HomeMy WebLinkAbout1960-128 ORDINANCE NO./2" AN ORDINANCE relating to traffic speed limits and amending Section 39 of Ordinance No. B-1526 entitled "AN ORDINANCE relating to and regulating traffic, travel and transportation and their incidents upon the streets and other ways open to the public; prescribing the powers and duties of officers and others in relation thereto; defining offenses; pro- viding penalties and repealing Ordinance No. B-131 and all amendments thereof and all other ordinances in so far as they are in conflict therewith, and declaring an emergency", as amended by Ordinance Nos. B-1546, B-1712, and B and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section I. That Section 39 of Ordinance No. B-1526, as amended by Ordinance Nos. B-1546, B-1712 and B-2094, is hereby amended to read as follows: "Section 39. SPEED REGULATIONS. • "(a) Every person operating a vehicle of any character upon a public street or alley shall operate the same in a careful and prudent manner and at a rate of speed no greater than is reasonable and proper under the con- ditions existing at the point of operation, taking into account the amount and character of traffic, condition of brakes, weight of vehicle, grade and width of high- way, condition of surface, and freedom of obstruction to view ahead, and consistent with any and all con- ditions existing at the point of operation-so as not to unduly or unreasonably endanger the life, limb, property or other rights of any person entitled to the use of the street or alley, or of any child or children of immature year upon or adjacent to the same. "(lo) Subject to subdivision (a) of this section, and except as otherwise herein provided, it shall be unlaw- ful for the operator of any vehicle to operate the same at a speed in excess of the following: "1. Twenty (20) miles per hour; When passing - any marked school or public playground or park cross- walk, when such marked crosswalk is fully posted with standard portable school or speed control signs. The • speed zone at the crosswalk shall extend 300 feet in either direction from the marked crosswalk. • "2. Twenty-five (25) miles per hour: Through- out the City except as otherwise limited by this code; provided however 9 that the legal speed limit on the following arterials shall be a maximum of 30 miles per hour in areas not posted otherwise; • a. First Street throughout the Oity of Yakima. b. West Lenox Avenue and Nob Hill Boulevard • from 3rd Avenue to the Western City Limits. c, Tieton Drive from South 16th Avenue to the Western City Limits. d, Summitview Avenue from 7th Avenue to the Western City Limits. s. Lincoln Avenue from 5th Avenue to the Western City Limits. f. Fifth Avenue "I" Street to Yakima Avenue. g. Third Avenue. and Broadway from Walnut Street to the South limits of the City of Yakima. h. West "I" Street from 6th Avenue to North First Street. 1. West Yakima Avenue from 16th Avenue to 36th Avenue. j. Nead Avenue from South 16th Avenue to East City Limits. k. South 16th Avenue from Lenox Avenue to South City Limits. 1. South 24th Avenue from Nob Hill Boulevard to Washington Avenue. m. Fair Avenue from Terrace Heights Way to Lenox Avenue. n. East Lenox Avenue from South First Street to East City Limits. o. North 16th Avenue from Lincoln Avenue to Fruitvale Boulevard. "3. Thirty-five (35) miles per hour: It shall be lawful to travel upon the following streets and road- ways at a speed not greater than thirty-five (35) miles per hour. Englewood Avenue; Grandview Avenue between Lincoln Avenue and Englewood Avenue; Summit- view Avenue where the same constitutes a boundary between the City of Yakima and Yakima County; Washington Avenue East City Limits to West City Limits. - 2 - 411 • 411 The speed limit shall be also thirty-five (35) miles per hour on such streets as may be desig- nated by resolution adopted by the City Council and by signs posted on,such streets, "(e) All charges Tor:the violation of any of the pro- visions of this section, every notice to appear, and every complaint charging the violation of this section shall specify approximately the speed at which the defendant is alleged to have operated such vehicle, the maximum lawful speed at the point of operation, and the reasonable and proper rate of speed applicable under the conditions • existing at the point of operation. "(d) The speed . limits set forth in this code shall not apply to authorized emergency vehicles when operated in emergencies and the drivers thereof sound audible signal by bell, siren or exhaust whistle. This provision shall not relieve the driver of such vehicle from the duty to drive with due regard for the safety of all persons using the street nor shall it protect him from the consequences of a reckless Aisregard the safety of others. "(0) Compliance with speed requirements of this code, under the circumstanceshereinabove set forth y shall not relieve the operator of any vehicle from the further exercise of due care and caution as further circumstances shall require. "(f) The unlawful operation of a vehicle in excess of the maximum lawful'speeds provided in this code at the point of operation and under the circumstances des- cribed shall be prima facie evidence of the operation ef a motor vehicle in a reckless manner by the operator thereof," Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health and safety'of the people of the City of Yakima and an emer- gency is hereby declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval • 3 . - III • • and publication, as provided by law and the City Charter, PASSED By THE CITY COUNCIL, signed and approved this day of June, 1960 1 ATTEST:
