Thank you also for evaluating all factors which may be relevant to the proposed project, including the considerations of property ownership. I have consulted with my attorney and a water resource engineer and I would request a public hearing be held and the proposed USACE Permits be denied for the following reasons: First, the proposed project action analyzed in the approved 12-1-15 Final Environmental Assessment, the SEPA and 1-6-16 FONSI, is not consistent with the current project action. The 12-1-15 approved EA states "Any changes to the approved scope of work will require re- evaluation for compliance with NEPA and other laws and EOs before implementation. In addition, the 9-14-16 letter from Robert Little, FEMA Grants Management Specialist, in a letter to Brynee Walker, State Hazard Mitigation Programs Manager, FEMA states: "Any change to the approved scope of work will require re-evaluation for compliance with NEPA and other laws and Executive orders." Specifically, in 2018 two bridge replacements and one private culvert were eliminated from the original project: the South 80th Avenue bridge, the bridge at Wide Hollow Road at approximately 89th Avenue, and the proposed added box culvert near the S. 88th Avenue private bridge. Adding culverts adjacent to the bridges significantly changes the project scope of work, flood levels, floodplains and flood impacts to nearby property owners. Since, all prior project approvals were analyzed and based on the bridges being replaced in their current locations, along with the addition of a culvert on a private crossing, these changes must be also be analyzed and reported, including changes to hydraulics, environmental assessments, real property impacts and costs, revised floodplain, etc. In addition, the 2015 Final Environmental Assessment stated that the project would remove regulatory floodplain, yet based on the County's 2018 Shaw and Wide Hollow Creek Flood Control Project map, the 100 year floodplain increases significantly west of the proposed Shaw Creek realignment and the floodplain extends further north within the Meadowbrook Mobile Home Park and Westbrook subdivision. All of which will be now be placed in the post -project flood plain. The EA did not adequately address the expanded floodplain, nor provide due process for the impacted property owners. There also appears to be no discussion in the EA of the potential environmental impacts with disturbing contaminated sediments and runoff for the proposed new culverts or related mitigation and disposal requirements. The USACE Joint Public Notice plans you provided, did not provide Temporary Erosion and Sediment Control or In -water Work Plans or specifications that would address potential release of contaminated disturbed sediments. Second, while Yakima County and FEMA may state that they have followed the EA process by having public meetings in 2009 and receiving public comments regarding the EA, they have not. The EA only examined one Shaw Creek re-routing alternative, which the County asserts, is similar to the historical connection to Wide Hollow Creek. Yet no detailed analysis is provided to support that assertion nor is there historical evidence to support it. Based on their prejudiced alignment, the EA public comments were dismissed without detailed investigations into each comment, nor was there a detailed analysis of all of the alternative alignments, including all the costs to acquire the necessary RW. I know, because my wife and I went to the Yakima County office on March 7, 2014 to view a preliminary design, and no one from the County has met with us since, to discuss our concerns and the significant impacts of their proposed Shaw Creek relocation through the middle of our property. In order to justify their Shaw Creek realignment project, the County tied Shaw Creek to their Wide Hollow Creek improvement project. While the Wide Hollow Creek watershed is extensive and has flooded numerous times causing significant property damage, the Shaw Creek watershed is very small, has rarely flooded and has never caused significant property damage. This is evident by the relatively newer construction of the Cottonwood Grove development with +-300 homes, along with the Cottonwood Elementary School and their subsequent ball fields. All of which were allowed to be constructed without mitigation from potential flooding from Shaw Creek. In addition, though Shaw Creek has never been a significant flood risk with significant property damage, like other rivers and streams in Yakima County, their proposed design is to increase the capacity of Shaw Creek up to a hypothetical 500-year flood event. Yet Wide Hollow Creek cannot even contain a ten-year event in many places. In addition, as recent as 2018, the Yakima County project website