AN ORDINANCE appropriating the sum of $10,000.00 to the Cemetery
Fund and declaring an emergency'.
WHEREAS, at the time of the adoption of the 1959 Budget,
insufficient money was appropriated to. the Cemetery Pund to lake
care of' the budgeted _expenses of said Department, said : insufficiency
of funds having been accrued in the year prior to 1959, and
WHEREAS, the City Council•finds.it is necessary for .the
preservation of the public health, welfare and safety - of the City
of Yakima and in the- best interests of the City of Yakima to make
an appropriation to the said Cemetery Fund and that an emergency
exists of the - type contemplated by R.a.W. 35.33.090, now, therefore, •
BE IT ORDAINED BY THE CITY OP YAKIMA:
.Section 1. There is hereby appropriated the sum of 310000.00
from the unappropriated moneys of the City of Yakima to the Cemetery
Fund, and the Director of Finance and 'City Treasurer of the City
of Yakima are hereby authorized and .directed to make the aforesaid
tran _ sfer. •

?Section 2. This ordinance is one to provide for the

immediate preservation of the public peace, property ,health
and safety of the people of the City of Yakima, and an emergency
i,s hereby declared to exist and this ordlnance shall be in .full

Re. Ordinance No. 64 appropriating
$10,000 to Cemetery Fund
Dear Sir:.
Ordinance No. 64, passed as an emergency measure
by the City Council on December 30, 1959, appropriated
the sum of $10,000 from the unappropriated moneys of
the City of Yakima to the Cemetery Fund. Since the
ordinance did not specify which fund the $10,000 should
• be taken from, you have requested my opinion from the
same.
It most certainly was the intent of the City
Council to appropriate this money from the unappropriated
moneys in the Current Expense Fund. This is the only
fund from which these moneys could be appropriated. It
is, therefore, my opinion that this sum may be properly
appropriated from the Current Expense Fund.
