AGENDA STATEMENT

ITEM TITLE: Resolution approving an agreement with the Yakima Herald-Republic
for legal advertising services

SUMMARY EXPLANATION:
Pursuant to Yakima Municipal Code Chapter 1.75, the City Council shall award the contract for legal
advertising annually on the third Tuesday in February. The Yakima Herald-Republic is the only legal
newspaper of general circulation within the City of Yakima as posted by the Clerk of the Yakima County
Superior Court; therefore, in order to secure the continuation of legal newspaper services, the attached
agreement is being proposed. The City finds and determines that approval of the agreement is in the
best interests of residents and will promote the general health, safety and welfare.

RESOLUTION NO. R-2026-
A RESOLUTION approving an annual agreement with the Yakima Herald-Republic for
legal advertising services.
WHEREAS, Chapter 1.75 YMC provides for the annual bid and execution of an
agreement for legal newspaper services for the City of Yakima (City), unless there is only
one qualifying legal newspaper of general circulation within the City as set forth in YMC
1.75.050; and
WHEREAS, the Yakima Herald-Republic is the only legal newspaper of general
circulation within the City of Yakima certified by the Clerk of Yakima County; and
WHEREAS, the City Council finds and determines that the proposal provided by
the Yakima Herald-Republic for legal newspaper services is an appropriate service
proposed by a qualified provider; and
WHEREAS, in order to secure the continuation of legal newspaper services, the
Agreement attached hereto and incorporated herein by this reference, by and between the
City of Yakima and the Yakima Herald-Republic, the City finds and determines that approval
of such Agreement is in the best interests of residents of the City and will promote the
general health, safety and welfare; therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The Agreement for legal newspaper services attached hereto and
incorporated herein, by and between the City of Yakima and the Yakima Herald-Republic,
is hereby approved; and
Section 2. The City Manager's execution and administration of the Agreement
approved in Section 1 above is hereby approved as and from the date of execution thereof;
now, therefore,
ADOPTED BY THE CITY COUNCIL this 17th day of February, 2026.

LEGAL ADVERTISING CONTRACT
THIS CONTRACT, executed this 17th day of February, 2026, by and between the City of
Yakima, Washington, a municipal corporation, hereinafter called the City, and the Yakima
Herald-Republic, hereinafter called the Publisher pursuant to the terms and conditions herein.
WITNESSETH:
WHEREAS, pursuant to Chapter 1.75 of the City of Yakima Municipal Code, if only one
newspaper is posted as a legal newspaper by the clerk of the Yakima County Superior Court
and is published within and having circulation within the City of Yakima, the City Council may
award the legal advertising contract without calling for bids; and
WHEREAS, the Yakima Herald-Republic is the only newspaper posted as a legal
newspaper with a general circulation within the City of Yakima; and
WHEREAS, the Yakima Herald-Republic proposes as follows:
8.3 point sans serif type with 8.4 point leading set on an 10 pica line width in
conformance with the attached sample, with paragraphs to be indented two spaces, at the rate
of$1.95 per line for the first insertion and $1.85 per line for each subsequent insertion of a
particular advertisement or notice; and
WHEREAS, the City is required to publish a number of legal notices and the Yakima
Herald-Republic is able to publish those legal notices as outlined in this Agreement;
NOW, THEREFORE,
The City and the Publisher hereby agree as follows:
1. The City does hereby incorporate the recitals above as if fully incorporated herein
and accepts the aforesaid proposal of the Publisher. The City agrees to pay the Publisher for
the required printing and publishing of City ordinances, resolutions, legal notices and other legal
advertising required by law to be published by the City commencing on the third Tuesday of
February, 2026 and ending the third Monday of February, 2027, in the amount of$1.95 per line
for the first insertion and $1.85 per line for each subsequent insertion of a particular
advertisement or notice.
2. The Publisher agrees
a. To perform all such printing and publishing in accordance with the aforesaid
proposal and at the aforesaid price, with all notices to be printed in a common location in a
newspaper which satisfies the specifications and requirements of Chapter 1.75 of the City of
Yakima Municipal Code.
b. That all legal advertising shall be printed as promptly as mechanically possible
following the placing of the order therefore, consistent with dates specified on printing orders
requiring printing on a specific date or dates; provided, publications resulting from City Council
meetings shall be published during the same calendar week as that during which the City
Council meeting is held.

c. The Publisher shall republish advertisements in the next issue of the newspaper
at no charge to the City when directed to do so by the City Clerk because of a misprint,
omission or other error by the Publisher deemed by the City Clerk to require republication.
d. In the event the City advertising is published in a weekly newspaper, the day of
publication of which is changed during the term of this contract, the Publisher shall give written
notice of such change to the Yakima City Clerk not less than two weeks prior to the change in
the publication day.
e. The Publisher shall furnish to the City an affidavit of publication of each legal
advertisement immediately following the final printing thereof, which affidavit shall include the
full text of the advertisement as printed and the date or dates of publication, which affidavit shall
be signed by a responsible and authorized representative of the Publisher with the signature
acknowledged by a notary public.
3. In the event the published advertisements contain cumulative misprints,
omissions, or other errors deemed by the City Council to be sufficient cause for termination of
this contract, the City reserves the right to so terminate this contract and arrange for publication
of the City's legal advertising with some other legal newspaper for the balance of the term of this
contract. The City shall give notice to the Publisher of the consideration by the City Council of
termination of this contract in sufficient time to allow the Publisher to appear before and to be
heard by the City Council prior to the effective date of any such termination.
4. The name of the newspaper in which the City legal advertising is to be printed is:
Yakima Herald-Republic, which newspaper is published daily, with physical printing and space
for legal notices on Tuesdays, Thursdays, and Saturdays. If the name of the newspaper
changes, the newspaper is sold or assigned to a third party, or the newspaper ceases to be
published daily, Publisher shall immediately inform the City and the City may terminate this
Agreement immediately at the City's sole discretion.