stated "In 2012 and 2013, representatives from Yakima County Water Resources Division have been contacting landowners in the project area to discuss the project and their willingness to sell either an easement or a portion of their land for the Shaw Creek relocation. The PDM grant provides funding for purchases at fair market value from willing sellers and condemnation is not permitted in this granting process. Additional meetings with landowners will continue through the planning process." Your office should be aware that Yakima County has not conducted this project in good faith nor have they met with us since our initial 2014 meeting. I also understand, through a friend that had filed a public disclosure request, that the County is now prepared to condemn our property. Since the project began, the County has changed from willing sellers to condemnation, the scope of work has changed to eliminate bridges and a private crossing culvert, and their project is not on time, on scope, or on budget. Third, Yakima County does not own, nor have any rights to our property, which would allow the USACE permit on the proposed relocation area of Shaw Creek and Wide Hollow Creek. In addition, Yakima County has not followed standard project and RW acquisition processes which were established to protect private property rights: Therefore, please see my attached September 28, 2018 letter denying permitting agencies access to our property. It is critical that private property rights must be protected, therefore, an open and transparent project process must be followed. You may ask how I am qualified to comment on Yakima County and their project process or lack thereof. I worked for the Washington State Department of Transportation in the Real Estate Services Office for 36 years as a licensed staff appraiser. In addition, I was the Local Agency Coordinator with regulatory oversight for 8 counties (including Yakima County) and 32 cities in our South Central Region, when these agencies utilized Federal Highway Administration funding in their right-of-way projects. I was also the Real Estate Services Manager in the South Central Region. With 36 years of WSDOT experience acquiring real property and property rights with State and FHWA project oversight, I assure you that we had public meetings and numerous meetings with stakeholders and private landowners to discuss our proposed project impacts to their real property. We then had the opportunity to make possible design modifications to create win - win situations, facilitate RW acquisitions and build our highway projects. Owners were contacted during our initial project scoping phase, before the EAs were completed, to ensure our preliminary design could deliver our projects on time, on scope and on budget. Finally, I have also asked my Congressman Newhouse to investigate the lack of oversight by FEMA and I have filed a formal complaint, Refit HLCN157542123857, with the U.S. Department of Homeland Security, Office of Inspector General to investigate FEMA's waste of taxpayer's dollars, fraud and abuse/misconduct pertaining to this project, including FEMA Region 10 staff associated with their oversight of this project. In conclusion, as a regulatory agency, we would request that you do not issue your USACE Permit on private property where Yakima County has not conducted their proposed project in good faith, unbiased and transparent, nor have they followed standard project and right-of-way acquisition guidelines and laws. It is my understanding the NEPA process requires a range of reasonable alternatives to be evaluated. However, based upon your current design it is apparent both the NEPA process and the Environmental Assessment were not completed in good faith, since you have not adequately addressed all of the public concerns and comments nor provided the public due process. Itksalso apparent that the current route selection process was prejudiced by not investigating and evaluating other reasonable alternative alignments. First and foremost, Yakima County did not require the Cottonwood Grove residential development torelocate #rmitigate their development impacts to Shaw ditch during the development of their subdivision, despite the numerous public comments and concerns from the nearby property owners. Therefore, the most likely alternative alignment should now be located on the Cottonwood Grove developer's land which has benefited the most. Specifically, this development has reserved TRACT A along the southwesterly side of their subdivision a 50' right of way for public use, which according to their plat would be deeded to the City ofYakima atnoexpense. This dedicated R/W would then follow FEIVIA's estimated floodway to the east toconnect to a new channel west of Rose Lane and east of our property, thereby connecting to Wide Hollow Creek where the County had planned toreconstruct the Wide Hollow Road Bridge. Second, Lhad due diligence beenperfonmedduhngthe environmental process and the current alignment not biased, it would have become apparent that the school had constructed an irrigation overflow channel on the southeasterly and south side of the school. Historically, the Shaw ditch natural corridor flowed due south through the Cunmnminn/spasture and farm property, then south to the Wide Hollow Creek, until the Cottonwood School and Sports Fields were constructed. Note, the AhtanunnCanal right ofway onthe south side mfthe school and as depicted on the County Assessor's map, was utilized circa 3.895 to divert irrigation water from Wide Hollow Creek north tothe Cummings property. Therefore, this alternative alignment would follow the historic 1800's water course. In addition, it should also be noted that the Yakima Valley Canal Company's irrigation flow is regulated by adjusting the amount of excess canal water bydiverting orspilling canal water into the Wide Hollow Creek throughout the irrigation season. This water diversion islocated south ofWide Hollow Road and east mfDaoetRoad, Lwhere the canal and the Wide Hollow Creek cross. Similarly, when the canal water is delivered to the Cottonwood School parcel, excess water is spilled, however the excess school water is spilled into the overflow/drainage swale located onthe south side ofthe school. |fthe proposed project isto"nmitigatepotentia|f|mwd loses" tohomes |nthe Cottonwood Grove development and also "provide positive benefits to water quality and fish habitat for Wide Hollow Creek", then the School's excess irrigation water should bediverted south along the existing canal company right ofway. Your proposed channel alignment could still flow south along the east side of the Cottonwood School parcel as currently proposed, thereby protecting Cottonwood Grove School and the residential subdivision' However, the alignment would then connect to the school's existing southern 80' wide by over 800^ in length irrigation drainage ovva|a, which would connect tothe existing canal right ofway. The canal company owns the right-of-way in fee and it runs due south 1,200 feet to a culvert beneath Wide Hollow Road, where it would disperse into the Wide Hollow Creek' Since this canal right-of-way is clearly depicted on the Yakima County Assessor's maps as the Ahtanum Canal, had Yakima County and FEMA performed their due diligence and interviewed the local residences as subject matter experts, they would have found an existing drainage course as the least expensive alternative with less environmental impacts, which would allow additional irrigation water to flow into the Wide Hollow Creek. Since in -stream flow into the Yakima River is critical during the summer months, all of the project agencies should concur that this is an opportunity to divert additional water into the Yakima River during the summer months when it is most critical. This least cost alternative alignment would also eliminate the need to replace the Wide Hollow Road Bridge at approximately 89th Avenue. In conclusion, based upon our previous correspondence, along with our comments above, several alternative alignments exist which prove the least costly alternatives; have significantly less impacts to private property and provide additional in -stream flows. Therefore, once again, we are not willing to sell only a portion of our property to Yakima County or FEMA. Please notify all agencies and all parties involved, they do not have permission to access our property for any purpose. Namely, the melting snow pack due to high temperatures and significant rainfalls have caused major flooding along the Naches River, Ahtanum Creek, Cowiche Creek, Wide Hollow Creek, Cottonwood Canyon, Bachelor Creek, etc. Many residents indicate that this 2016 flooding is equal to the epic 1996 flood, or worse. However, through this series of unprecedented weather patterns and flood events, Shaw ditch has remained only a trickle. Because the FEMA office is located on the west side of our state they may not have observed these recent flood events first hand. However, I am sure that Cliff Bennett and Yakima County can attest to these recent events. I have numerous photos from these 2016 flood events which document Wide Hollow Creek flooding over Wide Hollow Road and yet Shaw ditch as a small trickle. When FEMA revised their FIRM map 53077C1009E on July 17, 2012, hundreds of parcels west of 88th Avenue were now required to have Flood Hazard Insurance. This reclassified map has caused a hardship on many families. While the recent flood events have confirmed the location of many floodplains, these events also confirmed that Cottonwood Grove subdivision