R-2001-129 A RESOLUTION declaring an emergency in that the Fruitvale Canal irrigation line needs immediate reconstruction and repair to provide continued irrigation to the citizens of Yakima, and in order to continue the Chesterley Park construction process without disruption, and declaring a sole source for the reconstruction and repairs, and authorizing and ratifying the City Manager's decision to execute all necessary documents and change orders with Evans & Son, Inc. and Wardell Architects, and any other necessary outside parties, to reconstruct and repair the Fruitvale Canal irrigation line without calling for bids. WHEREAS, Article VI, Section 6 of the Yakima Charter and Chapter 1.80 of the City of Yakima Municipal Code require that the purchase of supplies, materials and services costing more than $25,000.00 be accomplished by a call for bid; and WHEREAS, the law recognizes an emergency exception from these competitive bidding requirements in the event of an emergency; and WHEREAS, the Yakima Charter provision and YMC Section 1.80.040 allow the City Council to declare an emergency in certain situations and thereby dispense with the need to follow a competitive bid process; and WHEREAS, the City is currently constructing the final elements of Chesterley Park, consistent with the Park Comprehensive Plan; and WHEREAS, the Fruitvale Canal runs through the park site directly under the area to be developed into new soccer fields and additional parking, and WHEREAS, the City's contractor, Evans & Son., Inc., has discovered that the Fruitvale Canal in its current state cannot allow the development of the site due to extensive leakage between pipe joints on the irrigation line; and WHEREAS, prior to construction, an analysis of the pipe for load bearing capacity was conducted; however, it was not known or anticipated that the pipe would leak to the extent discovered and halt construction; and (sb)res/emer/FrwtvaleCanal/arig 01/11h • WHEREAS, the correction and repair to this pipe line requires repair and replacement of the pipe, not to exceed $200,000, to allow the Chesterley Park development to proceed and to allow continued irrigation service; and WHEREAS, the normal bid process for the reconstruction and repair of the Fruitvale Canal irrigation line would take in excess of six weeks, and would prevent the repair from being completed in a timely and immediate manner; and WHEREAS, timeliness is an issue both due to contract obligations and construction timelines, as well as irrigation delivery; and WHEREAS, correcting the defect immediately after the system is shut down for the season is necessary to avoid disruption of irrigation service and delivery to Fruitvale Canal customers in the succeeding year; and WHEREAS, it is essential to the health, safety, and welfare of the citizens of Yakima that immediate action be taken for the reconstruction and repair of the Fruitvale Canal irrigation line so that irrigation delivery is not delayed and service is not disrupted, and also so that the current ongoing construction project in Chesterley Park is not delayed and disrupted; and WHEREAS, Evans & Son, Inc., is the contractor who is currently constructing the final elements of Chesterley Park, including the new soccer fields and the additional parking; and WHEREAS, Evans & Son, Inc., is on site now performing the contract work and it. necessary, logical and reasonable to execute a change order with the current contractor to repair and reconstruct the Fruitvale Canal irrigation line in order to avoid mobilization, other startup costs, and delays, and to take advantage of their expertise regarding this ongoing construction project; and WHEREAS, Wardell Architects is the construction administrator for the Chesterley Park construction project; and WHEREAS, it is necessary, logical and reasonable to continue the services of Wardell Architects regarding the repair and reconstruction of the irrigation line to take advantage of their knowledge and expertise on this construction project; and (sb)res/ emer /FruitvaleCanal/ aug'O1/ hh WHEREAS, the City Council finds it to be in the best interest of the City to declare an emergency to exist due to the aforementioned conditions and to ratify the City Manager's action to execute all necessary documents with any needed outside parties, including specifically with Evans & Son, Inc., and Wardell Architects, for the reconstruction and repair of the Fruitvale Canal irrigation line without calling for bids, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Council declares an emergency situation to exist necessitating the immediate reconstruction and repair of the Fruitvale Canal irrigation line, declares a sole source of Evans & Son., Inc. and Wardell Architects to perform the necessary services, and authorizes and ratifies the City Manager's decision to execute all necessary documents, including change orders, with Evans & Son, Inc. and Wardell Architects, and with any other needed outside parties, to reconstruct and repair the Fruitvale Canal irrigation line for an amount not to exceed $200,000 without calling for bids. SUBMITTED BY: Dick Zais, City Manager Chris Waarvick, Public Works Director Kay Adams, City Engineer Dueane Calvin, Water & Irrigation Manager CONTACT PERSONITELEPHONE: Chris Waarvick, 576-6411 SUMMARY EXPLANATION: Staff respectfully requests City Council approval of the attached: 1) resolution declaring an emergency condition allowing for waiving of the formal bid process; and 2) appropriation ordinance to repair the Fruitvale Canal through Chesterley Park located at 40th Avenue and River Road. The current project at Chesterley Park consists of constructing the final elements of the park including two soccer fields, additional parking, pathways, and landscaping. This project is consistent with and implements the adopted parks comprehensive plan. The Fruitvale Canal was converted from an open ditch to an arched pipe in the early 1980's. Design analysis on the pipe was done to assure the pipe would withstand development loading over the pipe. During the recent construction of the new soccer fields, it has been discovered that the leakage of the pipe is to an extent that halts further construction of the soccer project identified above. Staff determined that the pipe be immediately replaced with a watertight system, estimated not to exceed $200,000, with the current contractor through a change order. These resources are from the Irrigation Capital Fund and require Council ratification of management's emergency actions and approval of the attached appropriation ordinance. Timeliness is critical. Immediately upon Fruitvale Canal season closure, the construction of the replacement pipe needs to begin. This will ensure that the irrigation system in 2002 will begin on time and city irrigation delivery obligations be met. The pipe will be replaced across the park property and construction of the remaining park elements can then resume. The City Manager has directed this work to commence immediately as an operational necessity and emergency.
