R-2001- lo] authorizing the City Manager to execute and file a funding assistance application for a Washington Wildlife and Recreation Program ("WWRP") project to the Interagency Committee for Outdoor Recreation ("IAC") as provided in Chapter 79A.15 RCW, Acquisition of Habitat Conservation and Outdoor Recreation Lands and all other applications, agreements, amendments and documents for the purpose of acquiring land to expand Kiwanis Park. WHEREAS, the City Council of the City of Yakima has approved a comprehensive plan that includes this project area; and WHEREAS, under the provisions of the VVVVRP, state and federal funding assistance is requested to aid in financing the cost of land acquisition; and WHEREAS, the City Council of the City of Yakima considers it in the best public interest to acquire land to expand Kiwanis Park to complete the acquisition project described in the funding assistance application; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. That the City Manager of the City of Yakima is hereby authorized to execute and file a formal application with the IAC for funding assistance; and 2. That any fund assistance received be used for the implementation of the project referenced above; and 3. That the City of Yakima certifies that its share of project funding is committed and will be derived from dollars received from the sale of Larson Park property currently in Parks and Recreation capital budget, and 4. That the City of Yakima acknowledges that it is responsible for supporting all non-cash commitments to the sponsor share should they not materialize; and 5. That the City of Yakima acknowledges that any property acquired with IAC financial aid must be placed in use as an outdoor recreation area and be retained in such use in perpetuity unless otherwise provided and agreed to by our organization, IAC and any affected federal agency; and 6. That this resolution becomes part of the formal application to IAC; and 13 7. That the City of Yakima provided appropriate opportunity for public comment on this application.