and the homes to the west are not at risk of flooding or flood damage from Shaw ditch. The 12-1-15 FEMA Final Environmental Assessment states in SECTION TWO PURPOSE AND NEED, Sec. 2-1, the purpose of the Shaw Creek flood control project is to reduce the risk of flood damage to residences in the Cottonwood Grove subdivision by relocating and increasing the capacity of Shaw Creek up to the 500-year flood event. From a historic perspective, numerous creeks, streams and rivers recently flooded within the Yakima Valley as they have in the past, and yet Shaw ditch did not flood or even fill its banks. The absence of flooding along Shaw ditch also confirms that the FEMA hydraulic models are inaccurate and there is no historical evidence to support the basis of their design to relocate Shaw ditch, or the purpose or need. It is inappropriate to utilize FEMA Pre Disaster Mitigation Grant Program funding or any taxpayer funds to relocate Shaw ditch with a 500-year flood event capacity, when there is no historical evidence of Shaw ditch flooding in this area. In conclusion, based upon these series of events in 2016 it is incumbent upon FEMA to revise the Shaw ditch FEMA map and remove the undue hardships FEMA and Yakima County have placed on families in West Valley. The only way to correct this is to be honest about the absence of flooding along Shaw ditch and the inaccuracy of FEMA's model. What are the real economic impacts with a model with a low probability of minimal water near these residences? In addition, the project folio stated that the "Relocation of Shaw Creek to its historic location will provide positive benefits to water quality and fish habitat for Wide Hollow Creek." What is the basis of this statement, since there is no historical or geological evidence that Shaw ditch was ever located where the creek and overflow are proposed? "Shaw Creek" is actually a ditch and our relatives have lived near Shaw ditch for over 55 years with no evidence of fish spawning or flooding which caused property damage. Historically any Shaw ditch overflow could have followed 96th Avenue south until the Cottonwood School was constructed. When the school was constructed an overflow channel on the south side was also installed. The proposed project overflow channel could flow south along the school to 96th Avenue and then south along the additional right of way which was created when Yakima County shifted their road alignment to the west, or south in the existing Ahtanum Canal R/W to Wide Hollow Creek. As the owner of "undeveloped lands", project impacts of the proposed "Shaw Creek Relocation" to West Valley Farm and Ranch LLC include: severance damages, added costs for access and utilities, an additional 200' setback development restrictions, more stringent EPA protection for streams and wetlands, impacts to the current interim use, taking of land plus significant loss of developable lots, potential high water table and wetlands, etc. The "planting of natural vegetation along the new creek" in the past has included Russian olive trees and the ditch cannot currently flow due to the massive amounts of vegetation and trees along Shaw and other nearby ditches. The best alternatives to the proposed mitigation project are: 1) Assign reasonable mathematical models and projections to the FEMA model. 2) Remove the obstructive vegetation from Shaw ditch and then enlarge these existing ditches. Since there is effectively no water during the summer months in these ditches, the enlarged ditches could serve as overflow channels; 3) Utilize the current overflow channel on the south side of Cottonwood School and the County R/W along 96th Avenue or the Ahtanum Canal to connect to Wide Hollow Creek; Thank you for your consideration of these additional three Alternatives, which cost significantly less than the relocation or overflow channel proposals. The draft Environmental Assessment has stated "The purpose of the Project is to mitigate potential flood losses from more than 300 houses in the Cottonwood Grove development which was approved and constructed prior to FEMA flood mapping." If in fact there was an imminent threat of flooding from Shaw ditch, post Yakima County's 1996 epic flooding, then how could Yakima County and Yakima City allow "300 houses in the Cottonwood Grove development" to ever be constructed? I would answer that FEMA's identified problem of Shaw ditch flooding and causing significant property damage does not exist and my statement can be confirmed by those who have resided in this neighborhood for over 50 years. In addition, I believe that FEMA circumvented the environmental process by modifying their hydrological and hydraulic models with increased "predicted flows" that were not based upon historical validity, but with models that allowed