Home My WebLink AboutR-2002-131 Eagle Fireworks Display Permit (Davis High School ASB )RESOLUTION NO R-2002 -131 A RESOLUTION granting a public fireworks display permit to Eagle Fireworks and waiver of the S50.00 permit application fee on behalf of Davis High School ASB WHEREAS, Eagle Fireworks has applied to the City for a public fireworks display permit to conduct a public fireworks display at Zaepfel Stadium at Eisenhower High School on November 1, 2002; and WHEREAS, Eagle Fireworks has complied with the requirements of Sections 10.15.040 and 10.15.050 of the City of Yakima Municipal Code in that it has shown proof of adequate insurance, and is the holder of a valid State Fire Marshal Permit for such display and the Code Administration Manager has investigated and approved the location of such display, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Pursuant to the provisions of Section 10.15.040 of the City of Yakima Municipal Code, Eagle Fireworks is hereby granted a permit for public fireworks display according to the terms and conditions found upon the attached and incorporated permit application. And not less than Twenty - Five Thousand Dollars for property damage liability for each event and the Certificate of Insurance shall also name, as additional insured parties, the City of Yakima, its officers and employees acting in their capacity as agents of the City. Page 1 of 1 Title 10 FIRE Chapter 10.15 FIREWORKS 10.15.040 Permit for public display. It is unlawful for any person to make a public display of fireworks within the city of Yakima without having first obtained a permit to do so. Application to make such a display shall be made in writing to the code administration manager or his designee on forms provided for that purpose and shall be accompanied by a fifty -dollar fee for each display; provided, however, that the city council may waive the fifty -dollar application fee for student organizations. Application shall be made at least ten days in advance of the proposed display. The code administration manager or his designee shall investigate whether the character and location of the display as proposed would be hazardous or dangerous to any person or property. Based on the investigation the code administration manager or his designee shall submit a report of findings and a recommendation for or against the issuance of a permit, together with reasons, to the city council. The city council may grant or deny the application and may place reasonable conditions on any such permit issues. A permit for a public display of fireworks shall not be issued unless the person applying for the permit is a holder of a valid license issued by the State Fire Marshal to make such a display. If the city council grants a permit for the public display of fireworks, the sale, possession and use of fireworks for the public display is lawful for that purpose only. No such permit shall be transferable. Every public display of fireworks shall be handled or supervised by a competent and experienced pyrotechnic operator approved by the code administration manager or his designee. Manager SUMMARY EXPLANATION: Eagle Fireworks has applied for a permit on behalf of the Davis High School ASB to conduct a special fireworks display at Eisenhower High School, Zaepfel Stadium on November 1, 2002 at 8.30 in the evening. The display is being conducted by Eagle Fireworks at no charge to the school and a request has been made that the $50 permit application fee also be waived by the City Council. Pursuant to Yakima Municipal Code 10.15.040 City Council may waive the fee for student organizations. Evidence of liability insurance, state permit and site plan have been submitted and are on file in the office of Code Administration. The Public Display of Fireworks application complies with the provisions of Chapter 10.15 of the Yakima Municipal Code.
