E+Y ORDINANCII ORDINANCE NO. ______ AN ORDINANCE relating to vacations, sick leave, civil leave, military leave, establishing rules and regulatione on time off, establishing holidays and the basic work week for all employees of the City of Yakima except Firemen, and repealing all resolutions, ordinances or parts of ordinances in conflict here- with. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That all officers and regular permanent employees of the City of Yakima except Firemen shall be granted time off privileges as follows: VACATION LEAVE (a) Each employee regularly employed continuously for twelve months or longer, working five days each week, shall be entitled to an annual vacation with full pay at the rate of five- ! sixths of a working day of vacation for each full month's work during tcle preceding year (b) Each employee regularly employed continuously for five years or longer shall be entitled to an annual vacation with full pay at the rate of one working day of vacation for each full month's work during the preceding year© (c) Each employee regularly employed continuously for ten years or longer shall be entitled to an annual vacation with full pay at the rate of one and one-fourth working day of vacation for each full month's work during the preceding year (d) Vacation leave may be accumulated up to twenty-four working days. Any continuous vacation leave taken by an employee • in excess of two calendar weeks during any calendaryear shall be recommended by the department head and approved by the appointing authority. It i� intended that each employee shall take a relaxing vacation cf not less than two calendar weeks after the first year. A vacation of less than two weeks is not considered, of value to the employee for the purpose of relaxing. The extra days allowed to accumulate over two weeks are for the benefit of the employee in being able to meet emergencies and take care of family matters without the lose of pay when his regular vacation time is exhausted* It also mates it possible for the employee with proper approval to make a longer trip than would be possible in two weeks. Annual leave must be taken at such time as the employee can be spared, but an employee will be allowed to take his leave when he desires if at all possible to schedule it at that time. If an employee is scheduled to take his vacation and declines to do so, the vacation time is forfeited. If working conditions and emer- gency make it necessary that he not take his vacation for the good of the service, vacation time shall be carried forward into the next year and taken as quickly as possible in the new year or added to the vacation accumulation with proper approval of the department head and the appointing authority. On separation from the service all accumulated accrued vacation leave shall be allowed. SICK LEAVE (a) Sick leave with pay shall accrue at the rate of one working day of leave for each full calendar month of the employee continuous service with the City to commence at the end of one 411 - 2 - • month of employee`o service. Unused sick leave in any year ,hall be accumulative for succeeding years to a maximum of sixty wor ing days. Employees who are granted a leave of absence with pay for any purpose shall continue to accrue sick leave at the regular prescribed rate during such absence. (b) An employee eligible for sick leave with pay shall be granted, such leave for the following reasons: (1) . Personal illness or physical incapacity re ul Ling from causes beyond employees control; (2) Forced quarantine of the employee in accordance with community health requirements; or (3) The death of a member of the employees immediate family. Any allowance of over three days for family death must be • recommended by the department head and approved by the appointing authority. For purposes of this sub - paragraph, the term "immediate family shall mean any husband, wife, parent, grandparent, child, grandchild, brother or sister„ (c) An employee needing sick leave shall inform his imme- diate superior of the fact as far in advance of the starting of his shift as possible giving the reason therefore and an estimate of the length of his probable absence. (d) Employees returning from three or more days of sick leave must file a written release from their doctor stating they are able to return to their regular work on a full -time basis. In cases of prolonged illness or injury, an examination may be ordered, by a qualified physician chosen by the City (o) Any failure to give proper notice or.file a physician's 411 certificate as required, may be cause for denial of sick leave with pay for the period of absoncee (f) Any employee receiving sick leave with pay who simultaneously receives compensation under the Workmen Compen- sation'Law, shall receive for the duration of such compensation only that portion of his regular salary which, together with said compensation, will his regular salary. (g) Absence for a fraction or part of a day that is chargeable to sick leave in accordance with these provisions, shall be charged proportionately in an amount not less than one day. (h) An employee who is laid off fron his position for reasons that are not discreditable to him, may, if reappointed within twelve months available for his necessary use any accrued leave existing at the time of his layoff. (1) When an is transferred to another position any unused sick leave which may have accumulated to his credit shall continue to be available for his use as necessary. (j) At the option of the employee, sickness in excess of the maximum number, of days accrued may be charged to unused vacation. (k) Abuse of the sick leave privilege: Sick leave is intended to protect the employees income when, through illness or death in the family, he cannot do so himself. The taking of time off for purpeses-other than those heretofore set forth or time for illness caused by Self abuse, may result in proper disciplinary ,action. 