FEMA to modify their 1974 Flood Hazard Boundary map area with the revised Flood Insurance Rate map completed in 2010 and the FIRM Panels 53077C1009E and 53077C1028, effective July 17, 2012. FEMA did not modify their 1974 FIRM based upon historical flood data and the local residences who reside near Shaw ditch and who are the local subject matter experts. The EA states that Shaw ditch is no more that 4' wide in places with less than 5 cfs of flow west of 80th Avenue and that "Once the irrigation in the area is shutoff in the fall, the creek runs dry until it is turned back on is the spring." In spite of this historical data FEMA developed a model and "predicted flow in excess of 349 cfs for the 100-year flow." to support their desired outcome. In addition, while FEMA anticipated Pacific Northwest "Climate Change" they did not address the warming trend with less snow within the water shed. Based upon climate change alone, the increased flow "predicted" is not valid. The FEMA increased flow model with their expanded floodway and flooplains have prejudiced the route selection process and alternatives. The project folio stated that the "Relocation of Shaw Creek to its historic location will provide positive benefits to water quality and fish habitat for Wide Hollow Creek." However, there is no historical or geological evidence that Shaw ditch was ever located where the alternative creek and overflow are proposed and the EA states that "Once the irrigation in the area is shutoff in the fall, the creek runs dry until it is turned on in the spring." "Flooding in this area is generally infrequent due to the low average amount of annual precipitation:" The Yakima Valley is an arid desert, not the Gulf Coast or East Coast where FEMA has paid out billions of our taxpayer dollars. As the owner of "undeveloped lands" on the proposed "Shaw Creek Relocation", it is apparent that the EA is again not accurate and has again prejudiced the route selection by failing to recognize that our land has been in agricultural production for over 100 years, as evident by the canal on the west side of our property which was established circa 1894 by the Yakima Valley Canal Company and is depicted on your maps as the 1947 irrigation ditch location, the 1900's farm house located at 9001 Wide Hollow Road, along with the two grain silos, etc. Though the intensity of this family farm and the agricultural crops and animals may have changed over the years, this parcel is prime agriculture land which is currently classified as Farm and Agricultural Land and is classified as Open Space per RCW 84.34. The proposed "Shaw Creek Relocation" project impacts to West Valley Farm and Ranch LLC are significant and I had previously articulated them in my July 7, 2014 email to Science Kilner with FEMA and Cliff Bennett with Yakima County. However, it is apparent that our comments were dismissed and not addressed by FEMA, as evident by their Scoping Summary Report which states that we only requested "clarification" and were "concerned". Let me be clear, our family farm is adamantly opposed to the proposed relocation of Shaw ditch, the severance and taking of our property, along with the significant damages and impacts to our current farming operation and to future land use plans. I believe the inordinate amount of time and money expended by FEMA and Yakima County to support their relocation of Shaw ditch, where a flood damage problem does not exist, is a misuse of our taxpayer dollars. In addition, FEMA's change from the 1974 FIRM to the 2010 & 2012 FIRM's, without validity or support, has effectively taken away private property rights and land use options without contest or compensation. Historically any Shaw ditch overflow could have followed 96th Avenue south, until the Cottonwood School was constructed. When the school was constructed an overflow channel on the southeasterly and south sides were installed by the School District. An overflow channel could therefore flow south along the east side of the Cottonwood School parcel as currently proposed, to their southern school drainage swale, +-75' wide, and then west to the existing Yakima Valley Canal Company right of way. The Canal Company owns the R/W in fee, though adjoining residences to the west are encroaching, and it runs due south +-1,200 feet to a culvert beneath Wide Hollow Road, and then it disperses into the Wide Hollow creek (see attached map). Since this canal R/W is clearly depicted on the Yakima County Assessor's maps as the Ahtanum or Wide Hollow canal, had FEMA performed their due diligence and interviewed the local residences as subject matter experts, they would have found an existing drainage course alternative on public land, and the least cost alternative with less environmental impacts. This alternative would also eliminate the need to replace the Wide Hollow Road Bridge at approximately 89th Avenue. In conclusion, stop the misuse of our taxpayer dollars, eliminate the 2010 & 2012 FIRM's and reinstate the 1974 FIRM, thereby removing the regulatory taking of property rights and insurance burdens from numerous homes in the area. The best alternatives to the proposed mitigation project are: 1) Assign reasonable mathematical models and projections to the FEMA model. 