amending the definition of Dwelling, multiple -family within Yakima
Municipal Code Title 15 Urban Area Zoning Ordinance Ch.15.02
Definitions to permit new housing types such as tiny homes and
efficiency units within the City of Yakima.
WHEREAS, the Planning Commission of the City of Yakima has considered an
amendment to Title 15 Urban Area Zoning Ordinance Ch.15.02 Definitions of the
Yakima Municipal Code which would allow new housing types such as tiny homes and
efficiency units within the City of Yakima as multiple -family housing; and
WHEREAS, the Planning Commission has held a public meeting on the
proposed amendments on February 22, 2017; and
WHEREAS, the Planning Commission held an open record public hearing on
March 8, 2017, pursuant to notice and has received and considered all evidence and
testimony presented; and
WHEREAS, the Planning Commission, having conducted such public hearing,
found, determined, and recommended that the City Council approve such amendment;
and
WHEREAS, the City Council held a public hearing on April 18, 2017 pursuant to
notice to consider such amendments as recommended by the Planning Commission;
and
WHEREAS, the City Council of the City of Yakima, having considered the record
herein and the recommendation from the Planning Commission, hereby finds and
determines that approval of such amendment is in the best interests of residents of the
City of Yakima and will promote the general health, safety and welfare; therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The definition of "dwelling, multiple -family" located in Chapter
15.02 Definitions of the Yakima Municipal Code is hereby amended to read as follows:
"Dwelling, multiple -family" means a structure or structures, or portion thereof, designed
for occupancy by three or more families living independently of each other and
containing three or more attached dwelling units on a lot. Multiple -family and detached
single-family dwellings that are clustering around a common amenity such as open
space, recreation facilities or common community building, and have a common
driveway access on a single lot of record are also considered multiple -family
development.
Section 2. Adoption of Planning Commission Findings. The findings
within the March 8, 2017, Yakima Planning Commission's Recommendation, regarding
this proposed text amendment is hereby adopted by the Yakima City Council as its
findings in support thereof pursuant to YMC § 15.23.020, and are incorporated herein by
this reference as if fully set forth herein.
Section 3. Validity. If any section, subsection, paragraph, sentence, clause
or phrase of this ordinance is declared invalid or unconstitutional for any reason, such
decision shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ratification. Any act consistent with the authority, and prior to the
effective date of this ordinance is hereby ratified and affirmed.
Section 5. Authorization to File. The City Clerk is hereby authorized and
directed to file a certified copy of this ordinance with the Yakima County Auditor.
Section 6. Effective Date. This ordinance shall be in full force and effect 30
days after its passage, approval, and publication as provided by law and by the City
Charter.

SUMMARY EXPLANATION:
On March 8, 2017, the City of Yakima Planning Commission held an open record public hearing
to consider a text amendment to modify the definition of "dwelling, multiple -family" within the
City's Urban Area Zoning Ordinance to allow alternate forms of housing such as tiny
homes/efficiency units as multi -family residential development, which is clustered around a
common open space or a community building within the City of Yakima.
In accordance with YMC 16.10.080, on March 21, 2017, the City of Yakima Planning
Commission forwarded its recommendation to the Yakima City Council regarding the proposed
text amendment. Now therefore in accordance with YMC 16.10.090, the Yakima City Council is
requested to consider the Planning Commission's recommendation on this matter during a public
hearing.

March 8, 2017
WHEREAS
The City of Yakima last amended its Title 15 Urban Area Zoning Ordinance on December 6,
2016; and
WHEREAS
Proposals to amend the City of Yakima's Urban Area Zoning Ordinance, follow the City's
established process in YMC § 15.23.020(B) and YMC Title 16; and
WHEREAS
Pursuant to RCW 36.70A.130(1) the City is required to take legislative action to review and
revise its development regulations in accordance with the Growth Management Act; and
WHEREAS
Under the provisions of YMC 1.42 the Yakima Planning Commission is responsible for the
review of amendments to the City's Yakima Urban Area Zoning Ordinance, and for
recommending the approval, modification, or denial of each amendment; and
WHEREAS
On February 22, 2017, the Yakima Planning Commission held a study session to review the
proposed text amendment and held an open record public hearing on March 8, 2017; and
WHEREAS
At its March 8, 2017 public hearing, the Yakima Planning Commission heard the staff
presentation regarding the proposed text amendment to YMC Title 15, took public testimony,
and recommended approval of the proposed amendment and accompanying ordinance; and
WHEREAS
All required public notice for these amendments were provided in accordance with the
provisions of YMC § 15.11.090, and YMC §§ 16.05.010 — 050; and
WHEREAS
This project was determined to be categorically exempt from review under the State
Environmental Policy Act because it falls below the City of Yakima's flexible threshold for SEPA,

