ITEM TITLE: Resolution setting the time and place for a public hearing on July 21,
2026, at 6:00 p.m. in the City of Yakima City Council Chambers to
hear from the public on the proposed surplus of real property owned
by the City and acquired for utility purposes

SUMMARY EXPLANATION:
Ordinance 3384 vacated an alley adjacent to the former Astria hospital and newer surgical center. The
ordinance retained a right to a utility easement interest for the City through the alley. There are no
utilities located in the easement area and the City has no need to have an easement. Since the right to
the easement was to use it for utilities purposes, the City Council is required to hold a public hearing
before surplussing the easement right. This resolution sets the public hearing on the surplus of the
property to July 21, 2026.

RESOLUTION NO. R-2026-
A RESOLUTION setting the time and place for a public hearing on July 21, 2026 at 6:00 p.m.
in the City of Yakima City Council Chambers to hear from the public on the
proposed surplus of real property owned by the City and acquired for utility
purposes.
WHEREAS, the City of Yakima has a real property interest in an easement right that was
acquired for utility purposes pursuant to Ordinance No. 3384 which vacated an alley right-of-way
bounded by South 10th Avenue, South 11th Avenue, West Walnut Street, and West Chestnut
Avenue; and
WHEREAS, the Ordinance provided that upon vacation the City retained a 20 foot wide
utility easement in the location of the then-existing alley; and
WHEREAS, an easement was never filed, there are no utilities running through the
property over which the easement is allowed, and the City of Yakima has determined it has no
need for the easement to provide for utilities; and
WHEREAS, pursuant to RCW 35.94.040, because the property was originally obtained
for utility purposes, a public hearing must be held prior to surplussing the property, regardless of
the property's value; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The proposed surplus of City property, specifically the easement interest created by
Ordinance No. 3384 located in the former north/south alley bounded by South 10th Avenue, South
11th Avenue, West Walnut Street, and West Chestnut Avenue, legally described as follows:
That part of Block 392, Capitol Addition to North Yakima, as recorded in Volume
"A" of Plats, page 29, records of Yakima County, Washington, described as
follows: Beginning at the Northwest corner of Lot 1 of said Block 392; thence
Southwesterly to the Northeast corner of Lot 16 of said Block 392; thence
Southeasterly to the Southeast corner of Lot 9 of said Block 392; thence
Northeasterly to the Southwest corner of Lot 8 of said Block 392, thence
Northwesterly to the point of beginning.
shall be presented for a public hearing and determination by the City Council at the hour of
6:00 p.m. on July 21, 2026, in the City Council Chambers of the City of Yakima at Yakima City
Hall, 129 North 2nd Street, Yakima, Washington, or as soon thereafter as the same so that all
persons interested may appear and be heard, and that notice of such hearing be given as required
by law.
ADOPTED BY THE CITY COUNCIL this 16th day of June, 2026.