2) Remove the obstructive vegetation from Shaw ditch and then enlarge these existing ditches. Then, around 2012 FEMA "remodeled" the "potential" for flooding along Shaw Ditch to include Cottonwood Grove and hundreds of surrounding homes within a new floodplain. Why? Had there been catastrophic flooding throughout the Shaw Ditch neighborhood over the past 25 years? NO, they just increased the "potential" for flooding and "remodeled" the floodplain, thereby creating a crisis that needed to be fixed. Historic flooding within this area has been along the Wide Hollow Creek watershed, NOT Shaw Ditch. In addition, the 2015 Final Environmental Assessment stated that the project would remove regulatory floodplain, however, based on the County's 2018 Shaw and Wide Hollow Creek Flood Control Project map, the 100 year floodplain increases significantly west of the proposed Shaw Creek realignment and the floodplain extends further north and south in the Meadowbrook and West Valley Park neighborhoods. All of which will now be placed in the post -project flood plain. The EA did not adequately address the expanded floodplain, or provide due process for the impacted property owners. My first indication that Yakima County was again proceeding with this project was a few weeks ago when I received a Fraud Alert from First American Title Company regarding our property. I found out the City of Yakima had ordered a title report on our property. I then saW Randy Beehler from the City on our local news channel, where he stated that the City of Yakima planned to apply for a FEMA BRIC, (Building Resilient Infrastructure and Communities) grant in 2026 to help fund the proposed Shaw Creek project. I went to the Yakima County web site and found a Public Notice for comments to be received by July 25, 2024. Yakima County NEVER notified me of this opportunity to comment. In fact, my last correspondence on this project was December 31, 2019. Attached are some of the letters and emails which I have sent over the past ten years to express our opposition to the current project alignment and provide alternative options, all of which have been dismissed by the County as not valid. My name is Howard Maxfield, and I have previously written to you and submitted a tetterto the editor of the Yakima Herald. I would like to present two key points, First, let's discuss the potential increase in response times if Station 92 were to close. My wife and I are both 79 years old. I have a Calcium CT score of 1972 on a scale of 9-400+, and both of my parents underwent heart surgeries. Three weeks ago, I had a fall at the corner just east of Station 92. Given our age, my wife and I experience falls more frequently. Fortunately, l did not hit my head during the fall, which could have led to a brain bleed or fracture. If Station 92 were closed, the nearest station would be about a six -minute drive away. In a medical emergency, that additional time could be fatal. Statistically, I expect to need the services of Station 92 in the corning years, as it is located right in my neighborhood. Second, I want to address the inequity of closing the most remote fire station. Shutting down one of the five stations is fundamentally unfair. It is time for some innovative thinking. If the $1.75 million in savings cannot be found, I have a few suggestions: 1. We currently have six crews distributed across five stations. While it may not be practical to reduce the airport station, have you considered cutting down the station with two crews and adjusting the boundaries of the other stations to rebalance the workload? 2. Another option could be to implement a rotating closure, where one station is closed for one week at a time. This approach would distribute the impact across the city, and boundary revisions might be necessary. 3. At the very least, 1 urge you to ensure that EMT services remain available at Station 92. Quick response times are critical, and saving lives should take precedence over property concerns. 1 /6/2026 Thank you for your attention to this matter. With travel times estimated at six minutes between Station 92 and Station 93, alongside the presence of large school complexes further west, urge you to carefully evaluate whether the proposed savings from closing Station 92 might inadvertently increase risks to public safety.
