A RESOLUTION approving the sale of a portion of Yakima County Assessor's Parcel
No. 19132911005 commonly known as Sherman Park, Yakima,
Washington, the legal description of which is attached hereto and
incorporated by reference herein as Exhibit "A", for use by the State
of Washington for road construction and improvements, and
directing and authorizing the City Manager of the City of Yakima, or
his designee, to execute a Quit Claim Deed and Real Property
Voucher for the sale of said property to the State of Washington
substantially in the form as attached hereto as Exhibits "B" and "C"
respectively, and to take any additional actions and execute any
additional documents that may be necessary or appropriate relating
to the sale of said property.
WHEREAS, the State of Washington desires to acquire certain real property at
State Route 24 and Interstate 82, Yakima, Washington; and
WHEREAS, RCW Title 35.21 authorizes the City of Yakima to acquire, hold,
possess and dispose of property; and
WHEREAS, the State of Washington desires to purchase said the said property
from the City of Yakima; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to authorize the sale of the said property to the State of Washington; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to
execute a Quit Claim Deed and Real Property Voucher substantially in the form
attached hereto as Exhibits "B" and "C". The Quit Claim Deed and Real Property
Voucher shall be approved as to form by the City Attorney.
ADOPTED BY THE CITY COUNCIL this 1st day of February, 2005.

That portion of the hereinafter described Parcel A lying easterly and southwesterly of a line
described as beginning at Highway Engineer's Station (hereinafter referred to as HES) FC
22+04.93 on the FC line survey of SR 82, SR 24 Interchange; thence northerly to a point opposite
said HES FC 22+04.93 and 25 feet northerly therefrom; thence southeasterly parallel with said FC
line survey to a point opposite FC 26+03.34 and the end of this line description.

EXCEPT that portion of Lots 13 and 24, GOODWIN'S FIVE ACRE TRACTS, recorded in
Volume "A" of Plats, Page 18, records of Yakima County, Washington, described as follows:
Beginning at the Southeast corner of the Northeast quarter of Section 29, Township 13 North,
Range 19, E.W.M.,
thence North 89°14'10" West 230.02 feet along the South line thereof;
thence North 0°01'30" West 328.23 feet;
thence North 50°34'50" East 95.96 feet;
thence North 0°01'30" West 266.20 feet to the North line of said Lot 13;
thence South 89°09'25" East 155.86 feet along said North line to the Northeast corner thereof;
thence South 0°01'30" East 656.14 feet along the East line of said Lots 13 and 24 to the point of
beginning.
Also, the grantor herein convey and grant to the state of Washington all rights of ingress and
egress (including all existing, future or potential easements of access, light, view and air) to, from

herein reserve for itself, its successor or assigns, the right of reasonable access to the FC Line

on file in the office of the Secretary of Transportation at Olympia, and bearing date of approval

of Washington, for and in consideration of the sum of TEN AND NO/ 100 ($10.00) Dollars, and
other valuable consideration, convey(s) and quitclaim(s) to the State of Washington the following
described real estate, and any after acquired interest therein, situated in Yakima County, in the
State of Washington, under the imminent threat of the Grantee's exercise of its rights of Eminent
Domain:
See Exhibit A attached hereto and made a part hereof
It is understood and agreed that delivery of this deed is hereby tendered and that the terms
and obligations hereof shall not become binding upon the State of Washington unless and until
accepted and approved hereon in writing for the State of Washington, Department of

State of Washington for Properties Adjacent to the Yakima Arboretum for
the I-82, SR 24 Interchange Project

SUMMARY EXPLANATION: As part of the SR 24 redevelopment and bridge expansion, the
State of Washington has requested to purchase a small portion of City property located on the
north side of SR 24. The City has negotiated an agreement to sell the attached described
property to the State of Washington for $6,660. This amount includes a $3,660 appraisal value,
plus $3,000 for all damages.
