AN ORDINANCE rezoning property tt Mead Avenue between South 3rd Avenue and South 4th Avenue from R-2 to B-20 WHEREAS, on January 6 1960 at a regularly scheduled • meeiing of the Planning Commission of the City of Yakima, said Planning Commission by a divided vote recommended the denial • of the application of Gottlieb Hein and Reinhold Eichler for the rezoning of certain property situated on Mead Avenue be- tween South 3rd and South 4th Avenues from ,R-2 to B-2, and WHEREAS, subsequent thereto and within the time speci- fied in city ordinance, the said Gottlieb Hein and Reinhold • Eichler duly filed an appeal from said recommendation of the 110 Planning Commission with the City Council, and WHEREAS, a hearing was held an said appeal on February • 3p 1960 at a regular meeting of said City Council, and WHEREAS, at the conclusion of said hearing on said • appeal on February 3p 1960, after due and careful consideration of all of the factors involved in said aeplication, the City Council adopted Resolution No. D-97 which resolution denied the recommendation of the Planning Commission of the City of Yakima that the application of the said Gottlieb Hein and Reinhold Eichler to rezone said property be denied, and requesteel the said Planning Commission to make further report to the City Council with respect to said application of Gottlieb Hein and Reinhold Eichler, and • 411 WHEREAS, the City Clerk of the City of Yakima delivered a copy of said Resolution NO. D-97 to the Secretary of said Planning Commission, and WHEREAS, more than 40 days have elapsed after the receipt by the said Secretary of said Planning Commission of a copy of said Resolution No D-97 and the eaid Planning ' Commission has failed to act in aay way thereon and WHEREAS, the City Council finds that the rezoning of said property from R-2 to B-2 in accordance with the application ' therefor is in,accord with good planning and the Comprehensive Plan of the City of Yakima, and that the needs of the city ani community require such charge to ,Local Business purposes, now, 411 therefore, BE IT ORDAINED BY THE CITY OF YAKIMA:. Section 1. The following described real property located on Mead Avenue between SoUth 3rd and South 4th Avenues, and more particularly described as follows, to-wit: Lot 6 the W Y of Lot 7 and the W of • Lot 8, Ledwieh Addition is hereby rezoned from R. Two Family Residential to B-2 Local Bueiness. Section 2. The above change in zoning shall be • included and depicted on the next regularly amended ,Use District Map prepared by and for the aaid City. Section 3 The City Clerk is hereby authorized and • directed to file with the Yakima County Auditor a certified copy of this ordinance., " 2 te w • 411 Section 4. This ordinance shall become effective • thirty days after its Dassage, approval and publication as provided by law and the City Charter.
