YAKIMA CITY COUNCIL MINUTES August 19, 2025 City Hall - Council Chambers - 129 N 2nd Street, Yakima WA 5:30 PM City Council Regular Meeting - Conducted in person and virtually via Zoom. 1) Roll Call Present: Mayor Patricia Byers, presiding; Assistant Mayor Matt Brown and Councilmembers Reedy Berg, Janice Deccio, Rick Glenn, Danny Herrera and Leo Roy Staff: City Manager Vicki Baker, Acting City Attorney Ryan Bleek and City Clerk Rosalinda Ibarra 2) Pledge of Allegiance Mayor Byers led the Pledge of Allegiance. 3) Interpreter Services Mayor Byers introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4) Public Comment Anne Knapp, City resident; and Mary Place, City resident, urged the Council to postpone any action related to the Yakima Valley Trolley agreement (Agenda Item 7E) until the full financial impact and additional information is provided. Lisa Downey, City resident, spoke against closure of Franklin pool. Consuelo Rodriguez introduced students of La Casa Hogar in attendance who are learning about their local government. Tony Courcy, City resident, spoke regarding a water rights claim. Leroy Bruce Golightly, City resident, expressed concerns about the Yakima Police Department. 5) Open Discussion for the Good of the Order 5.A Overdose Awareness Day proclamation MOTION: Brown moved and Berg seconded to approve the Overdose Awareness Day proclamation and request that it be read and presented. The motion carried by unanimous vote. Mayor Byers proclaimed August 29, 2025 as "Overdose Awareness Day11. Kim Hitchcock and Jessica Espinoza thanked Council and accepted the proclamation. August 19, 2025-Yakima City Council Meeting Minutes Page 1 of 6 30 6) Council Reports 6.A Lodging Tax Advisory Committee (LTAC) Report Mayor Patricia Byers, Chair of the Lodging Tax Advisory Committee, briefed Council on the LTAC meeting of August 14, 2025, and reported on the Committee's budgetary allocation recommendations based on the 2026 forecast for Lodging Tax Revenue of$1,800,000. • $490,000 - Debt Service - Fixed Allocation • $3,274 - City of Yakima Administrative Fees • $300,000 - Convention Center Capital • $641,226 - Convention Center Operations • $60,000 - Visitor Center Operations • $95,500 - Sports Commission Operations • $150,000 - Capitol Theatre Operations • $60,000 - Sundome John Cooper (President and CEO of Yakima Valley Tourism) and Connie Upton (General Manager of the Yakima Convention Center) addressed Council's questions regarding how the Lodging Tax supports the Yakima Convention Center and Visitor Center operations. MOTION: Deccio moved and Brown seconded to approve the Lodging Tax Advisory Committee recommendations as outlined. The motion carried by unanimous vote. 7) Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Items 7E and 7G were removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion-see motion directly below.) MOTION: Brown moved and Herrera seconded to approve the consent agenda. The motion carried by a 7-0 roll call vote. 7.A Approval of minutes from the August 4, 2025 City Council regular meeting 7.B Approve payment of disbursements for the period July 1 - 31, 2025 7.0 July 2025 Investment Transaction Report 7.D Resolution accepting and approving 2nd Quarter 2025 Claim Report RESOLUTION NO. R-2025-118, A RESOLUTION accepting and approving the 2nd Quarter 2025 Claim Report for the City of Yakima. 7.E This item was removed from the Consent Agenda. 7.F Resolution authorizing a First Response Agreement between Yakima County Fire Protection District No 4, the City of Union Gap Fire Department and the City of Yakima Fire Department August 19, 2025- Yakima City Council Meeting Minutes Page 2 of 6 31 RESOLUTION NO. R-2025-120, A RESOLUTION authorizing a First Response Agreement between Yakima County Fire Protection District No 4, the City of Union Gap Fire Department and the City of Yakima Fire Department for emergency aid response services. 7.G This item was removed from the Consent Agenda. 7.H Resolution authorizing a renewal of the service agreement with Penser North America, Inc., to serve as third party administrator of the City's workers' compensation program RESOLUTION NO. R-2025-122, A RESOLUTION authorizing a renewal of the service agreement with Penser North America, Inc., to serve as third party administrator of the City's workers' compensation program. 7.1 Resolution ratifying and approving the City Manager's execution of a grant agreement with the Washington State Office of Public Defense RESOLUTION NO. R-2025-123, A RESOLUTION ratifying and approving the City Manager's execution of a grant agreement with the Washington State Office of Public Defense accepting the terms and conditions for a reimbursable grant for 2025. 7.J Ordinance amending the 2025-2026 Biennial Budget for the City of Yakima and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2025-2026 for various purposes (Second Reading) ORDINANCE NO. 2025-027, AN ORDINANCE amending the 2025-2026 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2025 for various purposes. 7.K Resolution authorizing a second amendment to the Commercial Lease Agreement between the City of Yakima and the Greater Yakima Chamber of Commerce for property located at 10 North 9th Street in Yakima RESOLUTION NO. R-2025-127, A RESOLUTION authorizing a second amendment to the Commercial Lease Agreement between the City of Yakima and the Greater Yakima Chamber of Commerce for property located at 10 North 9th Street in Yakima. Items Removed from Consent Agenda: 7.E Resolution authorizing an Operation License Agreement with Yakima Valley Trolleys, a non-profit corporation In response to Councilmembers concerns related to the agreement provided, Community Development Director Bill Preston noted that the contract terms require further review. After Council discussion, MOTION: Glenn moved and Berg seconded to table the resolution (Item E) to a future date. The motion carried by unanimous vote. A RESOLUTION authorizing an agreement with Yakima Valley Trolleys to operate, maintain, and promote the City of Yakima's electric railway system and museum. August 19, 2025- Yakima City Council Meeting Minutes Page 3 of 6 32 7.G Resolution authorizing agreements with Flock Safety for annual subscription renewals Yakima Police Lieutenant Tory Adams clarified that the proposed resolution allows the continuation of their subscription and does not include new equipment. The City Clerk read the resolution by title only. After Council discussion, MOTION: Glenn moved and Berg seconded to approve Item G authorizing the agreements. