For Meeting of: October 21, 2025 ITEM TITLE: Resolution authorizing acceptance of YVCOG Congestion Mitigation &Air Quality (CMAQ) award for the Yakima Alley Paving Project 2859 (Streets Capital Fund) SUBMITTED BY: Bill Preston, Community Development Director SUMMARY EXPLANATION: The City of Yakima was awarded $525,000 in Federal Funding through the YVCOG Congestion Mitigation &Air Quality (CMAQ) program for the Yakima Alley Paving Project 2859. The project will include paving alleys between Folsom Avenue and Lincoln Avenue and between Pierce Avenue and Lewis Avenue. Construction estimated to begin in 2026. There is a 13.5% local match required for this award. If Toll Credits are available at the time of obligation, no match will be required. R-2025- A RESOLUTION authorizing acceptance and execution of a federal Congestion Mitigation &Air Quality (CMAQ) award with Yakima Valley Conference of Governments (YVCOG) for the Yakima Alley Paving Project 2859 (PROJECT) WHEREAS, the City is improving the functionality and safety of alleys located in the City of Yakima, and improving the air quality; and WHEREAS, improvements consist of paving alleys between Folsom Ave and Lincoln Ave, and from Pierce Ave to Lewis Ave; and WHEREAS, the City of Yakima was selected to receive $525,000, in federal CMAQ funding from YVCOG; and WHEREAS, the CMAQ award requires the City to provide 13.5% local match for the project; and WHEREAS, the City Council finds that it is in the best interests of the City of Yakima and its residents to accept and execute the grant award with YVCOG for the Yakima Alley Paving project 2859, and authorize the City Manager to take all necessary steps to execute the grant award, necessary contracts, and administer the funds received from YVCOG; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Manager is hereby authorized to accept the Yakima Valley Conference of Governments CMAQ federal grant award, not to exceed Five Hundred Twenty-Five Thousand Dollars ($525,000.00) as described in the award, and directed to take all necessary steps to secure the funding for the Yakima Alley Paving project 2859. Section 2. The appropriate administrative officials of the City are hereby authorized to receive monies and to expend the same as authorized by the YVCOG award. Section 3. The City Manager, or his designee, shall have responsibility for the administration of said funds and expenditure of said funds received pursuant to the YVCOG award and the budget submitted therewith for the grant. Section 4. The City Council hereby authorizes the City Manager to execute any and all contracts necessary and not to exceed the budgeted amounts outlined in the award, and enter into any other necessary agreements or documents to accomplish the Yakima Alley Paving project 2859 funded through the YVCOG award. Section 5. Severability. If any section, subsection, paragraph, sentence or clause of this resolution is declared invalid or unconstitutional for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of the resolution. As of February 28,2025, YVCOG continues to coordinate with WSDOT and FHWA to ensure CMAQ funding remains secure pending ongoing review by the new federal administration. Project progress reports will be required for all regional CMAQ-funded projects as part of the monthly YVCOG Transportation Technical Advisory Committee meeting(s). Any changes in federal funding amounts or anticipated obligation dates must be reported as soon as possible. The project can be entered into the City of Yakima's Transportation Improvement Program according to the following schedule: • Obligation year=2025; (2023-24 carryover, 2025) CMAQ funding=$525,000(CN Phase) Additionally,jurisdictions utilizing CMAQ funds are required to secure a minimum of 13.5%eligible matching funds (anticipated to be WSDOT"Toll Credits", presently available through FFY 2026). Project sponsors are responsible for assuring project phases are fully funded at the time of obligating federal funds. Projects must be included in the State Transportation Improvement Program (STIP) before these federal funds can be obligated.
