Commission Findings of Fact
April 22, 2026
In consideration of request for a Certificate of Appropriateness for alteration of
historic property located at 2810 Barge St #2.:

REQUEST
Certificate of Appropriateness request, for the construction of a detached accessory dwelling unit
(ADU) at a “contributing” single-family residence in the Barge-Chestnut Historic District.
FINDINGS

Background – On December 23, 2025, the applicant submitted a request to construct an accessory
dwelling unit (ADU) at a historic residence located at 2810 Barge St. The subject property is listed
as a ‘contributing property’ of the Barge-Chestnut Neighborhood Historic District. The home was
built in 1936 and is located on the South side of Barge Street, with the front of the home facing North.
The proposed ADU will be located on the Southwest side of the residence. An existing garage
structure will be removed.

Yakima Municipal Code, Chapter 11.62 Historic Preservation Ordinance
The City of Yakima Historic Preservation Ordinance for Special Valuation governs the review
of changes to Yakima Register of Historic Places and provides for the preservation, design
review and rehabilitation of eligible historic properties with the city of Yakima.
Review of Changes to Yakima Register of Historic Places Properties (Chapter
11.62.050)
After identifying the distinguishing historic characteristics of a property subject to the design
review process, retention and preservation of those features and materials are the primary
goals of the design review effort.
Review Required – No person shall make any material change affecting significant historic
features as listed in the designation form to any existing property on the Yakima Register of
Historic or contributing property within a historic district on the Yakima Register without
review by the commission and without receipt of a Certificate of Appropriateness as a result
of the review. The review shall apply to all features of the property that contribute to its
designation and are listed on the designation.
Requests for Review and Issuance of a Certificate of Appropriateness or Waiver.
In accordance with YMC § 11.62.050(2)(B)(6), the proposed addition is not exempt from
design review. This application requires a Type II Review by the Commission for issuance of
a Certificate of Appropriateness (YMC § 11.62.050(2)(C)(2). The Type II Commission review
decision shall be final and binding unless it is appealed to the Yakima City Council by the
aggrieved person, public agency or other legal entity.
Secretary of Interior’s Standards for Rehabilitation & Guidelines for Rehabilitating
Historic Buildings
The intent of the Standards is to assist the long-term preservation of a property’s significance
through the preservation of historic materials and features. The Standards pertain to
historic buildings of all materials, construction types, sizes, and occupancy and encompass
the exterior and interior of the buildings. Rehabilitation assumes that at least some repair
or alteration of the historic building will be needed in order to provide for an efficient
contemporary use; however, these repairs and alterations must not damage or destroy
materials, features or finishes that are important in defining the building’s historic character.
Approval Recommendations
The property meets the Standards for Rehabilitation as listed below:
1) A property will be used as it was historically or be given a new use that requires
minimal change to its distinctive materials, features, spaces and spatial relationships.
a. The historic use of the property as a residence will be maintained. The proposed
ADU will not have an impact on the historic nature of the property and is
essentially equivalent to the existing detached garage structure.

2) The historic character of a property will be retained and preserved. The removal of
distinctive materials or alteration of features, spaces and spatial relationships that
characterize a property will be avoided.
a. The submitted application does not indicate what type of materials are proposed
for the construction of the Accessory Dwelling Unit. The Yakima Municipal Code
requires (via YMC 15.09.045 (b)(4)) the exterior walls of any ADU to “be designed
so as to be similar in style, color, and building materials to the primary detached
dwelling.” With this, it can be determined that the proposed ADU will be similar
in character to the existing primary structure. The applicant provided an AI
rendering of what the project will look like when completed and the ADU
structure matches the primary structure in character in the submitted
rendering.
3) Each property will be recognized as a physical record of its time, place and use.
Changes that create a false sense of historical development, such as adding
conjectural features or elements from other historic properties, will not be
undertaken.
a. The property will remain as single family residence and the proposed ADU will
not remove any historic features or add conjectural features from other historic
properties.
4) Changes to a property that have acquired historic significance in their own right will
be retained and preserved.
a. An existing garage will be demolished to make room for the proposed ADU, but
the garage itself is not historically significant. This property is a contributing
property of the Barge Chestnut Historic Neighborhood, but is not listed on any
Yakima, State, or Historic Registers.
5) Distinctive materials, features, finishes, and construction techniques or examples of
craftsmanship that characterize a property will be preserved.
a. None of the existing architectural characteristics of the home (primary
structure) will be changed. The submitted application does not indicate what
type of materials are proposed for the construction of the Accessory Dwelling
Unit. The Yakima Municipal Code requires (via YMC 15.09.045 (b)(4)) the
exterior walls of any ADU to “be designed so as to be similar in style, color, and
building materials to the primary detached dwelling.” With this, it can be
determined that the proposed ADU will be similar in character to the existing
primary structure. Application materials indicate that the proposed structure
will match the character of the primary structure.
6) Deteriorated historic features will be repaired rather than replaced. Where the
severity of deterioration requires replacement of a distinctive feature, the new
feature will match the old in design, color, texture and, where possible, materials.
Replacement of missing features will be substantiated by documentary and physical
evidence.