4 • • (1) On separation from the service, leave is forfeited. CIVIL LEAVE (a) Any necessary leave may be allowed by the head of the department to permit any employee to serve as a member of the jury, or to exercise his other civil duties, Each employee who is granted such leme, and who, for the performance of the civil duties involved, received any compensation, shall be paid by the City for the time he is absent only in the amount of excess of his regular salary over the compensation so received. MILITARY LEAVE (a) Leave not to exceed fifteen (15) days during each calendar year over and above annual vacation or sick leave, may be allowed any employee who is a member of the National Guard or • of any organized reserve or arced forces of the United States. The employee will be paid his normal pay during such military leave period when 'taking part in active training duty. GENERAL (a) No leave without pay will be granted an employee until the employee has first taken advantage of all his usable earned vacation credits, and such leave will not be granted for the purpose of the employee gaining personal advantage or profit. - �5 III , • 41 1 (b) Unauthorized absence from duty for three consecutive days shall constitute grounds for dismissal at the discretion of the City Manager, subject to Civil Service Rules and Regulations. ELIGIBLE ETTPLOY (a) These previsions regarding time off privileges do not apply to employees on temporary work or employees during the pro- bationary period or occupying positions provisionally. (b) The provisions regarding vacation leave, sick leave and time off privileges shall not in any way reduce or alter the benefits and provisions relating thereto.provided for by the Policemen Relief and. Pension System, or by any laws of the State of Washington now in effect or to be adopted hereafter. WpRTOFABSENCES (a) It shall be the duty of each department head to see that the sick leave request form is properly filled out and sub- . mitted. The filing of this form is mandatory and the form should be routed to the Personnel Director by way of the Director of Finance. HOLIDAYS -------- (a) The following days are hereby established as holidays with pay for all employees of the City of Yakima except for members of the Fire Department: New Year's Day Washington's Birthday, Memorial Day, '4th c) July (Independence Day), Labor Day, Veterans® Day, Thanks- . giving Day and. Christmas Day. • . . (b) Whenever any of said holidays falls upon a Sunday the following Monday shall be a holiday. (c) All offices of the City of Yakima except the Police and Fire Departments and such offices as are required to be on an emergency basis shall be closed upon said holidays. (d) When hourly employees other than those working on jobs where employees are scheduled to work in shifts in a service that is rendered seven daye per week and 24 hours per day, are required to work on a holiday, they shall be paid for such work at the rate of time and a half in addition to their regular pay. (e) In the event that a holiday occurs during the period of annual leave of an employee, such holiday shall not be included within said annual leave and the employee shall receive an additional day of leave therefor. (f) No employee shall be paid for a holiday unless such employee is in pay status both the day before and the day after such holiday. (g) Equal time off shall be scheduled by the department head for the Police Department; other departments required to z -ake:srtrender service 24 hours each day, except the Fire Department; T , -4,4541.1 tl-V regular monthly employees, excluding department and division ! a ka, 4 ' heads. (h) In the event that a holiday falls on an employee's regular day off, other than a Saturday or equivalent day, the employee shall have equal time off to be scheduled within 90 days. aFiiir.NDED Fav 01101NANCT. NO.-/-(44 WORJCWEEK (a) The basic work week shall be forty hours with the exception of the Fire Department some few jobs which require special consideration by mutual agreement. The standard work day shall be eight hours. For those employees ea an hourly basis, overtime will be allowed when required to work, at the rate of one time and one-half. Employees paid on the monthly basis ll not be allowed overtime, but if assigned specifically to overtime work outside the scope of their regularly assigned duties, com- pensutory time off may be allowed. Al]. credit for compensatory time must be allowed by the department head and his approval must be obtained before taking said compensatory time off. Compen- satory time will not normally be allowed for an employee doing • his regular assigned duties. Section 2. All resolutions, ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3.
