RESOLUTION NO. $30 Car Tabs A RESOLUTION AUTHORIZING AND RECOGNIZING A $30 PROTEST PERMIT FOR THE PEACEFUL AND LAWFUL PROTEST OF VEHICLE LICENSING FEES (CAR TABS) WITHIN THE CITY OF YAKIMA WHEREAS, the people of Washington State voted to approve a measure to reduce vehicle'leensrr g fees (commonly known as "car tabs") to $30; and WHEREAS, many citizens, including those within the City of Yakima, have expressed a good -faith effort to comply with the democratic outcome of that vote and seek to protest ongoing enforcement of higher fees in a lawful and peaceful manner; and WHEREAS, the First Amendment to the United States Constitution guarantees the right to freedom of speech, peaceful assembly, and the right to petition the government for redress of grievances; and WHEREAS, cases such as Edwards v. South Carolina (19 (1969) affirm the right of individuals to expressdissent i regarding governmental policy; and Cox v. Louisiana (1965), and Shuttlesworth v. Birmingham ublic spaces, including symbolic and protest actions WHEREAS, citizens exercising a political protest of excessive vehicle licensing fees by affixing a "$30 Protest Permit'" to their vehicle or maintaining expired tabs due to refusal to pay above the voter -approved threshold may be engaging in protected expression of dissent, not criminal conduct; and WHEREAS, the City of Yakima seeks to balance public safety and order with the civil liberties of its residents and recognizes the legal moral, and constitutional implications of suppressing peaceful protest through punitive enforcement; NOW, T REFO E IT RESOLVED BY T E CITY COUNCIL OF THE CiTY OF YAKIMA: 1. Recognition of Protest Rights The City of Yakima officially recognizes a citizen's right to protest vehicle licensing fees by limiting payment to $30, consistent with prior voter mandates, as a legitimate form of political protest protected under the First Amendment. 2. Authorization of Protest Permits Citizens within the jurisdiction of the City of Yakima may affix a dearly visible sign or permit labeled "$30 Protest Permit" on their vehicle, indicating intent to lawfully protest excessive car tab fees, 3. Directive to Law Enforcement Officers of the Yakima Police Department shall be instructed not to initiate citations, criminal penalties, or vehicle impoundment based solely on expired tabs where: O Valid insurance is present; O The vehicle otherwise complies with safety and registration requirements; O The operator presents or displays the "$30 Protest Permit' in good faith; O There is no clear evidence of intentional fraud, deception, or public endangerment: 4. Legal Cooperation Clause The City Attorney shall coordinate with relevant state and municipal agencies to ensure that the enforcement of protest recognition does not conflict with applicable state laws and that any constitutional questions are resolved in favor of citizens' rights within the city limits only. 5. Non -Punitive Intent The purpose of this resolution is not to nullify state law but to preserve constitutional rights and recognize protected political speech within municipal enforcement discretion. 6. Public Education The City shall make available an informational pamphlet explaining the nature and limits of the $30 Protest Permit for public distribution and legal understanding.
