For Meeting of: May 12, 2026 ITEM TITLE: Resolution authorizing Right of Way Use Permit Application RL260019 for Michelsen Packaging Co. at 922 N 1st Ave SUBMITTED BY: Robert Washabaugh, City Engineer SUMMARY EXPLANATION: Michael Pepper of Michelsen Packaging Company is requesting approval of a Right of Way use Permit application number RL260019, for the long-term closure of Quince St from N 1st Ave to the alley just east of N 4th Ave to allow for their exclusive use of Quince St to access their properties on the north and south sides of the street. The properties are located at 922 N 1st Ave and are in the M-1 Light Industrial zoning district. Engineering staff revied the application and recommends approval by the City Council. Right of Way Use permits are processed under the provisions of Chapter 8.20, which requires review by the code administration manager and final approval by the City council. The permit also requires lability insurance as prescribed in Section 8.20.060, which will be provided to the Office of Code Administration prior to issuance of any permit. Approved permits are valid for a period of one year, renewable annually. This allows the City an opportunity to review any public health/safety/welfare issues that may need to be addressed in subsequent years. R-2026- A RESOLUTION authorizing the issuance of a right-of-way use permit to allow Michelsen Packaging Co. truck traffic use on Quince Street between N. 4th Ave. and N. 1st Ave. WHEREAS, pursuant to Chapter 8.20 YMC, the City Council is authorized to issue permits for construction of certain improvements within public rights-of-way; and WHEREAS, Michael Pepper of Michelsen Packaging Co. is requesting a right-of- way use permit to allow the use for truck traffic on Quince Street between N. 4th Ave. and N. 1st Ave., in the public right-of-way to provide safe, accessible entry and exit for Michelsen Packaging Co.; and WHEREAS, city staff has recommended approval of such a permit, and that the application be reviewed by the full Council; and WHEREAS, the City Council, having considered such application and the recommendation of city staff, hereby finds and determines that issuance of the requested right-of-way use permit authorized pursuant to Chapter 8.20 YMC is in the best interest of the residents of the City of Yakima and the City, and will promote the general health, safety and welfare; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute and issue a right-of-way use permit in accordance with the provisions of Chapter 8.20 YMC and in conformity with the application for such permit submitted by Michael Pepper of Michelsen Packaging Co. by application dated March 25th, 2026, and designated as city Regulatory License No. RL260019 at 202 N. 2nd Avenue which shall include the following provisions: 1. Follow all requirements of YMC 8.20, including but not limited to, the insurance requirements; 2. The City may terminate the permit after having provided 30 days written notice to the applicant; 3. Upon termination of the permit, the applicant shall restore such right-of-way to the condition it was in prior to the installation of the work. ADOPTED BY THE CITY COUNCIL this 12th day of May, 2026. Alas-. 2 S; zoz6 MARCH 25,2026 REFERENCE NO.26017 28 NARRATIVE The proposal is a request for a Permanent Long-term Right-of-way License to exclusively use the approximate East 488 feet (legal description attached to application) of Quince Street between North First Street and North Fourth Street. The purpose of the request is to permit Michelsen Packaging Co. to move uninterrupted between two properties under their ownership. Currently, Michelsen Packaging Co. owns property on both the north and south sides of Quince Street at the above-described location. Assessor's Parcel Number 181313-42523 lies on the north side of Quince Street and contains Michelsen's primary processing plant. Assessor's Parcel Number 181313-42419 lies on the south side of Quince Street and is used as a storage yard for finished products from the primary processing plant and other related vehicle storage. Presently, both sides of Quince Street, as it abuts Michelsen's properties, are fenced with a 6- foot-high chain-link fence for security purposes. The two fences, along with the physical construction of Quince Street, prevent the ease of moving products directly from the north parcel to the south parcel and visa-versa. To move finished products from the processing plant to the storage yard, Michelsen has had to resort to a short off-site transportation link between the two properties using North First Avenue. The vehicles typically using the transportation link are semi-trucks and forklifts that move products from one parcel to the other. The transportation link is approximately 200 feet in length and entails these vehicles entering and leaving each site from driveways located in close proximity to the intersection of Quince Street and North First Avenue. Thus, there are forklifts and large semi-trucks making quick turns onto. and off of, North First Avenue in a very short distance. This situation is less than desirable, and it would be preferrable to be able to drive directly from the processing plant to the storage yard. To resolve the current situation, Michelsen Packaging Co. is requesting that a portion of Quince Street, as it abuts their two properties, be granted a Permanent Long-term Right-of-Way License to end the inefficient use of the two properties involved. The License would permit Michelsen Packaging Co. with an opportunity to exclusively use the approximate East 488 feet of Quince Street for additional storage and permit that section of street to be fenced and closed to the public. This would also allow the removal of the two fences lining both sides of Quince Street, thus permitting a direct route from the processing plant to the storage yard. This new situation would increase the flow of production on the site, along with improving traffic safety on North First Avenue, by removing much of the semi-truck and forklift traffic. The approximate Westerly 100 feet of Quince Street, that is not part of this request, will remain open. This short section of roadway serves three other parcels. Two of the parcels are located on the north side of the street and one parcel is located on the south side of the street. Access and public utilities to these three properties will not be changed ut altered. All three lots will continue to have access to Quince Street and to North Fourth Avenue. 'thus, this requested revision should have a low-impact on neighboring properties. Based on all the above factors.