a. Alterations will be aligned with historic preservation standards.
7) Chemical or physical treatments, if appropriate, will be undertaken using the gentlest
means possible. Treatments that cause damage to historic materials will not be used.

8) Archeological resources will be protected and preserved in place. If such resources
must be disturbed, mitigation measures will be undertaken.

9) New additions, exterior alterations, or related new construction will not destroy
historic materials, features, and spatial relationships that characterize the property.
The new work will be differentiated from the old and will be compatible with the
historic materials, features, size, scale and proportion, and massing to protect the
integrity of the property and its environment.
a. The submitted application does not indicate what type of materials are proposed
for the construction of the Accessory Dwelling Unit. The Applicant has provided
an AI generated image depicting the proposed ADU to be matching in character
to the primary structure. The Yakima Municipal Code requires (via YMC
15.09.045 (b)(4)) the exterior walls of any ADU to “be designed so as to be similar
in style, color, and building materials to the primary detached dwelling.” With
this, it can be determined that the proposed ADU will be similar in character to
the existing primary structure.
10) New additions and adjacent or related new construction will be undertaken in such a
manner that, if removed in the future, the essential form and integrity of the historic
property and its environment would be unimpaired.
a. The proposed ADU does not alter the existing structure of the residence in a
manner that would disrupt the historic integrity if removed.
Basis for Decision - Based upon a review of design review guidelines stipulated in YMC
11.62.050, Review of Changes to Yakima Register of Historic Properties, application and,
exhibits, testimony and other evidence presented at the open record public meeting by the
City’s Historic Preservation Commission on April 22, 2026; and a review of Secretary of
Interior’s Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings;
the Historic Preservation Commission makes the following:
CONCLUSIONS
1. The purpose of historic preservation design review guidelines is to preserve the
historic integrity of properties; contributing or non-contributing listed on the
Yakima Register of Historic Places.

2. The subject property is listed as a ‘Contributing property’ of the Barge-Chestnut
Neighborhood Historic District, but is not listed within any State, Local, or National
Historic Registers.
3. Secretary of Interior’s Standards for Rehabilitation of historic properties allows for
the rehabilitation of a historic structure which makes possible an efficient
contemporary use while preserving those portions and features of the property
which are significant to its historic, architectural, and cultural values.
4. Secretary of Interior’s Standards for Rehabilitation of historic properties
recommends that the size, scale, and massing of a new addition all pertain to the
addition’s overall volume and three-dimensional qualities. Taken together, size,
scale and massing are critical elements for ensuring that a new ADU is subordinate
to the historic building, thus preserving the historic character of a historic property.
5. The construction of the proposed ADU on the subject residence shall be done in a
manner that does not damage historic features or materials, and does not negatively
impact the surrounding historic district.
DECISION
The Historic Preservation Commission, following a review of the application by a majority
vote of its members, has determined that the request for the alteration will not adversely
affect historic significant features of the residence, or the Barge Chestnut Historic District,
and approves of the issuance of a Certificate of Appropriateness for the proposed Accessory
Dwelling Unit. The requested Type II for the historic residence located at 2810 Barge St., as
described above is APPROVED, and determined to be eligible for issuance of a Certificate of
Appropriateness, as set forth in YMC 11.62.050.

NOTICE OF RIGHT TO APPEAL
Type II Commission review decision shall be final and binding unless it is appealed to the
City of Yakima City Council by the aggrieved person, public agency or other legal entity in
accordance with YMC 11.62.050(4)(d). The appeal must be in writing on forms provided by
the Commission, and filed with the Clerk of the City of Yakima within fourteen (14) days of
the date of the decision. Appeal forms may be obtained from the Department of Community
Development.

