WHEREAS, the City of Yakima (City) granted to Wholesail Networks LLC and Ziply Fiber (Wholesail and Ziply) a telecommunications system franchise (Franchise) as set forth in Ordinance No, 2015-045 and amended by Ordinance No. 2019-034 and Ordinance No. 2022- 015 to use rights -of -way located in the City of Yakima for the purpose of providing telecommunications services; and; WHEREAS, certain assets were believed to be transferred which created a necessity for the new owner to request the City's consent to assign and amend the Franchise to reflect the new owner; WHEREAS, subsequent to City approving the assignment, City learned the assets purchased did not include the Franchise and the Franchise did not need to be amended or assigned, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Ordinance No. 2025-003 shall be repealed, Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. For Meeting of: August 4, 2025 ITEM TITLE: Ordinance repealing Ordinance 2025-003, a telecommunications system franchise granted to Wholesail Networks LLC and Ziply Fiber SUBMITTED BY: SUMMARY EXPLANATION: Randy Beehler, Communications & Public Affairs Director Earlier in 2025, certain assets of the franchise grantees were believed to be transferred, which created a necessity for the new owner to request the City's consent to assign and amend the Franchise to reflect the new owner. However, subsequent to the City Council approving the assignment, the City learned the assets purchased did not include the Franchise and the Franchise did not need to be amended or assigned. The Council is being asked to repeal the ordinance adopted earlier this year, which would result in the previous ordinance being reinstated.
