R-2001- 39 A RESOLUTION denying the appeal (UAZO #16-00) by Bressler Outdoor Advertising of the Hearing Examiner's September 26, 2000, Decision affirming the Administrative Official's decision denying Bressler's Class (2) application to place a billboard at 105 East "E" Street. WHEREAS, on October 12, 2000, Bressler Outdoor Advertising appealed (UAZO #16-00) the Hearing Examiner's Decision (Examiner No. IU00-1-18, UAZO Appeal #11-00) dated September 26, 2000, affirming the Administrative Official's July 11, 2000, decision denying Bressler's Class (2) application to place a billboard at 105 East "E" Street; and WHEREAS, on February 6, 2001, the City Council considered Bressler's appeal UAZO #16-00 at a duly convened closed -record hearing; and WHEREAS, after considering the record established during the appeal heard by the hearing examiner, the arguments of the appellant, interested parties and the public, the City Council decided by motion to deny Bressler's appeal (UAZO #16-00) and to affirm the Hearing Examiner's September 26, 2000, Decision affirming the July 11, 2000, Notice of Decision of the Administrative Official denying the placement of a proposed billboard at 105 East "E" Street; now, therefore: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Bressler Outdoor Advertising's appeal, UAZO #16-00, of the Hearing Examiner's September 26, 2000, Decision (Examiner IU00-1-18, UAZO Appeal #11-00) affirming the Administrative Official's July 11, 2000, decision denying Bressler's Class (2) application to place a billboard at 105 East "E" Street is denied as of February 6, 2001. SUBMITTED BY: William Cook, Director of Community & Economic Development CONTACT PERSON / TELEPHONE: Dan Valoff, Associate Planner, 575-6163 SUMMARY EXPLANATION: On October 12, 2000 Bressler Outdoor Advertising appealed the Hearing Examiner's Decision affirming the Administrative Officials decision denying the placement of a billboard sign at 5 West Washington Avenue and at 105 East "E" Street. On February 6, 2001, the City Council considered Bressler's appeal at a closed record hearing and directed city legal staff to prepare the following legislation: A. Resolution granting the placement of a billboard sign at 5 West Washington Avenue. B. Resolution denying the placement of a billboard sign at 105 East "E" Street. Resolutions X Ordinance_ Contract Other (Speci Funding Source APPROVAL FOR SUBMITTAL: - City Manager STAFF RECOMMENDATION: Approve resolutions. BOARD RECOMMENDATION: Hearing Examiner denied the Class (2) appeal filed by Bressler Outdoor Advertising affirmed the building officials decision denying the placement of a billboard sign at 5 West Washington Avenue and at 105 East "E" Street.