as established in WAC 197-11-800 (19), as this text amendment will result in no substantive
changes to use or modification of the environment; and
WHEREAS
The recommendation for this Text Amendment is based upon the criteria specified in YMC §
16.10.040; and
WHEREAS
The Yakima Planning Commission concluded its consideration of this amendment on March 8,
2017.
Now therefore, the Yakima City Planning Commission presents the following findings
and recommendation to the Yakima City Council:
Based upon a review of the information contained in the application, staff report, exhibits,
testimony and other evidence presented at an open record public hearing held on March 8,
2017, the Planning Commission makes the following:
PURPOSE AND DESCRIPTION OF PROPOSED AMENDMENT:
The purpose of the proposed amendment is to modify the definition of "dwelling, multiple -family"
within the City's Urban Area Zoning Ordinance to allow alternate forms of housing such as tiny
homes/efficiency units as multi -family residential development, which is clustered around a
common open space or a community building within the City of Yakima.
Proposed Amendment:
"Dwelling, multiple -family" means a structure or structures, or portion thereof, designed for
occupancy by three or more families living independently of each other and containing three or
more attached dwelling units on a lot. Multiple -family and detached single-farnilv dwellings that
are clustering around a common amenity such as open space, recreation facilities or common
community building, and have a common driveway access on a single lot of record are also
considered multiple -family development.
FINDINGS OF FACT
1. The Planning Commission held a study session on the proposed text amendment on
February 22, 2017.
2. The commission found that the amendment to YMC Title 15 will:
a. Serve as the first step to allow tiny homes/efficiency units as a primary or secondary
housing type within the City of Yakima;
b. Allow the combination of single and multi -family dwellings to be considered as multi-
family development;
c. Provides for a broad distribution of housing in Yakima that meets the affordability and
neighborhood design needs of the public; and
d. Encourages diverse and affordable housing choices within the City of Yakima.
3. The proposed amendment is categorically exempt from review under the State
Environmental Policy Act because it falls below the City of Yakima's flexible threshold for

SEPA, as established in WAC 197-11-800 (19), as this text amendment results in no
substantive changes to use or modification of the environment.
4. Public notice was provided in accordance with YMC § 16.05.050, with a Notice of Public
Hearing and Legal Ad Publication in the Yakima Herald newspaper on February 8, 2017.
5. On March 8, 2017, the Yakima Planning Commission held its public hearing on the text
amendment to YMC Titles 15 and voted unanimously to recommend approval of the
proposed amendment and accompanying ordinance to the Yakima City Council.
YAKIMA PLANNING COMMISSION'S CONCLUSIONS
1. The text amendments are minor in nature;
2. No adverse impacts have been identified by the approval of the amendment request;
3. The proposed text amendment is exempt from Environmental Review;
4. The requested text amendment is supported by the City of Yakima's Comprehensive
Plan 2025 and draft 2040 Comprehensive Plan;
5. The amendment will serve as the first step to allow tiny homes/efficiency units as a
primary or secondary housing type within the City of Yakima, and allow the combination
of single and multi -family dwellings to be considered as multi -family development;
6. Provide for a broad distribution of housing in Yakima that meets the affordability and
neighborhood design needs of the public; and
7. Encourages diverse and affordable housing choices within the City of Yakima.
MOTION
Based upon the analysis, findings and conclusions outlined above, it was moved and seconded
that the Yakima Planning Commission recommend APPROVAL of this text amendment to the
Yakima Municipal Code (YMC) Title 15.
Having made the above Findings of Fact and Conclusions, the Planning Commission hereby
renders its
RECOMMENDATION TO CITY COUNCIL
The Planning Commission of the City of Yakima, having received and considered all evidence
and testimony presented at the public hearing, and having received and reviewed the record
herein, hereby recommends that the City Council of the City of Yakima APPROVE the zoning
Text Amendment application (TXT #002-17), and forwards the proposed ordinance to the
Yakima City Council.

