right of Way Long Term use Permit
application number RL260006 for a used cooking oil container in the city right of way at 501 N Front
Street. The property is located in the GC zoning district.
He previously had submitted a permit application to leave two storage containers in city right of way with
the cooking oil container, but that request was denied by council at the recommendation of the
community development division managers. The division managers then worked with him to find an
agreeable solution, which will be that the storage containers will be relocated onto his private property
and the cooking oil container will be allowed to stay in the right of way with conditions. One condition is
that they will provide a spill pan underneath the container.
Right of Way Use permits are processed under the provisions of Chapter 8.20, which requires review by
the code administration manager and final approval by the City Council. The permit also requires lability
insurance as prescribed in Section 8.20.060, which will be provided to the Office of Code Administration
prior to issuance of any permit. Approved permits are valid for a period of one year, renewable annually.
This allows the City an opportunity to review any public health/safety/welfare issues that may need to be
addressed in subsequent years.

RESOLUTION NO. R-2026-
A RESOLUTION authorizing the issuance of a right-of-way use permit to allow a
grease trap for Minado Buffet Inc.
WHEREAS, pursuant to Chapter 8.20 YMC, the City Council is authorized to issue
permits for construction of certain improvements within public rights-of-way; and
WHEREAS, Suncan Yan of Minado Buffet Inc. is requesting a right-of-way use
permit to allow the use of a grease trap at 501 N Front Street in the public right-of-way; and
WHEREAS, city staff has recommended approval of such a permit, and that the
application be reviewed by the full Council; and
WHEREAS, the City Council, having considered such application and the
recommendation of city staff, hereby finds and determines that issuance of the requested
right-of-way use permit authorized pursuant to Chapter 8.20 YMC is in the best interest of
the residents of the City of Yakima and the City, and will promote the general health,
safety and welfare; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute and issue a right-of-way use
permit in accordance with the provisions of Chapter 8.20 YMC and in conformity with the
application for such permit submitted by Suncan Yan of Minado Buffet Inc. by application
dated February 6th, 2026, and designated as city Regulatory License No. RL260006 at 501
N Front Street which shall include the following provisions:
1. Follow all requirements of YMC 8.20, including but not limited to, the
insurance requirements;
2. The City may terminate the permit after having provided 30 days written
notice to the applicant;
3. Upon termination of the permit, the applicant shall restore such right-of-way
to the condition it was in prior to the installation of the work.
ADOPTED BY THE CITY COUNCIL this 7th day of July, 2026.
