For Meeting of: April 14, 2026 ITEM TITLE: Closed record public hearing and Resolution to consider an appeal of a Certificate of Appropriateness for property at 2810 Barge Street SUBMITTED BY: *Connor Kennedy, Associate Planner Trevor Martin, Planning Manager SUMMARY EXPLANATION: The City of Yakima is appealing a decision by the Historic Preservation Commission (HPC). The decision was made in error due to an incomplete application. To correct this, City Council must grant the appeal and remand the application back to the HPC. The attached resolution completes this action. Further detail. On December 29, 2025, the applicant submitted a Certificate of Appropriateness application (HPR#0065€`25) that was incomplete, lacking clear photographs of existing conditions, a description of the proposed scope of work, and samples of replacement materials, all items required by the City's application checklist and despite the applications known deficiencies, City staff presented the item to the HPC out of consideration for the property owners project timeline, informing the Commission of the deficiencies and suggesting that additional information could be requested prior to making a decision. Due to the lack of required application materials, an image of a neighboring property was mistakenly presented to the HPC as the subject property, resulting in a review based on incorrect materials and a decision was made without a full analysis. The City of Yakima Planning Division filed a timely Land Use Appeal Application on February 5, 2026, identifying the action being appealed as the HPCs approval of the Certificate of Appropriateness for the ADU at 2810 Barge Street. Adopting the resolution appealing the previous Historic Preservation Commission determination will remand the application back to the Historic Preservation Commission, allowing the Commission to correct the record and issue a revised determination. R-2026- A RESOLUTION of the city council of the city of Yakima, Washington, granting the City's appeal and remanding the historic preservation commission's Type II decision approving a certificate of appropriateness (HPR#006-25) for a detached accessory dwelling unit at 2810 Barge Street for further proceedings. WHEREAS, on August 21, 2025, permit applications were submitted to the City of Yakima Codes and Planning Divisions by King Builders Group LLC on behalf of the property owner, Tina Smith, for the proposed construction of an accessory dwelling unit (ADU) at 2810 Barge Street (Parcel No. 181323-32543) within the Barge-Chestnut Historic District; and WHEREAS, on December 29, 2025, the applicant submitted a Certificate of Appropriateness application (HPR#006-25) that was incomplete, lacking clear photographs of existing conditions, a description of the proposed scope of work, and samples of replacement materials, all items required by the City's application checklist; and WHEREAS, despite the application's known deficiencies, City staff presented the item to the Historic Preservation Commission (HPC) out of consideration for the property owner's project timeline, informing the Commission of the deficiencies and suggesting that additional information could be requested prior to making a decision; and WHEREAS, due to the lack of required application materials, an image of a neighboring property was mistakenly presented to the HPC as the subject property, resulting in a review based on incorrect materials and a decision was made without a full analysis; and WHEREAS, the City of Yakima Planning Division filed a timely Land Use Appeal Application on February 5, 2026, identifying the action being appealed as the HPC's approval of the Certificate of Appropriateness for the ADU at 2810 Barge Street: and WHEREAS, based on the record and statements from the City of Yakima Planning Division, the City Council finds it is appropriate to remand the matter back to the Historic Preservation Commission for a decision taking into account corrected photographs and information now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Appeal. The City Council hereby grants the appeal filed by the City of Yakima Planning Division, finds that the Historic Preservation Commission's approval of Certificate of Appropriateness HPR#006-25 was made upon incomplete application materials and was affected by error under YMC § 11.62.050 and related design review provisions, and vacates the decision approving the design of the ADU as described in the Staff Report and decision record. Section 2. Remand to the Historic Preservation Commission. This matter is remanded to the Historic Preservation Commission for a new hearing and decision consistent with the following directives: A. Completeness. Prior to any hearing, the applicant shall submit a complete application; and 1 11 B. Correction of the Record. City staff shall ensure the record excludes any misidentified photographs or exhibits and shall present corrected exhibits of the subject property to the HPC; and C. Findings. The HPC shall evaluate the ADU under the Secretary of the Interior's Standards for Rehabilitation and YMC § 11.62.050, making specific findings on compatibility D. Notice. The HPC shall follow all applicable public meeting and notice requirements for a remanded Type II review and shall issue written findings and conclusions supported by record. Section 3. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this resolution is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this resolution.