ISSUE:
Yakima Planning Commission (YPC) consideration and public hearing of an amendment
to the City of Yakima's Municipal Code Title 15 Urban Area Zoning Ordinance to
accommodate alternate forms of housing as multi -family development.
STAFF RECOMMENDATION:
The City of Yakima Planning Division recommends that the YPC hold the required public
hearing, take public input, revise the draft amendment as necessary, and forward the
Planning Commission's recommendation to the Yakima City Council for further
consideration.
PURPOSE AND DESCRIPTION OF PROPOSED AMENDMENT:
The purpose of the proposed amendment is to modify the definition of "dwelling,
multiple -family" within the City's Urban Area Zoning Ordinance to allow alternate forms
of housing such as tiny homes/efficiency units as multi -family residential development,
which is clustered around a common open space or a community building within the City
of Yakima.

in regard to its impact on existing or proposed land uses, will serve as the first step to
allow tiny homes/efficiency units as a primary or secondary housing type within the City
of Yakima, as well as allowing the combination of single and multi -family dwellings to be
considered as multi -family development. In addition, the amendment will also allow for

increased density in residential zoning districts as emphasized and required by the State
of Washington and is fully supported by the City's draft 2040 Comprehensive Plan.
CITY OF YAKIMA 2025 COMPREHENSIVE PLAN GOALS AND POLICIES, WHICH
SUPPORT TINY HOMES/EFFICIENCY UNITS:
Land Use Element:
Goal 3.1: Provide for a broad distribution of housing in Yakima that meets the
affordability and neighborhood design needs of the public.
Policy 3.1.1.1: Development shall be at an overall density of 12 dwellings units per acre
or more. Recommended zones: Two -Family Residential (R-2) and Multi -Family
Residential (R-3), Professional Business District (B-1), and Central Business District
(CBD).
Policy 3.1.1.2: Permitted housing types include townhouses, condominium, multi -family
and manufactured housing.
Policy 3.1.2.2: Residential PD allows new development to provide a mixture of housing
sizes and prices and to provide incentives for developers to include affordable units in
higher cost developments
Goal 5.1: Encourage diverse and affordable housing choices.
Policy 5.1.3: Encourage affordable housing development.
Policy 5.1.4: Encourage a range of affordable homeownership options.
Policy 5.1.5: Encourage the provision of fair share housing opportunities to all economic
segments and mixed uses for infill developments.
Policy 5.1.7: Encourage good faith efforts that the City of Yakima and other local
governments not impose regulations that may constitute barriers to affordable housing
availability, and appropriate compatible residential densities.
Policy 5.1.8: Support programs to improve existing housing stock.
Goal 5.3: Adopt or revise the City's development standards to increase housing
opportunities.
Policy 5.3.1: Review of existing zoning regulations and consideration of innovative
standards that will encourage construction of affordable housing and encourage the
participation of neighborhood associations and the development community in this
process.
Policy 5.3.1: Facilitate small lot sizes, condominiums, clustering and other options that
increase the supply of affordable homeownership options.
Policy 5.3.3: Assist, when allowable, the conversion of accessory buildings into housing
units as a means to increase the supply of affordable housing units and to help existing
homeowners remain in their homes.
Goal 5.4 Participate in efforts to maximize the land available for affordable housing in the
community.

