R-2001- 82 A RESOLUTION fixing time for public hearing before the Hearing Examiner on June 28, 2001, on a petition filed with the City Clerk by Lee & Karen Curry. to vacate a segment of King Street between South 7 t & 8th Avenues. WHEREAS, pursuant to RCW 35.79.010, a petition has been filed with the City Clerk, requesting the vacation of a street or alleyway (or portion thereof) within the City of Yakima, a true copy of which petition is attached and incorporated into this resolution; and WHEREAS, such a petition has been signed by the owners of more than two-thirds (2/3) of the property abutting upon the street or alley (or portion thereof) which is requested to be vacated, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The above -referenced petition for vacation is hereby referred to the Hearing Examiner for public hearing pursuant to section 1.43.080 of the City of Yakima Municipal Code. The Hearing Examiner is directed to make written recommendation to the City Council regarding said petition. The Hearing Examiner Public Hearing shall be held on June 28, 2001 at 9:00 a.m. in the City Council Chambers of City Hall, which date and time are not more than sixty (60) days nor less than twenty (20) days after the passage of this resolution. It is further resolved that the City Clerk give notice of the Hearing Examiner public hearing in the form and manner prescribed by RCW 35.79.020 and Section 1.43.080 of the City of Yakima Municipal Code. We the alternately adjoining property owners of said plats, petition the City of Yakima to vacate this portion of the street, pursuant to RCW 35.79 and regain full and unfettered use of said property. Wise, Ow er o 521 S. 8th Ave March 19, 2001 City of Yakima Honorable Members of The Yakima City Council RE: City of Yakima Steet Vacation Narrative by adjoining property owners: The alternately adjoining property owners between South 7th Avenue and South 8th Avenue, two plats, "Coonse State Addition" and "Coonse State Addition No. 2", are 100 percent in favor in requesting the City of Yakima to vacate the property known as King Street. The adjoining property owners proclaim the following: No government entity maintained King Street for 64 years. Over these years, the property became an "environmental hazard". Complaints about the condition of King Street were ignored by Yakima County. For the benefit of neighborhood aestheics and their own protection, King Street adjoining property owners have used their time and resources to maintain said property for many years. Unkept, the property became a fire concern with dry weeds and brush. The air quality was poor, due to dust from dry earth. The property was a convenient dump for trash. The homeowner writing this narrative had an infestation of rodents, due to the garbage dumping, that took years to eradicate at considerable expense. There were dead animal carcass, rusted -out auto. parts, dismantled refrigerator and broken glass. Because none of the adjoining properties front King Street, the homes were at risk for vandalism and crime. To maintain the impovements of King Street, about 15 years ago, the adjoining property owners decided to restrict access by fencing off the said property. Chris Waarvick, director of public works, has conferred, "it appears we the adjoining property owners desire full use because of the lawns and fences". The said two plats were developed in 1937 and a total of 45 feet of right of way was "dedicated" to the County for King Street. However, the County apparently did not require this portion of street to be developed as a condition of the plat. As a result, King Street was never improved to a public street standard nor opened to the public for travel. The City of Yakima annexed this area in 1996 and has not conducted any maintenance of this street section, in part, because the street exists only on paper. Yakima County Public Works has confirmed, "no maintenance of this area occurred prior to annexation". As noted by Chris Waarvick, "neither the City or County will maintain an area dedicated for a street when no street exists. The responsibility comes at a time the street is accepted into the public system." We, the adjoining property owners, come now and request the City of Yakima to vacate the "dedicated" property, King Street, and return it to the property owners who have maintained it for years.