1. Staff presents staff report of the proposal to the commission.
2. Commissioners discuss the design of the home and the placement of the addition, the
removal of historic windows, and design of the addition. Commissioner King notes that she
would like to see the original windows being reused in some way in the new addition.
3. Staff notes that the commission may not want to impose a requirement for the applicant to
reuse the windows in the new design as there may be a reason why they have not been
included in the design, and that the commission could instead ask them to reuse the windows
if possible without requiring the use.
4. The commission continues to discuss the proposal and staff answers several questions.
5. Commissioner Mann moves to approve the addition with a suggestion for the historic windows
to be reused or maintained in some way if possible. Commissioner King seconds. The vote
passes and the Certificate of Appropriateness is approved.
V. Adjournment
i. Commissioner King makes a motion to adjourn, Bussey seconds and the commission votes to
adjourn until January 28, 2026.

1. Staff discusses the proposal to replace the windows of the Union Pacific building
2. Commissioner Mann comments that he appreciates the investment the applicant is making in
the historic building by replacing these windows.
3. Commissioner Bussey asks if the windows are listed within the historic registration of the
building and discusses that the proposed windows are proposed to match the exact layout of
the existing historic windows.
4. Commissioner Mann moves to approve the Certificate of Appropriateness, Edmonson
seconds. The commission votes and approves the Certificate of Appropriateness for 104 W.
Yakima Ave.
ii. 2810 Barge Street – Accessory Dwelling Unit
1. Staff introduces the next item, a Certificate of Appropriateness for the construction of an
Accessory Dwelling Unit (ADU) at 2810 Barge Street. Staff informs that the proposed ADU will
take the place of an existing garage structure, and indicates that application materials were
limited.
2. Staff reviews the submitted site plan and staff report with the commission.
3. Staff recommends approval based on the requirements of the Yakima Municipal Code, but
reiterates that application materials are limited and the commission can request further
materials before making a decision.
4. Commissioner Mann asks if the applicant indicated that the ADU structure would be built with
a brick fascia. Staff responds that they did not make any indication of what building materials
would be used and that the application packet that was submitted was incomplete.
5. Staff explains that the recommendation to approve was not based on application materials but
was rather based on the requirements of the Yakima Municipal Code (15.09.045(b)(4)).

6. The commission discusses the Yakima Municipal Code and Accessory Dwelling Units with
staff.
7. Commissioner Bussey asks if the garage on the property is considered historic as well and
discusses this with staff. The property itself is considered a contributing property and no
specific structure on this property is listed on a historic register.
8. Commissioner Mann asks if it would be okay to push the item back one more month to collect
additional information before making a decision. Staff indicates doing so would be okay.
9. Commissioners discuss pushing the item back for more information or approving the item as
submitted.
10. Commissioner Edmonson notes a date error within the staff report.
11. Commissioner Edmonson moves to approve the certificate of appropriateness. Commissioner
Mann seconds the motion. The commission votes to approve the Certificate of
Appropriateness for 2810 Barge Street.

1. Staff introduces the Certificate of Appropriateness item which is a proposal to re-roof the historic H.M.
Gilbert house. Staff recommends to approve the item.
2. Commissioner Bussey notes that conclusion #4 in the staff report should be stricken from the staff report
as it was left in the report by mistake.
3. Commissioner Edmonson moves to approve the certificate of appropriateness, Commissioner King
seconds, the commission votes to approve the certificate of appropriateness to re-roof the H.M. Gilbert
home at 2019 W. Yakima Ave.
V. New Business Staff Liaison
i. Review Naches Ave Overlay Draft
1. Staff presents a draft of the Naches Avenue Historic Overlay Zone to the commission.
2. Staff discusses the presentation with the commission and answers questions.
3. Staff discusses edits and changes to the draft with the commission.
4. Commissioner Mann moves to approve the draft and direct staff to move forward with presenting the
draft code to the Yakima Planning Commission with the edits discussed during the meeting,
Commissioner Edmonson seconds, the commission votes unanimously to approve this motion.

i. Commissioner King motions to adjourn, Commissioner Mann seconds, the commission votes to adjourn to
the March 25, 2026 meeting.
