ITEM TITLE: Resolution accepting Change Order No. 1 with Ascent Foundation &
More LLC for the Stormwater System Spot Improvements Project
SW2832 (Stormwater Capital Fund 442)

SUMMARY EXPLANATION:
The City of Yakima selected Ascent Foundations & More LLC for Project SW2832 Stormwater System
Spot Improvements. The additional materials and work in the attached Change Order No. 1 with Ascent
were required to remove and replace unsuitable foundation materials encountered by the contractor at
the improvement sites. The Change Order is in an amount not to exceed $190,000 and includes the
addition of 4 working days to the contract term (City Contract 2025-163). The Change Order is funded
through Stormwater Capital Fund 442.
ITEM BUDGETED: N/A
STRATEGIC PRIORITY 24-25: A Safe and Healthy Yakima
RECOMMENDATION: Adopt Resolution.

A RESOLUTION accepting Change Order No. 1 to City Contract 2025-163 with Ascent
Foundation & More LLC for Project SW2832 Stormwater System Spot
Improvements (Stormwater Capital Fund 442)
WHEREAS, the City of Yakima (City) selected Ascent Foundation & More LLC as the
contractor for Stormwater System Spot Improvements Project SW2832 as approved through
Resolution 2025-146; and
WHEREAS, additional construction materials and working days were required of Ascent
Foundation & More LLC due to unforeseen unsuitable foundation materials encountered at the
project sites; and
WHEREAS, the total cost of Change Order No. 1 is $190,000. with an increase of four
working days to the contract term; and
WHEREAS, City stormwater capital funds will be used to pay for the change; and
WHEREAS, the City finds that it is in the best interest of the City of Yakima and its
residents to approve the City Manager's execution of Change Order No. 1; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute the attached Change Order No. 1 with
Ascent Foundation & More LLC for additional work associated with Project SW2832 Stormwater
System Spot Repairs in the amount of ONE HUNDRED AND NINETY THOUSAND AND
00/100ths DOLLARS ($190,000.00) with an increase of four (4) working days. A true and correct
copy of the Change Order is attached hereto and fully incorporated herein.

You are directed to make the following changes in this Contract:
Gray&Osborne,Inc.(G&O),on behalf of the City of Yakima,has reviewed Change Order Proposal COP-001 regarding additional
work associated with the excavation and replacement of unsuitable foundation materials encountered during construction.
Determination: G&O concurs that,dining construction operations,unforeseen unsuitable foundation materials were encountered at
the project site.These materials were determined to be inadequate to support the design requirements and necessitated removal and
' replacement to ensure compliance with project specifications and structural integrity.
Measurement:Measurement for the work described herein shall be made on a cubic yard basis for all unsuitable material excavated
and replaced.No separate measurement will be made for individual components of the work.
Payment: Additional Compensation for all labor,materials,equipment,and incidentals required to complete the work including,but
not limited to,excavation.disposal of unsuitable materials,furnishing and placement of geotextile.import and placement of founda-
tion rock,hauling,embankment construction.grading,compaction.and all required testing beyond work specified in the Contract
Documents shall be made under the newly established bid items below.Payment shall constitute full compensation for all work associ-
ated with this Change Order.