A. Accessory Dwelling Units (ADU). Allow for attached and detached ADU's
in all residential districts provided size, design, and other provisions are
included to promote compatibility with surrounding uses.
D. Cottage Housing. Allow the development of cottage housing (a cluster of
small homes around a common open space) in residential zones,
provided special design provisions are included to ensure a pedestrian -
oriented design, inclusion of common open space, and strict cottage size
limitations.
F. Townhouses. Encourage the development of townhouses in the R-2 and
R-3 zones and commercial/mixed-use zones as an efficient form of
housing. Allow for attached and detached townhouses in all residential
districts provided size, design, and other provisions are included to
promote compatibility with surrounding uses. Additional considerations
may include: Design standards should emphasize pedestrian -oriented
design, facade articulation, and usable open space.
Policy 1.3.7. — Explore the development of zoning incentives to help meet the housing
diversity and affordability goals.
Examples could include residential density bonuses, variations in allowed housing type,
or flexibility in regulations, if a proposal meets community goals for affordable, senior,
size -limited or other types of innovative housing. If not permitted outright or through
discretionary review processes, consider providing these incentives through pilot
programs or other innovative measures.

CONCLUSIONS
1. The amendment to YMC Title 15 is minor in nature, but will serve as the first step
to allow tiny homes/efficiency units as a primary or secondary housing type within
the City of Yakima, and allow the combination of single and multi -family dwellings
to be considered as multi -family development.
2. No adverse impacts have been identified by the approval of this amendment
request as the change results in no substantive changes to use or the environment.
3. The requested text amendment to the City of Yakima's Zoning is supported by the
City's Yakima Urban Area Comprehensive Plan 2025 and draft 2040
Comprehensive Plan.
4. The amendment will serve as the first step to allow tiny homes/efficiency units as
a primary or secondary housing type within the City of Yakima, and allow the
combination of single and multi -family dwellings to be considered as multi -family
development;
5. Provide for a broad distribution of housing in Yakima that meets the affordability
and neighborhood design needs of the public; and

RECOMMENDATIONS
The Department of Community Development recommends APPROVAL of this text
amendment request.

Based on the testimony and evidence presented during this afternoon's public hearing, I
move that the Planning Commission adopt the findings of fact and order that the draft
ordinance dated March 8, 2017, be forwarded to the Yakima City Council with a
recommendation for approval.
Approval with modifications:
Based on the testimony and evidence presented during this afternoon's public hearing, I
move that the City of Yakima Planning staff modify the findings of fact and draft
ordinance dated March 8, 2017, to include the changes noted in the minutes of this
afternoon's public hearing, and with these changes move that the Planning Commission
approve the modified findings and ordinance, and order that the modified draft ordinance
be forwarded to the Yakima City Council with a recommendation for approval.

Re: Consideration of Amendments to the Definition of Multi -Family Residential
Over the past three to four years,there has been a growing movement throughout
the State af Washington to allow alternate forms of housing such as tiny
homes/efficiency units. As a result, some communities have permitted tiny
homes/efficiency units in both their Single and Multi -Family zoning districts, both
permitting them as single-family homes on individual lots of record, or as multi -family
dwelling units that are clustered around a common open space or a community
building. As the City of Yakima is presently in the process of updating its
Comprehensive PIan, it has come to the Planning Ivision's attention that the City's
current definition of Multi -Family Residential development ("Dwelling, multiple -family"
means a structure or structures, or portion thereof, designed for occupancy by three
or more families living independently of each other and containing three or more
attached dwelhng units on a lot.) has not kept pace with the changing trends in
housing choices, and at present would not allow tiny homes/efficiency units as multi-
family development. The main issue is that multi -family dwellings have to be
attached units under the City's current definition.
As the State of Washington has emphasized and required that cities allow for
accessory dwelling units, increased density in residential zoning districts, and
because the City's draft 2040 Comprehensive Plan supports these new forms of
housing, the Planning Division requests that the City Planning Commission consider
the following zoning amendments, which would allow this new form of housing.

also considered multiple -family development
This option would allcw tiny hounits, but would require a more
refined site plan wilh shared amenities and access.
Staff Recommendation: The City Planning Division recommends option #2 as
this amendment will:
1) AIIow tiny homes/efficiency units as multi -family development in the Two
Family Residential zoning district as a Type (2) or (3) Review dependent upon
the density of the development;
2) Allow the use as a Type (1) Review in the Multi -Family zoning district;
3) Prohibitthe use in the Suburban Residential and Single-Familyzoning
districts;
4) Ensure that multi -family developments composed of this alternative housing
type contain the required amenities to ensure that they are operated similar to
that of an apartment complex, and not as indeperdent single-family homes; and
5) Minimize amendments to other definitions within the Urban Area Zoning
Ordinance.

PROJECT DESCRIPTION
The City of Yakima Planning Division is proposing a minor amendment to the City of Yakima's
Municipal Code Title 15 definition of "dwelling, multiple -family" to allow multi -family and
detached single-family dwellings that are clustered around a common amenity such as open
space, recreational facilities or common community building that have a common driveway
access on a single lot of record to be considered as multiple -family development.
REQUEST FOR WRITTEN COMMENTS
The public is encouraged to review and comment on the proposed application. Written
comments may be submitted prior to the public hearing scheduled for March 8, 2017 or at the

NOTICE OF PUBLIC HEARING
This application will require two public hearings; one before the City of Yakima Planning
Commission to be followed by a public hearing before the Yakima City Council. The public
hearing before the City of Yakima Planning Commission has been scheduled for Wednesday
March 8, 2017, beginning at 3:00 p.m., in the Council Chambers, City Hall, 129 N 2nd Street,
Yakima, WA. Any person desiring to express their views on this matter is invited to attend the
public hearing or to submit their written comments to: City of Yakima, Planning Division, 129 N
2nd St., Yakima, WA 98901. A separate public notice will be provided for the public
hearing before the Yakima City Council.

AN ORDINANCE amending the definition of Dwelling, multiple -family within Yakima
Municipal Code Title 15 Urban Area Zoning Ordinance Ch.15.02
Definitions to permit new housing types such as tiny homes and
efficiency units within the City of Yakima.
WHEREAS, the Planning Commission of the City of Yakima has considered an
amendment to Title 15 Urban Area Zoning Ordinance Ch.15.02 Definitions of the Yakima
Municipal Code which would allow new housing types such as tiny homes and efficiency units
within the City of Yakima as multiple -family housing; and
WHEREAS, the Planning Commission has held a public meeting on the proposed
amendments on February 22, 2017; and
WHEREAS, the Planning Commission held an open record public hearing on March 8,
2017, pursuant to notice and has received and considered all evidence and testimony
presented; and
WHEREAS, the Planning Commission, having conducted such public hearing, found,
determined, and recommended that the City Council approve such amendment; and
WHEREAS, the City Council held a closed record hearing on April _, 2017 pursuant
to notice to consider such amendments as recommended by the Planning Commission; and
WHEREAS, the City Council of the City of Yakima, having considered the record herein
and the recommendation from the Planning Commission, hereby finds and determines that
approval of such amendment is in the best interests of residents of the City of Yakima and will
promote the general health, safety and welfare; therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The definition of "dwelling, multiple -family" located in Chapter 15.02
Definitions of the Yakima Municipal Code is hereby amended to read as follows:
"Dwelling, multiple -family" means a structure or structures, or portion thereof, designed for
occupancy by three or more families living independently of each other and containing three or
more attached dwelling units on a lot. Multiple -family and detached single-family dwellings that
are clustering around a common amenity such as open space. recreation facilities or common
community building, and have a common driveway access on a single lot of record are also
considered multiple -family development
Section 2. Adoption of Planning Commission Findings., The findings within
the March 8, 2017, Yakima Planning Commission's Recommendation, regarding this proposed
text amendment is hereby adopted by the Yakima City Council as its findings in support thereof
pursuant to YMC § 15.23.020, and are incorporated herein by this reference as if fully set forth
herein.

Section 3. Validity. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ratification. Any act consistent with the authority, and prior to the
effective date of this ordinance is hereby ratified and affirmed.
Section 5. Authorization to File. The City Clerk is hereby authorized and directed to
file a certified copy of this ordinance with the Yakima County Auditor.
Section 6. Effective Date. This ordinance shall be in full force and effect 30 days
after its passage, approval, and publication as provided by law and by the City Charter.