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-121, A RESOLUTION authorizing agreements with Flock Safety for annual subscription renewals for the Yakima Police Department. Add-On Item: Acting City Attorney Ryan Bleek provided Council a resolution for consideration to extend the current operating agreement with the Yakima Valley Trolleys while the new agreement is further reviewed. MOTION: Brown moved and Berg seconded to suspend the rules to present an amended resolution. The motion carried by unanimous vote. The City Clerk read the resolution by title only. MOTION: Glenn moved and Berg seconded to adopt the resolution. The motion carried by a 6-1 roll call vote; with Deccio voting no. RESOLUTION NO. R-2025-119, A RESOLUTION authorizing an amendment extending the current agreement with Yakima Valley Trolleys to operate, maintain, and promote the City of Yakima's electric railway system and museum. 8) Public Hearings 8.A Closed record public hearing and Resolution to consider the Hearing Examiner's recommendation regarding the master planned development and subdivision for Champions Park Phases 2 - 6 Mayor Byers stated this is a closed record hearing and testimony will be limited to the record regarding the master planned development application. Mayor Byers administered the Appearance of Fairness Doctrine. Each Councilmember answered negatively or affirmatively to the following questions: 1. Do you have any interest in the property or the application, or do you own property within 300 feet of the property subject to the application?All Councilmembers responded they did not. 2. Do you stand to gain or lose any financial benefit as a result of the outcome of this proposal? The response from Council members was no. 3. Can you hear and consider the application in a fair and objective manner, without bias? All Council members stated they could. 4. Have you had any ex-parte communications with the Applicants, or anyone else, regarding this application? All Council members responded no. Mayor Byers asked if anyone wished to challenge any Council member's participation in this application on appearance of fairness grounds? No one from the audience or on Zoom spoke to the issue. August 19, 2025- Yakima City Council Meeting Minutes Page 4 of 6 33 Senior Planner Eric Crowell introduced this item and briefed Council on the Hearing Examiner's recommendation for approval of the proposal. Mayor Byers opened the public hearing. With no one coming forward or calling in to speak, Mayor Byers closed the public hearing. The City Clerk read the resolution by title only. After Council discussion and deliberation, MOTION: Deccio moved and Brown seconded to affirm the recommendation of the Hearing Examiner and adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-124, A RESOLUTION approving the Master Planned Development of Champions Park Phases 2 - 6 and authorizing and directing the City Manager to execute a Development Agreement with Prickly Pear Holdings LLC (herein after"Developer") to provide for the terms and conditions of development of a preliminary long plat and planned development to be located at the vicinity of Sorenson Rd. between S. 38th Ave. and S. 52nd Ave., in the City of Yakima. 8.B Public Meeting to consider the Notice of Intent to commence the Lochridge Annexation in the vicinity of 80th Ave and Loren Place Planning Manager Trevor Martin reviewed with Council information related to the proposed annexation of a single parcel located at 1504 S. 80th Avenue. After Council discussion, MOTION: Brown moved and Deccio seconded to direct staff to draft the official annexation petition and collect signatures from property owners to begin the annexation review procedures. The motion carried by a 7-0 vote. 9) Department Items 9.A Resolution authorizing application for and acceptance of FAA grant for Crosswind Runway Rehabilitation Director of Yakima Air Terminal Robert Hodgman briefed the Council on the proposed resolution. The City Clerk read the resolution by title only. MOTION: Deccio moved and Brown seconded to adopt the resolution authorizing application for acceptance of FAA grant for the Crosswind Runway Rehabilitation. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-125, A RESOLUTION authorizing a grant application to the Federal Aviation Administration for the design of the Crosswind Runway Rehabilitation project at Yakima Air Terminal-McAllister Field. 9.B Resolution authorizing the application for and acceptance of an FAA grant to construct terminal building baggage claim and restroom upgrades Director of Yakima Air Terminal Robert Hodgman briefed the Council on the proposed resolution. The City Clerk read the resolution by title only. MOTION: Brown moved and Deccio seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2025-126, A RESOLUTION authorizing a grant application to the Federal Aviation Administration for the Yakima Air Terminal Building Modernization project for Capital Improvements at the Yakima Air Terminal- McAllister Field. August 19, 2025- Yakima City Council Meeting Minutes Page 5 of 6 34 10) City Manager Update City Manager Vicki Baker thanked Council for the opportunity to attend the Washington City Manager's Association Conference and reported on her participation. 11) Other Business MOTION: Brown moved and Deccio seconded to add to the September 2nd regular meeting a proclamation celebrating Yakima United's League Championship. The motion carried by unanimous vote. MOTION: Byers moved and Brown seconded to direct staff to prepare a Harvest Marching Band proclamation to be presented in October. The motion carried by unanimous vote. Councilmembers expressed appreciation for the Yakima Police Department's response to recent events. Assistant Mayor Brown suggested that the full financial impact to the general fund be noted in future budget agenda items. 12) Adjournment MOTION: Brown moved and Deccio seconded to adjourn to the next City Council regular meeting on September 2, 2025, at 5:30 p.m. in the City Hall Council Chambers. The motion carried by unanimous vote.
